HomeMy WebLinkAboutResolution 1244 Extending the Boundaries ~,"~ 1.15 Commission Resolution No. 1244 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTI- CULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE I CORPORATE LIMITS THEREOF. ----- WHEREAS, there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land within the boundaries of the City of ]3ozamiR iO 8:0: to inC'lnde C'ertail1 C'ontiguC11i tracti: of land withiR thQ b01,m,darilii: of thQ City of' I.\I:;I n~ and having presented to the City of Bozeman proposed plats and certificate of Survey of said land; and WHEREAS, the proper legal description of said contiguous tracts located in the County of Gallatin, State of Montana, is as follows: A tract of land in the Southwest Quarter (SW~) of Section One (1). Township Two (2) South, Range Five (5) East of the Montana Prin- cipal Meridian, Gallatin County, Montana, and being more parti- cularly described by the following Metes and bounds, to-wit: Beginning at a point which bears North 88'58' West along the South line of said Southwest Quarter a distance of 570.5 feet, from the South Quarter corner of said Section One (1); thence North 88'58' West along said South line a distance of 330.0 feet; thence North 0'02' East a distance of 2,655.88 feet to the North line of said Southwest Quarter; thence South 89"17' East along said North line a distance of 330.0 feet to a point 570.5 feet westerly ~long said North line from the Northeast corner of said Southwest "I Quarter; thence South 0'02' West 570.5 feet distant and parallel to the East line of said Southwest Quarter a distance of 2,657.73 feet to the point of beginning, containing 20.125 acres, more or less. Said tract is to be known and designated as Gallatin County ~,:;..-:~ Rest Home Addition to the City of Bozeman, Montana. WHEREAS, it will be for the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described to extend the boundaries of the City of Bozeman so as to include the said contiguous tracts hereinbefore described within the corporate limits of the said City of Bozeman. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1947, it is hereby declared to be to the best interest of the City of Bozeman and the inhabit- ants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as to include the contiguous tracts here- inbefore described within the boundaries and corporate limits of the City of Bozeman, Montana. PASSED AND ADOPTED by the Conunission of the City of Bozeman, Montana, at a regular session held on the 6th day of October, 1965. Commission Resolution No" 1244 -- -..--,....- :116 NOTICE IS HEREBY GIVEN THAT on the 6th day of October, 1965, at a regular meeting of the City Commission of the City of Bozeman, the said Commission duly and regularly passed and adopted Commission Resolu ion No. 1244 entitled: trA RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE IN- I HABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CON~ TIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF." NOTICE IS HEREBY FURTHER GIVEN that Wednesday, the 3rd day of November, 1965, at one o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated as the time and place for hearing objections to the action proposed to be taken in said Resolution No. 1244, whereby it is proposed to embrace the hereinafter described contigent territory within the corporate limits of the City of Bozeman, Montana. Expressions of approval or disapproval by resident freeholders of the territory proposed to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than twenty (20) days after the date of the first publication of this Notice.
