I WHEREAS, The Ci ty Commission of The Ci ty of Boz eman, did on the 23rd da y of December, 1964, duly and reg1Jlarly pass Commission Resolution No. 1163, entitled: A RESOLUTION OF THE CITY corvrMIs3ION OF 'THE CITY or" BOZEMAN DECLARING IT TO BE THE INTENTION OF 'IRE CI'IY OF BO ZEMAN TO CREA TE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 449 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUC TING AND INSTALLING A STORM DRAINAGE SYSTEM TO SERVE THE AREA ON EAST GARFIELD STREET, SOUTH BOZEMAN AVENUE, EAST CLEVELAND STREET !-I.ND SOUTH ROUSE A VENUE, SAID STORM DRAINAGE PROJECT TO INCLUDE NECESSARY PIPE LINES, MANHOLES, DRAIN INLETS AND OTHER NECESSARY APPURTENANCES. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 20th day of January, 1965, duly pass Commission Resolution No. 1173, en ti t led: A RESOLUTION OF THE CITY COMMI"SION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 449 OF THE CITY OF BOZEMAN FOR 'THE Pl:JRPOSE OF CONSTRUCTING AND INSTALLPJG A STORM DRAINAGE SYSTEM TO SERVE THE AREA ON EAST GARFIELD STREET, SO UTH BOZEMAN AVENUE, EAST CLEVELAND STREET AND SOUTH ROUSE AVENUE. which Commission Resolution Nos. 1163 and 1173, passed aforesaid, are hereby re- .. ferred to and made a part of this resolution for further particulars in respect to the boundaries of said district, the character of improvement to be constructed I therein, the estimated cost of said improvements anc the method of assessing the cost aga ins t the property wi thin said dis trict; and WHEREAS, said improvements as contemplated in said Commission Resolution Nos. 1163 and 1173 have been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 1163 and 1173, and the total coast of said improvements so constructed is the sum of Twenty-seven thousand Three-hundred Ninety-seven & 28/100ths ($27,397.28) Now, Therefore, ~lrsuant to the provisions of Sections 11-2201 to 11-2273 and 11-3301, R.~.M., 1947 and amendments thereto. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA Section 1. That to defray the cost and expense of constructing and making the improvements in said Special Improvement No. 449.there be, and there is hereby levied and asessed a tax amounting to the sum of Twenty-seven thousand Three-hundred Ninety- seven & 28/100ths ($27,397.28) Upon all the property in said Special Improvement District No. 449, tha t a particular description of each lot Bd 1=8rcel of land wi th I the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payments to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made a par thereof; that the several sums set opposite the names of the owners and the descr ibed lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements with- in said District; that the several sums so assessed be collected from the respective Commission Resolution No. 1227 50 owners of said lots and parcels of land described in said assessment list, Sche- dule "A", as required by law; that the payment of saId sums shall be made in 10 installments and the payment of said installments shall extend over a periof of 9 years; tha t the pa yment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all in~,tallments ta- I gether with the in tere s t thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accor dance wi th the law governing the collection of special improvement taxes; that failure to pay such assessments when the same become due and pa ya ble sha 11 make such persons and said lots and parcels of land liable to the penalties provided by law relative to delin- quen t taxe s . Sec tion 2. That the regular session of the Commission of The 6lty of Bozeman to be held in ilie Commission Chamber in the Wity Hall of said city on the 15th day of September 1965, at l:Ou o'clock p.m., be and the same is hereby designated as the time and place at which objections to the final adoption of this resolution will be heard by said Co~mission. Sec tion 3. Tha t the Clerk of the Commission of The Ci ty of Boz eman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and pu'81ished in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and I making the improvements in the Said Special Improvement DistrIct No. 449 is on file in the office of the Clerk of the Commission subject to inspection for a per- iod of five (5) days; that said Notice shall state the time and place at which objections w111 be heard by the Corrnnission to t he final adoption of this Resolution that it shall be published at least five (5) days before the day se t by the Comm- ission for the hearing of objections and the final adoption oC' this Resolution. NOTICE IS HEREBY GIVEN, T HAT at a regular session of the Commission of The Commission Resolution No. 1227 - .--- 51: City of Bozeman held on the 8th day of September 1965, Commission Resolution No. 1227 was provisionally passed and adopted; tha t sa id Commiss ion Resolu tion levies and assesses a special assessment of taxes upon all the property in Special Improve ment District No. 449, in said City, to defray the cost and expense of constructing I and making the iiproveients wl.thin said District, to-wi t: The boundaries of said Special Improvement District No. 449 are described as follows: Beginning at the center of Section 18, Township 2 ~outh, Range 6 East, M.P.M., thence westerl! along the quarter line of said Section 18, being the southerly line of the NW4 of said Section 18 a distance of 790 feet more or less to the southwesterly corner of Lot 2 of Block 3, University Subdivision of Bozeman, Mon tana; thence northerly along the westerly lot line of said lot 2 a distance of 123.51 feet to the northwesterly corner of said Lot 2; thence across East Lincoln Street to the southwesterly corner of Lot 13 of Block 4 of said Uni- versity Subdivision; thence northerly along the westerly lot lines of Lots 13 to 24 inclusive of said Block 4; to the northwesterly corner of said Lot 24; thence northerly across East Garfield Street to the southwesterly corner of Lot 5 of Block 5; thence northerly along the westerly lot lines of Lots 5 through 9 inclusive to the northwesterly corner of said Lot 9; thence in a northeasterly direction across Lot 10 to a point on the northwes tarl y line of said lot; said point being 25.75 feet southwesterly from the northerly corner of said Lot 10; thence northeasterly being along a curve and along the northwesterly lot lines of Lots 10, 11, 12 and 13 of said Block 5 to a point 29.75 feet westerly of the northeasterly corner of Lot 13 of said Block 5; thence easterly along the northerly lot lines of Lots 13, 14, 15 16 and 17 of said Block 5 and the northerly line of Lot 1 of Block 6, being the northerly line of said Universi ty Subdivision to the northeaster- ly corner of said University Subdivision; thence sou therly along the easterly line of said University Subdivision and along the easterly line of said TTniverslty Subdivision and along the easterly line of the NWt of said Section 18 a distance of 1931.45 feet to the center of said Section 18, being the true point of beginning; I Including wi thin the above described exterior boundaries the following Lots, Blocks and Tracts of land, to-wit: Lots 2 and 3 of Block 3, University Subdivision; Lots 13 through 24 inclusive of Block 4, University Subdivision; Lots 5 through 9 inclusive of Block 5, University Subdivision; Portion of Lot 10 of Block 5, University Subdivision; Lots 11 through 17 inclusive of Block 5, University Subdivision; Lots 1, 2, and 3 of Block 6, University Subdivision; Lots 1 and 2 of Block 7, Uni versi ty Sub- di vis ion; Lots 1 and 2 of Block 8, University Subdivision; Lot 1 of Block 1, University Subdivision Number 2; Lots 1 through 12 inclusive of Block 2, University Subdivision Number 3; unplatted portion of the East Half of the Northwest Quarter (E-~NWi) of Section 18. That Wednesday the 15th day of September, 1965, at 1:00 o'clock p.m. of said day a t the regular session of the said CO)'Y''11ission of The City of Bozeman at the Commission Room, in the City Hall Building of said City, has been designated as the time and place where the said Commission will mar and pass upon any and all objections tha t may be made to the final passage and adoption of said Resolution No. 1227, and the levying of said assessment, Bd tha t said Re- solution will be finally passed and adopted at said regular session.
