On December 10, 2007 the Bozeman City Commission adopted the Neighborhood Recognition Ordinance as part of the
Bozeman Municipal Code.This new ordinance contains the following requirement:
Section 2.05.1230, Responsibilities of Individuals or Entities Submitting an Application to the Department of Planning and
Community Development.
A. In order for the City Liaison to effectively perform their duties executing the intent and purpose of this chapter, as defined in
2.05.1230,the following shall be performed:
1. As part of any application to the Department of Planning and Community Development,the applicant shall provide written
notice via certified mail,e-mail,facsimile transmission,and/or personal delivery to the City Liaison if notification guidelines
(BMC 38.40)require that notice be posted"on-site",published in the local newspaper or mailed first class.
2. Such notice shall contain a complete set of application materials as submitted to the Department of Planning and
Community Development.
B. Failure to provide proof of such mailing via ccrditcd mail, e-mail and/or facsimile transmission report to the most recent City
Liaison address,e-mail address and/or fax number of record,or an affidavit attesting hand delivery,shall result in an incomplete
application.

Westbrook Subdivision
List of Variances
The following variances are being requested with the preliminary plat application for this
development. Additional variances may need to be requested if they are discovered by the
Planning Staff and/or other City departments during the course of review.
Section 38.24.090.D.3. (Access) - to allow access (local street intersections) within 150
feet of the Durston Road right-of-way. Glenkirk Drive will line up with the existing
Shadowglen Drive, parallel to and 115 feet north of the Durston Road right-of-way.
Aligning the roadways will make the intersection at Shadowglen, Laurel Parkway, and
Glenkirk Drive much safer than offsetting them to meet the 150' requirement.
Section 38.27.060.A. (Parkland Frontage)—to allow dedicated public parkland with less
than 50% of its perimeter fronting public streets. The proposed parkland will have
approximately 45%of its frontage on public streets along with a portion abutting open
space which is accessed by public streets. Pedestrian trails will provide connectivity
between the adjoining streets, open spaces and public parkland. We are providing
approximately 21%more parkland than required in addition to the 26 % of the property
that is open space. The lot layout does not make it economical to provide additional park
frontage. The additional parkland and open space provide more frontage for parking
than the minimum code allowed park size would provide.
Section 38.23.030 (Lot Proportion)—to allow a lot with a depth greater than three times
it's width with an irregular shape. The proposed Block 5, Lot 1 will be developed as one
R4 lot with multiple family residences. A site plan will be submitted to the city at the
time of development.
Section 38.23.040 (Block Length)—to allow a block with a length greater than 400 feet.
