HomeMy WebLinkAboutResolution 1220 Improvements on SID No. 442 21 COMMISSION RESOLUTION NO. 1220 A RESOLUTION OF THE COMMISSION OF THE CI TY OF BOZEMAN, MONTANA, LEVYING AND ASSESSIN G A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 442 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, ~O DEFRAY THE COSTS OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 44a. - I WHEREAS, The City Commission of The City of Bozeman, did on the 12th day of August, 1964, duly and regularly pass Commission Resolution No. 1129, entitled: A RESOLUTION OF THE CI TY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 442 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PA VEMENT PRO- JECT ON THE ENTIRE LENGTH OF BLACKM:ORE PLACE ANDtffiRRACE A VENUE IN MAPIE TERRACE SUBDIVISION TO THE CITY OF BOZEMAN, BEING A REARRANGEMENT OF TRACTS 1, 2, 3, 4, 9, 11 and 13 OF HOMESITES SUBDIVISION, SAID PAVEMENT PROJECT TO INCLUDE CONSTRUCTION OF DRAINAGE FACILITIES, COMBINATION CURB AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE AND AN ASPHALTIC-CONCRETE SURFACE COURSE, AND OTHER WORK INCIDENTAL THERETO. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 2nd day of September, 1964, duly pass Commission Resolution No. 1131, entitled: A RESOLUTION OF THE CITY C OMMISSI ON OF 'lliE CI'IT OF BOZEMAN CREA TIN G A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 442 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND IN- STA LLING A PAVEMENT PROJECT ON THE ENTIRE LENGTH OF BLACKMORE PLACE AND TERRACE AVENUE IN MAPLE TERRACE SUBDIVISION TO 'lliE CITY OF BOZ}:MAN BEING A REARRANGEMENT OF TRACTS 1, 2, 3, 4, 9, 11 and 13 OF HOMESITES SUBDIVISION. which Commission Resolution Nos. 1129 and 1131, passed ae aforesaid, are hereby referred to and made a part of this resolution for further particulars in respect I to the boundaries of said district, the character of improvement to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolution Nos. 1129 and 1131 have been constructed and completed in accordance with the terms and conditions of Commission Resolution No. 1129 and 1131, and the total cost of said improvements so constructed 1s the sum of Twenty-Three Thousand Dollars and No/lOO's. ($23,000.00). NOW, THEREFORE, pursuant to the provisions of Sections 11-2201 to 11-2273 and 11-3301, R.C.M., 1947 and amendments thereto. BE I T RESOLVED AND IT IS HEREBY ORDERED B' 'THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the improvements in said Special Improvement No. 442, there be, and there is hereby levied and assessed a tax amounting to the sum of Twenty-Three Thousand Dollars and No/lOa's. ($23,000.00) . I upon all the property in said Special Improvement District No. 442, tha t a particular description of each lot and parcel of land with the nama of the owner and the sum assessed against him or it for such improvements and the amount of each partial pay- ment to be made and the day when the same shall be delinquent is set forth in full detail in the assessment list hereto attached, marked Schedule nAn, and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed Commission Resolution No. 1220 .-""..". ---."'. 22 upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, schedule "A", as required by law; that the payment of said sums shall be ID9.de in 20 installments and the payment of I said installments shall extend over a period of 19 years; that the payment of the respective annual installments shall be made on or befare the 30th day of November of each year until payment of all installments toge ther wi th the in terest thereon, shall be made; that said sums shall be paid Bd the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improve taxes; tha t failure to pa y such a ssessrre nt when the same become due and pay- able shall make such persons and said lots and parcels of land liable to the penal- ties provided by law relative to delinquent taxes. Section 2. Tha t t he regular session of the Commission of The City of bozeman to be held in the Commission Chamber in the City Hall of said city on the 1 s t da y of September 1965, at 1:00 o'clock p.m., be, an d the same is hereby designated as the time and place at which objections to the final doption of this Resolution will be heard by said Commission. Section 3. That the Clerk of the Commission of The Ci ty