COMMISSION RESOLUTION NO. 1188
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT
TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVE-
MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 454 FOR
THE PURPOSE OF CONSTRUCTING AND INSTALLING SANITARY SEWER LATERAL MAINS
TO SERVE PORTIONS OF BLOCKS 23, 24, 27, 28 and ALSO PORTIONS OF VACATED
ALLEYS OF BLOCKS 24, 27 and 28, ALSO PORTIONS OF VACATED EAST MAIN STREET,
EAST MENDENHALL STREET, AYLSWORTH AVENUE AND SWITZLER AVENUE, ALL IN THE I
NORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA.
WHEREAS , there has been filed with the Clerk of the City Commission of the City of
Bozeman, Montana, a petition in due form of certain owners of properties situated in portions
of Blocks 23, 24, 27, 28 and also portions of vacated alleys of Blocks 24, 27 and 28, and
also portions of vacated East Main Street, Esst Mendenhall Street, Aylsworth Avenue and Swit-
zler Avenue, all in the Northern Pacific Addition to Bozeman, Montana, asking that a special
improvement district be created for the purpose of constructing and installing sanitary sewer
lateral mains to provide sanitary sewers for all lots within the district.'
WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held
on the 17th day of March, 1965, the aforesaid petition was respective~ considered and
granted;
NOW, THEREOFRE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the Intention of the City of Bozeman to create a
special improvement district to be known and designated as Special Improvement District
No. 454 of the City of Bozeman for the purpose of constructing and installing sanitary
sewer lateral mains, said project to include all appurtenant work, for the construction
of a sewerage system to provide sanitary sewers for all lots within the district.
Section 2
Boundaries

The boundaries of said Special Improvement District No. 454 are described as follows:
Beginning at the southwesterly corner of Lot 32 of Block 28 of Northern
Pacific Addition to the City of Bozeman, Montana; thence northerly along
the westerly lines of Lots 1 and 32 of said Block 28 and said property
lines extended northerly 60 feet to a point on the northerly line of
vacated East Mendenhall Street; thence easterly along the northerly line
of said East Mendenhall Street a distance of 710 feet; thence southeasterly
at an exterior angle to the right of 750 3D' with the northerly line of
said vacated East Mendenhall Street a distance of 471.5 feet more or less
to a point of intersection with the northerly line of Lot 16 of Block
24 of said Northern Pacific Addition; thence westerly along said northerly
line to the northwesterly corner of said Lot 16; thence southerly along
the westerly lot line of said Lot 16 and said Lot line extended southerly
to a point of intersection with the northerly right of way line of U.S.
Highway Number 10; thence northwesterly along said northerly right of
way line of U.S. Highway Number 10 to the point of beginning.
Including within the above described exterior boundaries the following
lots, blocks and parcels of land, to-wit:
Portion of Lots 15 and 16 of Block 23.
Portions of Lots 1,
2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14 and all of Lots 12 and
15, of Block 24, portion of vacated alley of said Block 24.
All of Lots 1, 2, 3, 4, 5, 13, 14, 15, 16, 17, 18, 19, 20,
21, 22, 23 ~d 24, also portions of Lots 6, 7, 10, 11 and 12
and portion of the vacated alley, all in Block 27.
All of Lots 1 thru 32 and vacated alley of Block 28.
Portion
of vacated East Mendenhall Street, portion of vacated East

Main Street, portion of vacated Aylsworth Avenue and a portion
of vacated Switzler Avenue all in the Northern Pacific Addition
and within the above described exterior boundaries.
Containing within the above described exterior boundaries
368,821.06 square feet.

Section 3
Character of Improvements
The character of the improvements to be made is the installation and construction of
an 811 vitrified Tile sanitary sewer pipe, including necessary trench excavation, backfill,
necessary manholes, wyes and other appurteances necessary to the work.

Section 4
Estimate of Cost
Preliminary estimate of cost for this project is $31,000.00, including all trench exca-
vation and backr'ill, all materials, installation costs, engineering and incidentals.
Section 5
Method of Assessment
The cost of such improvements is to be assessed against the entire district, each lot
or parcel of land within such district, will be assessed for that prrt of the whole cost,
, which its area bears to the area of the entire district exclusive of streets, avenues and
alleys.
Section 6
Extended District
The City Commission of the City of Bozeman does hereby find that the contemplated work
and improvements are, in the opinion of the City Commission, of more than local or ordinary
public benefit and that the cost and expense of such improvements shall be chargeable on an
extended district and the City Commission does hereby declare that the above described dist-
rict and all lots included therein will be benefited by the contemplated improvements and
that said district and all lots included therein shall be assessed to pay the costs and ex-
penses thereof.
Section 7
Payments
I The payments for said improvements shall be made in twenty (20) annual installments
extending over a period of nineteen (19) years, but this shall not be construed to prevent
payment in full at any regular payment date by any property owner who desires to do so.
It is proposed to p~ the entire cost and expense of the construction and installation of
said improvements with cash to be obtained from the sale of bonds of said Special Improve-
ment district No. 454, as authorized by law.
Such bonds will be in denominations of $100.00
each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable
against a fund to be known and designated as Special Improvement District No. 454 Fund of
the City of Bozeman.
The bonds will be redeemable at the option of the City, singly or in
multiples, and in the order of their registration, whenever funds are available for the pur-
pose in said Special Improvement District No. 454.
Said bonds shall draw a simple interest
from the date of their registration until called for payment, at a rate not to exceed six
percent (6%) per annum, which interest shall be chargeable as part of the cost of construction
and installation of said improvements.
The bonds will be issued and sold in accordance with
the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and
all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating
to special improvement Districts in cities and towns, and any amendments thereof or thereto.
Section B
Protests and Notice
That the regular session of the City Commission of the City of Bozeman, to be held at
the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 7th day of
April, 1965, at the hour of one o'clock p.m. of said day, is the time and place, when and
where the City Commission will hear and pass upon all protests duly and regularly made and
filed against the creation of said proposed Special Improvement District 454, the improve-
ments to be made pursuant therto and the extent and character thereof, or either thereof;
and the Clerk of the City Commission be, and she is hereby directed to give notice in the
manner and for the time as by law required, of the adoption of this Resolution of Intention.
I ADOPTED by the Commission of the City of Bozeman, Montana, at a regular and stated
session of said Commission held on the 17th day of March, 1965.
