I WHEREAS, The C it y Commi s r"i on of The C i t Y of Boz ema n, did on the 7th da y of April 1965, duly and regularly pass Commission Resolution No. 1190, entitled: A RESOLUTION OP 'THE CITY COMMISSION OP THE CITY OF BOZEMAN DECLARING IT TO BE TIlE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DI STRICT TO BE KNOWN A S SPECIAL IMPROVEMENT DISTRICT NO 45'7 OF THE cr TY OP B07,EVAN FOR THE PUHPOSE OF CONSTRUCTING AND INSTALL TWG WATER ~1AINS AND SANITARY SEWER LATERAL MAINS ON A POR- TIOl\: OF SOUTH TRACY A VENUE BEGINNING AT A POINT 149.55 FEET SOUTH- WESTERLY OF THE INTERSECTIlN OF SOUTH TRACY A VENUE AND SPRING CREEK DRIVE TO HILL STREET, ON HILL STREET BETWEEN THIRD AVENUE SOUTH AND HIGHLAND COURT AND ON HIGHLAND COURT BETWEEN THE SOUTH- ERLY BOUNDARY OF THOMPSONS ADDITION NO. 3 TO A POINT 199.25 FEET WESTERLY OF THE INTERSECTION OF SAID HIGHLAND COURT AND SPRING CREEK DRIVE. and thereafter, after due and legal proceedings had, the Commission of The Ci ty of Bozeman did on the 5th day of May, 1965, duly pass Commission Resolution No. 1195, entitled: A RESOLUTION OF THE CITY COMMISSION OF 'lliE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT ~O BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 457 OF THE CITY OF BOZE1~N FOR Tfill PURPOSE OF CONSTRU- CTING AND INSTALLING WATER MAINS AND SANITARY SEWER LATERAL :M-AINS ON A PORTION OF SOUTH TRACY AVENUE BEGINNING AT A POINT 149.55 F.EET SOUTHWESTERLY OF THE INTERSECTION OF SOUTH TRACY AVENUE AND SPRING CREEK DRIVE TO HILL STREET, ON HI LL STREET BETWEEN THIR S A VENUE SOUTH AND HIGHLAND COURT AND ON HIGHLAND COURT BETWEEN THE SOUTHER- -I LY BOUNDARY OF 'IHOMPSONS A DDITION NO. 3 TO A POINT 199.25 FEET WESTERLY OP THE INTERSECTION OF SAID HIGHLAND COURT AND SPRING CREEK DRIVE. which Comm:issHm Resolution Nos 1190 and 1195, passed as aforesaid, are hereby re- ferred to and made a part of this resolution for further particulars in respect to the boundaries of said district, the character of improvement to be constructed therein, the estimated cost of said i.11provements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolution Nos. 1190 and 1195 have been constructed and completed in accordance wi th the terms and conditions of Commission Resolution Nos. 1190 and 1195, and the to ta 1 co s t 0 f sa id improvements so constructed is the sum of Sixty-Two Thousand Dollars and No/I00's ($62,000.00) NOW, THEREFORE, pursuant to the provisinns of Section 11-2201 to 11-2273 and 11-3301, R.C.M., 1947 and amendments thereto. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CrIT OF BOZEMAN, STATE OF MON TANA: Section 1. That to defray the cost and expense of constructing and making the I improvements in said Special Improvemen t No. 45'7, there be, and there is hereby levied and as sessed a tax amoun ting to the sum of Sixty-Two Thousand Dollars and No/IOO's ($62,000.00) upon all the property in said Special Improvement District No. 45'7, that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payments to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and a COMMISSION RESOLUTION NO. 1234 ---- 80 made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within seid District; that the several sums so assessed be collected from the respect- I ive owners of said lots and parcels of land de. scribed in said assessment list, . Schedule "A", as required by law; that the payment of said sumS shall be made in 20 installments and the payment of said installments shall extend over a period of 19 years; that the payment of the respective annual installments shall be made on or before the 30th da y -of November of each year until payment of all ins ta 11ments together with the interest thereon, shall be made; th9.t said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same become due and payable sha 11 make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said city on the 22nd day of September, 1965, at 1:00 o'clock p.m., be, and the same i,s hereby designated as the time and place a t which objections to the final adoption of this :Resolution will be heard by said Commission. I Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper pr:inted and published in the Said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to 'defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 457 is on file in the Office of the Clerk of the Commission subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be ( published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this resolution. Man t ana; the nce N 00001' West a distance of 515.52 feet to a point of intersection of the centerline of South Third Avenue and the northerly line of Hill street extended westerly; thence north 89059' East a distance of 45 feet; thence North 0001' West along the west- erly line of Lot 2 of Block 4 of said Thompson's addition No.3 a distance of 235.31 feet; thence No:gth 59039' 50" East a distance of 884.40 feet; thence South 30 20' 10" East a distance of 320.03 feet to the southwesterly corner of Lot 1 of Block 3 of said addition; thence South 73050' East a dis- tance of 61.26 Feet; thence South 16010' West a distance of 373.0 feet to a point on the westerly lot line of Lot 2 Block I 2; thence South 12033' West along the westerly lines of Lots 2. 3 and 4 of said Block 2, a distance of 179.77 feet; thence South 07021' West along the westerly line of Lots 4, 5, 6 and 7 of said Block 2 a distance of 382.16 feet to the southwester- ly corner of Lot 7 of said block 2; thence North 89024' West along the southerly line of said Thompson's Addition No.3 a distance of 836,99 feet to the point of beginning.
