WHEREAS, at a regular session of the Commission of the City of Bozeman, State of Montana, held on the 10th day of March, 1965, the said Commission duly passed Commission Resolution No. 1188 declaring it to be the intention of the said Comm- ission to crea te a special improvement district to be known and designa ted as Special Improvement District No. 448 of the said City for the purpose of con- structing and installing a pavement project on South Tracy Avenue from a point 249.7 feet southerly of the South line of Cleveland Street to tlJUtherly line of Garfield Street, and on West Garfield Street from he easterly curb line of South Willson Avenue to the junction with South Traoy, and to specially assess the entire cost and expense of making said improvanents against the property within said District under and by virtue of the provisions of the laws of the State of Montana in suoh case made and provided, and said Commission Resolution No. 1180 is hereby referred to and made a part hereof for further particulars in respect to the b:mndaries of said Special Improvetmnt District No. 448, the estima ted cos t of said inprovements and the method of assessing the same against the property of said District; and WHEREAS, notice of the passage of said Commission Resolution No. llHO was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general oirculation printed and publ1ahed in the City of Bozeman, Montana, and by sending a copy of such notice by U.S. Mail to each perscn, firm or corporation having property within the proposed District at his or its last known address, upon the same date that such notice was first published as aforesaid, and due proof having been made of the publioation and service of said notice; and WffiREAS, wi thin the time provided by law and said published and served notice I there were not suffioient protests against the creation of said proposed Special Improvement Distriot No. 448, and the City Commission was in regular session on the lOth day of March, 1965, at one o.ciock p.m. of said day, at the Commission Chamber in the City Hall Building in the said City of Bozeman, the same being the time and pIa oe designa ted in said notice for passing upon Iii 11 prates ts, if any, against the proposed work or against ue oreation or extent of said District, or both or either; and it further appearing that all of the proceedings for ue creation of said Distriot have been lawful and regular; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: See tim I That said Special Improvement District No. 448 of he City of Bozeman, State ~ Montana, be, and the same is hereby crea ted for the purpose of making the im- provements as in said Resolution of Intention No. llHO and hereinafter described. Section 2 That said special Improvell.&nts be, and tb9 same are, hereby ordered to be made in said Special Improvement District No. 448 as follows: CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC-CONCRETE m VEMENT PROJECT WITH TNTREGAL CONCRETE CURBS AND GUTTERS AND THE NECESSARY ftP FURTENENCES TO SAID CONSTRUCTION AND INSTALLATION ON SOUTH TRACY AVENUE FROM A POINT 249.7 FEET SOUTHERLY OF THE SOUTH LINE OF CLEVELAND STREET T\O) SOUTHERLY LINE OF GARFIELD STREET AND ON WEST GARFIELD STREET FROM THE EASTERLY CURB LINE OF SOUTH WILLSON AVE- NUE TO THE JUNCTION WITH 3:>UTH TRACY. Section :3 I That the ent:1re cost and expense of making the special improvement herein referred to in said Special Improvement District No. 448 sha.li be pl1d by Special Impro vanent Dis trict Coupon Bonds, as authorized by the laws of the Sta te of Montana, which bonds shall b e in denomina tion of One Hundred Dollars ($lOO.OU) eaoh, and fraotions or multiples thereof where necessary, to be issued and chargeable against a fund to be known as "Special Improvement District No. 448 Fund", said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever .funds a re available for that purpose from said Special Improvement Dis- triot No. 448 Fund; said bonds shall draw interest at a rate not b exceed six- percent (6%) per annum, Which shall be chargeable as a part of the cost of said improvements and she.Ll run from the date of the registration of said bonds until said bonds are IBid. To pa y said bonds, and the interest thereon, representing the cost of said improvement, a special assessment shail be levied against all -- 4r-O -" of the lands within said Special Improvement District No. 448 as in said Resolution of Intention No. 1180 defined. Section 4 Said assessment and taxes shall be payable in twenty.' (20) annual ins tailments extending over a period of nineteen (19) years, with interest on deferred payments; but this provision shall not be cQnstrued to prevent full pa:vment at any time. Section 5 I Tha t the City Engineer be, a nd he is hereby directed m prepare plans and specifications for the doing of said work and the making of said improvements. Section 6 Tm. t pursuant to the It'ovisions and 8utrori ty conferred by Section 11-2232, Revised Codes of Montana 1947, said bonds may be sold to the highest and best bidder 'therefor for cash, and the proceeds of such sale used in making payment to t1:e contractor, or contractors, for Slch work, and such payment may be made ei ther from time to time on es tima tes made by the engineer in charge of such improvements for t1:e City, or upon the ent:1re completion of the improvements and the acceptance thereof by the City Commission. Section 7 Tl'Et upon ccbmpletion of plans and specifications by the City Engineer for the doing of said work and t he making of said improvements, the Clerk of the City Commissi on of the Oi ty of Bozeman, Mon tana, be, and is hereby d1 rec ted to publish a notice inviting proposals for the making of said improvements on said Special Improvements District No. 448, which notice shall refer to the plans and speci- fications on file, by publishing 8uch notice in two(2) issues of the Bozeman Daily Chronicle, .8 dailf newspaper printed and published in the City of Bozeman, not less than ten (10 days before the time such bids w ill be opened.
