WHEREAS, at a reg,)lar meeting of the City Commission of the City of Bozeman held the 1st day of September, 1965 , the aforesaid petition was respectively con- sidered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 I Declaration of Intention TM tit is hereb y declared to be the lntention of the Cit y of Bozeman to create a special improvement district to be known and designated as Special Im- provement Lighting District No. 460 of the City of Bozeman for the purpose of operating and maintaining a lighting system to light North seventh Avenue between a point 14U feet North of Main Street to the present city limits at the northerly line of Oak Street and the adjacent streets East and West of said North Seventh Avenue for a distance of 115 feet either side of said Seventh Avenue. Section 3 Charac tar of Improvemen ts The character of the improve~ent to be Ins taIled and paid for by the Montana Power Company is the erection and installation of Thirty-three I ( 33) , 400 Watt, 20,000 lumen Mercury Vapor, color corrected luminaires mounted on 30 feet high steel poles and eighteen (18), I? 5 Wa t t , 7000 lumen Mercury Vapor, Golor corrected luminaries mounted on 30 feet high steel poles. Power is to be fed by a single overhead wire and the in- stalla tion shall be equipped with all necessary appliances for the safe and proper operation of the system. Section 4 Estimate of Cost of Maintenance and Electrical Current and Method of Assessment. An estimate of the cost of maintaining such lighting system and supply current therefor is Six and 38/100 Dollars ($6.38) per unit month for the 2u,000 lumen fixtures and Three and 70/100 dollars ($3.70) per unit month for the 7,000 lumen fixtures, or a total S11m of Three Thousand Three Hlmdred Twenty-five and 68/100 Dollars ($3,325.68) per year of which total seventy-five percent (75%) or Two Thall sand Four Hundred Ninety-four and 26/100 dollars ($2,494.?6) is to be assessed against the property within the district on a front foot basis and twenty-five percent (25%) or Eight I Hundred Thirty-one and 42/100 Dollars ($831.42) is to be paid by the Oi ty of Bozeman. The estimated rate of assessment per year per front foot of the property within the district is .299850330 cen ts rer front foot. Section 5 Actual Area of District The total actual fr'mtage of the property withh said proposed Special Improve- Commission Resolution No 1237 95 ment Lighting District No. 460 is 8,318.35 linear feet, which is the frontage :figures on which all protests will be received, considered and determined. Section 6 Payment I The proposed Special Improvement Lightirg District will be established for the pUI'pose of paying the operating and maintenance cost of such light only, which said operation and maintenance will include the furnishings of electric current, all lamps as needed and the maintenance of poles, cables, and other incidental items. The entire cost of such lights will be borne by the Montana Fower Company. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on 1J\!ednesday, the 29th day of September, 1965, at the hour of one o'clock p.m. of said day, are the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement Lighting District No. 460, the improve'rent propc)sed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the ti.me as by law reqllired, of the adoption of this Resolu tion o:f I In tention. Objections must be made in writing and fi led with ihe Clerk of the City Commission not later than fifteen (15) days after the date of the first publication of this notice.
