SUBJECT: Amendment No. 3 to Professional Services Agreement for North 7th Ave. Lighting Design and Construction

RECOMMENDATION: Approve and authorize City Manager to sign Amendment No. 3 to
the Professional Services Agreement.
BACKGROUND: On July 11, 2010 the Bozeman City Commission approved a professional services agreement with Morrison Maierle for the North 7th Avenue Lighting Design and Construction. This contract was for $115,861.86 and included provisions for preliminary design,
final design, picture renderings of the proposed lights within the corridor, bidding, and
construction management services for phase one of the project. The original contract included
contingencies to allow the agreement to be modified to include future design work as the lighting project was phased to the south towards Main Street.
Since the original there have been two previous amendments to the original contract. These
amendments included services for right of way investigation, easement drafting, change in
lighting designs, and other miscellaneous services that have been requested by the North 7th Urban Renewal Board (NSURB). To date, the original contract and the previous two amendments total approximately $168,200.
This proposed amendment is for the design and construction administration for the second phase
of the N. 7th lighting project. The limits of the second phase of the lighting project are from Juniper Street to Durston Road.
At their March 6th monthly meeting NSURB recommended approval of the proposed
amendments to this professional services agreement. Engineering staff has reviewed the
amendment and found it to be acceptable.

FISCAL EFFECTS: The NSURB Work Plan and Budget has set aside funds for
engineering design services and construction for the second phase of the N. 7th Avenue lighting
project in FY 2014 and FY 2015 budgets.
ALTERNATIVES: As suggested by the City Commission.
