I keep thinking about this situation at Creekside Park. I am currently redoing sidewalks at
the Blackmore Apartments. I am required under Sec. 34.04.020 to keep our sidewalks ‘in
good order and repair’. This isn’t cheap but it is a requirement for all property owners to
which we must comply. Property owners are liable to the city for all losses to the city or
recoveries from the city for damages to person or property of others if they are not in
good order and reasonably safe. I understand this and as landowners in the City of
Bozeman we must abide. Using that, to which there are many, as an example, how come
these burdens are not on the city to comply when the city has a 90 degree concrete wall
that does not conform to FEDERAL standards? At the very least the wall should be cut to
grade to comply to code. It’s unsafe, ugly and forces the water to move unnaturally
towards Beall Street with a 12 inch wall above grade, that forces more water that
direction. Where do you draw the burdens? David

Craig,
Thanks for your note. I just see a recurring issue at this corner, dilapidated wall that makes
a ninety degree turn in the middle of a city (which FEMA has told me they have never seen
anything like it). This problem can be fixed. I have been presented with many opinions and I
have also presented solutions to the city specifically. Noting its location and that it’s a park,
I just wonder after all these years why the city can’t be proactive. Is it gonna take a disaster
to a property on Beall or a life safety issue to get this addressed? David

Thanks David. While I have nothing to report specifically on the corner of Lamme and Rouse, we
have been working very hard to address the city’s stormwater system, much of which impacts
Bozeman Creek. There is a Commission meeting Monday night where we’ll be talking about some
big stormwater policy and funding issues. You may want to attend.

Just checking in. I understand you’re busy. It is a big snow year and again a big risk of
flooding. I just didn’t know if there were any updates with regard to the corner of Lamme

Just touching base with you in regards to Creekside Park. When we last spoke early last
year (2013) you had said to have patience and see what unfolds. It is spring time again and
