HomeMy WebLinkAboutResolution 1190 Creates SID No. 457 460 COMMISSION RESOLUTION NO. 1190 A RESOLUTION OF THE CITY COMMISSION OF THE CITY _OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVE>fENT DIST- RICT TO BE KNOWN AS SPECIAL IMPRO~NT DISTRICT NO. 457 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING WATER MAINS AND SANITARY SEWER LATERAL MAINS ON A PORTION OF SOUTH TRACY AVENUE BEGINNING AT A POINT 149.55 FEET SOUTHWESTERLY OF THE INTERSECTION OF SOUTH TRACY AVENUE AND SPRING CREEK I DRIVE TO HILL STREET, ON HILL STREET BETWEEN THIRD AVENUE SOUTH AND HIGHLAND COURT AND ON HIGHLAND COURT BETWEEN THE SOUTHERLY BOUNDARY OF THOMPSONS ADDI- TION NO. 3 TO A POINT 199.25 FEET WESTERLY OF THE INTERSECTION OF SAID HIGH- LAND COURT AND SPRING CREEK DRIVE. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated on a portion of South Tracy Avenue beginning at a point 149.55 feet southwesterly of the intersection of South Tracy Avenue and Spring Creek Drive""to Hill Street, on Hill Street betw~en Third Avenue South and Highland Court and on Highland Court between the southerly boundary of Thompson's Addition No.3 to a point 19~.25 feet westerly of the intersection of said Highland Court and Spring Creek Drive, asking that a special improvement district be created for the purpose of constructing and installing water mains and sanitary sewer lateral mains for all lots within the district. " WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on the 7th day of April,~965, the aforesaid petition was respectively considered and gl"&1lted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special lmp~ovement District No. 457 of the City of Bozeman for the purpose of constructing and installing water mains and sanitary sewer lateral mains, said project to include all appurtenant work for the construction of water mains and of a sewerage system to provide sanitary sewers I for all lots within the district. Section 2 Boundaries The boundaries of said Special Improvement District No. 457 are described as follows: Beginning at a stone monument marking the southwest corner of Section 18, Town- ship 2 South, Range 6 East, M.P.M. said monument being the southwesterly corner of Thompson's Addition Number J, to the City of Bozeman, Montana; thence 00- 01' West a distance of 515.52 feet to a point of intersection of the centerline of South Third Avenue and the northerly line of Hill Street extended westerly; thence North 89- 59' East a distance of 45 feet; thence North O. 01' West along the westerly line of Lot 2 of Block 4 of said Thompson's Addition No. 3 a distance of 235.31 feet; thence North 59~ 39' 50tr East a distance of 884.40 feet; thence South 30- 20' lon East a distance of 320.03 feet to the south- westerly corner of Lot 1 of Block 3 of said Addition; thence South 73- 50' East a distance of 61.26 feet; thence South 16- 10' West a distance of 373.0 feet to a point on the westerly lot line of Lot 2 Block 2; thence South 12- 33' West along the westerly lines of Lots 2, 3 and 4 of said Block 2, a dis- tance of 179.77 feet; thence South 07- 21' West along the westerly line of Lots 4, 5, 6, and 7 of said Block 2 a distance of 382.16 feet to the south- westerly corner of Lot 7 of said Block 2; thence North 89- 24' West along the southerly line of said Thompson's Addition No.3 a distance of 836.99 feet to the point of beginning. Containing within the above described exterior boundaries the following lots and parcel of land, to-wit: All of Lot 8, Block 2; Portion of Lot 5 of Block 3; portion of Lot 2 of I 4; all of Lots 1 and 2 ~f Block 5 of Thompson's Addition No. 3 to the City of Bozeman, Montana. Section J Character of Improvements The character of the improvements to be made is the installation and construction of an 8 inch water main on South Tracy Avenue and a portion of Hill Street and a 6 inch water main on a portion of Hill Street and Highland Court, including necessary valves, -' 4fi1 hydrants, fittings, copper service lines and neceseary appurtenances. Also the construction and installation of an 8 inch sanitary sewer pipe lateral on a portion of South Tracy Avenue, on Hill Street and a portion of Highland Court, including necessary manholes, lampholes, wyes, service lines and other necessary appurtenances. Section 4 I Estimat e of Cost Preliminary estimate of cost for this district is $62,000.00, including all trench exca- vation and backfill, all materials, installation costs, engineering and incidentals. Section 5 Method of Assessment The cost of such improvements is to be Assessed by the linear foot, againatthe entire district, each lot or parcel of land within such district bordering or abutting on streets , or avenues whereon or wherein the improvement or improvements have been made-to be assessed for its part of the whole cost in proportion to the linear feet abutting or bordering same. Total-linear feet in said Special Improvement District No. 457 is 4,818.27. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire, cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 457, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 457 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose in said Special Impr~nt District No. 457. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) I per annum, which interest shall be chargeable as part of the cost of construction and installa- tion of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applic- able provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improve- ment districts in cities and towns, and any amendments thereof or thereto. Section 7 Protest s and Notice That the regular session of the City Commission of the City of Bozemant to be held at the Commission Chamber, City Hall Building, Bozeman, Montana on Wednesday, the 28th day of April, 1965, at the hour of one o'clock p.m. of said day, is the time and place, when and where the City-Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement-District No. 457, the improve- ments proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. That Wednesday, the 28th day of April, 1965, at one o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1190 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the installation and construction of an 8 inch water main on South Tracy Avenue and a portion of Hill Street and a 6 inch water main on a portion of Hill Street and Highland Court, including necessary valves, hydrants, fittings, copper service lines and necessary appurtenances. Also the construction and installation of an 8 inch sanitary sewer~pe lateral on a por- tion of South Tracy Avenue, on Hill Street and a portion of Highland Court, including necessary manholes, lampholes, wyes, service lines and other necessary appurtenances. For a description of the boundaries of said Special Improvement District No. 457, reference is hereby made to Resolution No. 1190 of the Commission of the City of Bozeman declaring the intention to create said district, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally.
