I WHEREAS, The City Commission of The City of Bozeman, did on the 9th day of December, 1964, duly and regularly pass Commission Resolution No. 1162, entitled: A RESOLUTION OF THE CITY COWMISSION OF THE CITY OF BOZ~AN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IM- PROiffiMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 445 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE PAVE- MENT PROJECT WI TH I NTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURT- ENANCES TO SAID CONSTRUC TION AND INSTALLATION ON THE FOLLOWING STREETS AND AVENUES, TO-WIT: A PORTION OF NORTH EIGHTEENTH AVENUE BETWEEN DURSTON ROAD AND THE SOUTHERLY LOT LINES OF LOT 26, BLOCK "An AND LOT 9, BLOCK "B" OF GRAF'S FIRST REARRANGEMENT OF BLOCK 6 OF KIRK'S SECOND SUBDIVISION TO THE CITY OF BOZEMAN, MONTANA. and thereafter, after due and legal proceedings had, the Co~mission of The City of Bozeman did on the 30th day of December 1964, duly pass Commission Resolution No. 1167, en ti tIed: A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF BOZEMAN CREATING A SPECIAL IMPRO VEMENT Dr STRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DI STRICT NO. 445 OF 'lliE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND IN- STALLING A PAVE1ffiNT PROJECT ON THE FOLLOWING STREETS AND AVENUES, TO-WIT: A PORTION OF' NORTH EIGHTEENTH A VENUE BETWEEN DURSTON ROAD AND THE SOUTH- ERLY LOT LINES OF LOT 26, BLOCK "At! AND LOT 9, BLOCK "B" OF GRAF'S FIRST REARRANGEMENT OF BLOCK 6 OF KIRK'S SECOND SUBDIVISION TO THE CITY OF BOZEMAN, MONTANA. which Commission Resolution Nos. 1162 and 1167 passed as aforesaid, are hereby I referred to and made a part of this resolution for further particulars in respect to the boundaries of said district, the character of improvements to be constructed there in, the esti"nated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements are contemplated in said Cowmission Resolution Nos. 1162 and 1167 have been constructed and completed in aocQrdance with the terms and conditions of Commission Resolutions Nos. 1162 and 1167, and the to ta 1 coat of said improvements so constructed is the sum of SiXteen Thousand Dollars and No/100ths. ($16,OOO.OU~ . NOW, THEREFORE, pursuant to the provisions of Sections 11-2201 to 11-2273 and 11-3301, R.C.M., 1947 and amendments thereto. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA. See tion 1. That to defray the cost and expense of c0nstructing and making the improvements in said Special Improvement No. 445, there be, and there is hereby levied and assessed a tax amounting to the sum of $ixteen Thousand Dollars and I No/lOOths. ($16,000.00) upon all the property in said Special Improvement District No. 445, that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payments to be made and the day when the same shall be delin- quent is set forth in detail in the assessment list hereto attached, marked Schedule II A ", and made a part hereof; tha t the several sums set opposite the names of the Commission Resolution No. 1223 34 owners and the described 10 ts and pa ree Is of land be, a nd the same are hereby respectively levied and assessed up0n and against said describe d lots and parcels of land to defray the cost and expense of cons tructing and making the improvements within said District; tha t the several sums so assessed be collected from the re- spective owners of said lots and parcels of land described in said assessment list, I Schedule "A", as required by law; tha t the payment of said sums shall be made in 20 installments and the payment of said installments shall extend over a period of 19 years; that the payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all installments to- ge ther wi th the interest thereon, shall be made; tha t said sums shall be paid and the collection thereof shall be made in the manner and in accordance wi th the law governing the collection of special improvement taxes; that failure to pay such assessments when the same become due and payable sha 11 n:ake such persons and said lots and parcels of land liable to the penalties provided by law relative to de- linquent taxes. Section 2. 'Iha t t he regular session of the Commission of The City of Bozeman to be held in ilie Commission Chamber in the Cl ty Ha 11 of sa id oi ty on the 8th da y Of Sep tember , 196 5 , at 1:00 o'clock P.M., be, dnd the same is hereby designated as the ti~!"e and place at which objections to the final Fldoption of this Resolution will be heard by said Commission. Section 3. That the Clerk of the Commission of ~he City of Bozeman be, and I she is hereby ordered and directed to publish in the bOZ eman Dai ly Chron lcle, a daily newspaper prin ted and published in the said C1 ty of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defra y the cos t and expense of cons truc ting and making the .improvements in the said Special Improvement District No. 445 is on file in t he office of the Clerk of the Commission subject to inspection for a period of five (5) da ya ; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; tha tit shall be published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this Resolution. I NOTICE IS HEREBY GIVEN, that at a regular sessIon of the Commission of The City of Boz eman he Id on the Is t day of Sep tember, 1965, Commission Resolution No. 1223, was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the prope rty in Spe cia 1 Improvemen t District No. 445 in said City, to ~efray the cost and expense of constructing and making the improvements within said District, to-wit: The boundaries of said Special Improvement District No. 445 are described as follow s : Beginning at the northeasterly corner of Grafts First Rearrangement of Block 6 of Kirk's Second Subdivision to the Oi ty of Bozeman, Montana; thence westerly along the northerly line of said Grafts First Rearrange- ment a distance of 2U feet to the northeasterly corner of Lot 1 of Block f'B" of said Graf's First Rearrangement, being the true point of beginning; thence southerly along the easterly lot lines of Lots 1 through 9 of Block "B" of said Graft s First Rearrangement to the southeasterly corner of said Lot 9; thence westerly along the southerly line of said Lot 9, and across North Eighteenth Avenue and along the southerly lot line of Lot 26 of Block "A" of said Graf's First Rearrangement to the southwesterly corner of said Lot 26; thence northerly along the westerly lot lines of Lots 26 through 34 of Block "A" of said Graf's First Rearrangement to the northwesterly corner of said Lot 34; thence easterly along the northerly line of said Grafts First Rearrangement to the true point of beginning: I Included within the above described exterior boundaries the following Lots and Blocks, to-wit: Lots 26 through inclus i ve, of Block "A" and Lots 1 through 9 inclusive of Block "B" of Grafts First Rearrangement of Block 6 of Kirk's second Subdivision to Bozeman, Montana Tha t, said Commission Resolu tion No. 1223 us now on fi Ie in theofric e of the Clerk of t he Commission, subject to inspection for a period of five (5) days by any persons interested. That Wednesday the 8th day of September, 1965, at 1:00 o'clock p.m., of said day a t the regular session of the said Commission of The City of Bozeman at the Commission Room, in the Oi ty Hall Building of said Ci ty, has been designated as the time and place where the said Commission will hear and pass upon any and all objections that may be made to the fina 1 passage and adoption of said Resolution No. 1~223, and the levying of said assessment, and that said Resolu tion wi 11 be finally pa ssed and adop ted at said regular session.
