A RESOLUTION OF THE
COYMISSION OF THE CI TY OF BOZEMAN, MONTANA, LEVYING
AND ASSESSING A SPECIAL
ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN
SPECIAL IMPRO VEMENT
Dr STRIC T NO. 444 IN THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF
MONTANA, TO DEFRAY THE COST OF C8NSTRUCTING AND MAKING
THE IMPROVEMENTS
WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 444.
I WHEREAS, The City
Commission of The City of Bozeman, did on the 23rd day of
December, 1964, duly and regularly pass Commission Resolution No. 1172, entitled:
A RESOLUTION OF THE CITY

BE THE INTENTION OF THE
CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEYENT DISTRICT
TO BE KNOWN AS SPECIAL
IMPROVEMENT DISTRICT NO. 444 OF THE CITY 01" BOZEMAN FOR
THE PURPOSE OF CONSTRUCTING
AND INSTALLING A STORM DRAIN AGE SYSTEM TO SERVE
THE AREA ON NORTH
EIGHTEENTH A VENUE BETWEEN WEST BEALL STREET AND DUES'IDN ROAD
AND '!HENCE NORTHERLY
THROUGH rrHE MAP LE TERRACE SUBDIVISION AND ON BLACKMORE
PLACE TO lliE NORTH
LINE OF SAID SUBDIVISION, SAID STORM DRAINAGE PROJECT TO
INCLUDE NECESSARY

and thereafter, after due and legal proceedings had,

DURSTON ROAD AND THENCE NORrrHERLY THROUGH THE MAPLE TERRACE
SUBDIVISION AND ON
BLACKMORE PLACE TO THE NORTH LINE OF SAID SUBDIVISION.
which Commission Resolution Nos.1172 and 1179, passed as aforesaid, are hereby re-
ferred to and ma de a part of this resolut ion for further particula rs in r espe c t to
the boundaries of said district,
the character of improvements to be constructed
I therein, the
estimated cost of said improvements and the method of assessing the
cost against the property within said district; and
WHEREAS,
said improvements are contemplated in said Commission Resolution
Nos. 1172 and 1179 have been constructed and completed in accordance with the terms
and conditions of Commission Resolutions Nos. 1172 and 1179, and the total cost of
said improvements so constructed is the sum of Twenty-thousand One-hundred Sixty-
five and 50/l00ths
($20,165.50)
NOW,
THERE1"ORE, pursuant to the provisions of Sections 11-2201
to 11-2273 and
11-3301, R.C.M.,
1947 and amendments thereto.
BE IT RESOLVED AND
IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF
BOZEMAN, STATE OF MONTANA.
Section 1.
Tha t to defray the cost and expense of cons tructing and making the
improvements in said Special Improvement No. 444,
the re be, and the re is hereby
levied and assessed a tax amounting to
the sum of Twenty-thousand One-hundred
Sixty-five and 50/l00ths
($20,165.50) .upon all the property in said Special Im-
provement District No. 444,
tha t a particular description of each lot and parcel
I of land with the name of
the owner and t he sum assessed against him or it for such
improvements and the amount of each partial payment to be made and the day when the
same shall be delinquent is set forth in detail in the assessment list hereto attached
marked Schedule "An
and made a part hereof,
the t the several sums set opposite the

names of the owners and the described lots and parcels of land be, a nd the same are
hereby respectively levied and assessed upon and against said described lots and
parcels of land to defray the cost and expense of constructing and making the im-

so assessed be collected
from the respective owners of said lots and parcels of land described in said assess-
men t lis t, Schedule !II! A " , as required by law;
tha t the paymen t of said sums shall be
made in 10 installments and the payment of said installments shall extend over a per-
iod of 9 years;
that the payments of the respective annual installments shall be made

on or before the 30th day of November of each year until payment of all installments
together with the interest thereon, shall be nade;
that said sums shall be paid and
the collection thereof shall be made in the manner and in accordance with the law
governing the collection of special improvement
taxes;
tha t failure to pay such
assessmen ts when the same become
due and payable shall make such persons and said
lots and parcels of land liable to the penalties provided
by law relative to delin-
quent taxes.
Section 2.

to be held in the Commis sion Chamber in the
City Hall of said
city on the 1st day
of Sep tember , 1965,
at 1:00 o'clock P.M., be, and the same is

the time and place at which objections to

be heard by said Commission.
Section 3.

LEVYING ASSESSMEN'J' SPECIAL IMPROVEMENT DI STRICT NO. 444,
CITY OF' BOZEMAN CONSTRUCTING AND INSTALLING A STORM DRAIN-
AGE SYSTEM TO SERVE WE AREA ON NORTH EIGHTEENTH AVENUE
BETWEEN WEST BEALL STREET AND DURSTON ROAD.
I NOTICE IS HEREBY GIVEN,
that at a regular session of the Commission of
the City of Bozeman held on the 25th day of August, 1965,
Commission Resolution
No. 1222 was provisionally passed and adopted; that said Commission Resolution
levies and assesses a specia 1 assessment of t axes upon all the property in
Special Improvement District No. 444 in s aid City,
to defray the cost and ex-
pense of constructing and making
the improvements within said District, to-wit:
Beginning at the Southwest Corner of Section 1, T2S, R5E; thence
northerly along the West line of Section 1, also being the West
line of Maple Terrace Subdi vision,
to a point on the section line,
being the northwest corner of Maple Terrace Subdivision;
thence
easterly along the North line of Maple Terrace Subdivision
to the
Northeast corner of Maple Terrace Subdi vi sian; thence sou therly
along the East line of Maple Terrace Subdivision, being the West
line of North 17th Avenue, to a pOlr-t on the Sou th line of Section
1, being the Southeast corner of Maple Terrace Subdivision and
110.01 feet easterly from the Northeast corner of Grafls First
Rearrangement of Block 6 of Kirk Second Subdivision to Bozeman,

said day at the regular session of the said Commission of The
City of Bozeman, at t he Commission Room, in the City Hall Building of said City,
has been designated as
the time and place where the said Commission will hear and
I pass upon any and all objections that may
be made to the fina 1 passage and adoption
of said Resolution No.
1222, and the levying of said assessment, and

solution will be finally passed and adopted at said