of Bozeman be, and she is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a da il y newspaper printed and published in the said City of Bozeman, a notice signed by the I Clerk 0 f the Commission and stating that a Resolution levying and assessing a special assessrrent of taxes to defray the cost and expense of cons tructing and making the improvements in the said Special Improvenent District No. 442 is on iLle in t he office of the Clerk of the Commission subject to inspection for a period of five ( 5) da Y8 ; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; tha tit shall be published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this Reso1u tion. NOTICE IS HEREBY GIVEN, tl:1at at a regular session of the C o'T1mi s s ion of the Commission Resolution No. 1220 23 City of Bozeman held on the 25th day of August, 1965, Commission Resolution No. 1220 was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Im- provement District No. 442 in said City, to defray the cost and expense of constr- I ucting and making the improverrents within said District, to-wit: The boundaries of said Special I11'provement District No. 442 are described as follows: Beginning at the southeasterly corner of Lot 3, Block A of said Maple Terrace Subdivision, being also the northeasterly corner of Lot 2, Block A; thence westerly along the lot line common to said lots 2 and 3 a distance of 130 feet to the southwesterly corner of said Lot 3, being also the northeasterly corner of Lot 5, of said Block A; thence southerly along the easterly line of said Lot 5 a distance of 100 feet to the southeasterly corner of said lot 5 being a point on the northerly line of Lot 1; thence westerly along the sou therly line of Lot 5 a distance of 40.1 feet to the northwesterly corner of Lot 1 of sa id Block A; thence souther ly along the lot 1 ine common to Lots 1 and 6 a dis tance of 140 fee t to the southeas terl y corner of said lot 6; thence westerly along the lot lines common to Lots 6 and 26 a distance of 100 feet to the sou thwesterly corner of Lot 6; thence continuing westerly along the lot line common to lots 7 and 25 a distance of 100 feet to the lot corner common to Lots 7,22,24 and 25; thence northwesterly along the northeasterly lot line of Lot 22 a distance of 125 feet to the sou theasterly corner of Lot 21; thence northerly along the westerly lot lines of Lots 8 through 14 a distance of 711.6 feet to the northerly line of said Maple Terrace Subdivision; thence easterly along the northerly line of said Maple Terrace Sub- division a distance of 315 feet to the northeasterly corner of Lot 4 of Block B of said Maple 'ferrace Subdivision; thence sou therly along the easterly lot lines of Lots 2, 3 and 4 of said Block B a distance of 308.7 feet to the south easterly corner of said Lot 2 of Block B; thence easterly along the lot line common to Lots 5 and 6 of said Block B and said lot line projected easterly, a distanceof 160 feet I to a point of intersection with the centerline of North i::Ieventeenth Avenue; thence southerly along the centerline of North Seventeenth Avenue a distance of 262.9 Feet to a point; thence westerly a distance of 30 feet to the point of beginning Con taining wi thin the above descr ibed exterior boundaries the following lots: Lots 3,4,5,6,7,8,9,10,11,12,13 and 14 of Block "A", Lots 1, 2, 3, 4, and 5 of Block "B" all in the Maple Terrace Subdivision of Bozeman, Montana, being a rearrangement of Tracts 1, 2, 3, 4, 9, 11 and 13 of Homesltes Subdivision. That, said Commission Resolution No. 1220 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interested. That Wednesday, 1st day of September, 1965, at 1:00 o'clock p.m., of said day at the regular session of the said Commission of The City of Bozeman, at the Commission Room, in the City Hall Building of said City, has been designa tad as the time and place where the sa 1d commission will hear and pass upon any and all objections that may be rrBde to the final passage and adoption of said Resolution No. 1220, and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 1129, de- claring it to be the intention of the Commission to create Special Improvement I District No. 442, and Commission Resolution No. 1131, creating Special Improvement District No. 442, for constructing and making the improvements therein.
