HomeMy WebLinkAboutResolution 1189 Creates SID No. 456 1-5J~ COMMISSION RESOLUTION NO. 1189 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVE- MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT IDSTRICT NO. 456 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING SANITARY SEWER LATERAL MAINS IN A PORTION OF THE E! OF THE SE~ OF SECTION 11, TOWNSHIP 2 SOUTH, RANGE 5 EAST, LYING IMMEDIATELY WEST OF SOUTH TWENTIETH AVENUE AND SOUTHERLY I OF WEST BABCOCK STREET. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated in a portion of the E~ of the SE~ of Section 11, Township 2 South, Range 5 East M~P.M., lying immediately West of South Twentieth Avenue and southerly of West Babcock Street, asking that a Special improvement district be created for the purpose of constructing and installing sanitary sewer lateral mains to provide sanitary sewers for all lots within the district. WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on the 17th d~ of March, 1965, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 450 of t-he City of Bo~eman for the purpose of constructing and installing sanitary sewer lateral mains, said project to include all appurtenant work, for the construction of a sewer- age system to provide sanitary sewers for all lots within the district. Section 2 Boundaries I The boundaries of said Special Improvement District No. 456 are described as follows: Beginning at the northwesterly corner of Kirk Subdivision Number One, to Bozeman, Montana, said point being South 89Q24' West a distance of 435 feet of the one-quarter corner common to Sections 11 and 12, Town- ship 2 South, corner common to Sections 11 and 12, Township 2 South, Range 5 East, M.P.M.; thence South along the westerly line of said Kirk Subdivision Number One a distance of 2026.91 feet; thence South 89Q54 , 30" West a distance of 445 feet; thence North parallel to and 445 feet distant westerly from the westerly line of South Twentieth Avenue a distance of 2028.27' more or less to the northerly line of the southeast quarter of said Section 11; thence North 890 24' East a distance of 445 feet to the point of beginning. Containing within the above described exterior boundaries 888,927.55 square feet. Section 3 Character of Improvements The character of the improvements to be made is the installation and construction of an 8' vitrified Tile sanitar,y sewer pipe, including necessary trench excavation, backfill, necessary manholes, wyes and other appurtenances necessary to the work. Section 4 Estimate of Cost Preliminary estimate of cost for this district is $15,000.00, including all trench excavation and backfill, all materials, installation costs, engineering and incidentals. I Section 5 Method of Assessment The cost of such improvements is to be assessed against the entire district, each lot or parcel of land within such district, will be assessed for that part of the whole cost, which its area bears to the area of the entire district exclusive of streets, avenues and alleys. Section 6 Extended District The City Commission of the City of Bozeman does hereby find that the contemplated 8~J\1 work and improvements are, in the opinion of the City Commission, of more than local or ordin- ary public benefit and that the cost and expense of such improvements shall be chargeable on an extended district and the City Commission does hereby declare that the above described district and all lots included therein will be benefited by the contemplated improvements and that said district and all lots included therein shall be assessed to pay the costs and expenses thereof. Section 7 I Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 456, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 456 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose in said Special Improvement District No. 456. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) per annum, which interest shall be chargeable as part of the cost of con- struction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 8 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 7th day of April, 1965, at the hour of one o'clock p.m. of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District 456, the improve- ments proposed to be made pursuant thereto and the extent and character thereof, or either I thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the dirst publication of this notice. I - The general character of the improvements proposed to be made is the construction and installation of sanitary sewer lateral mains in a portion of the E~ of the SEt of Sec- tion 11, Township 2 South, Range 5 East, M.P.M., lying immediately West of South Twentieth Avenue and southerly of West Babcock Street. The estimated cost of said improvements is $15,000.00, including all trench excavation and backfill, all materials, installation costs, engineering and incidentals. For a description of the boundaries of said Special Improvement District No. 456, refer- ence is hereby made to Resolution No. 1189 of the Commission of the City of Bozeman declar- ing the intention to create said district, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally.
