NO. 1252
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO
BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IM-
PROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 463 FOR
THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE PAVEMENT,
CONCRETE INTREGAL CURB AND GUTTERS, NECESSARY EXCAVATION AND FILL, GRAVEL
BACKFILL, NECESSARY STREET MONUMENTS AND OTHER APPURTENANT WORK THERETO,
ALSO THE CONSTRUCTION AND INSTALLATION OF STORM DRAINAGE PIPE, INCLUDING
NECESSARY TRENCH EXCAVATING AND BACKFILL, INLETS, MAN-HOLES AND OTHER

NECESSARY APPURTENANT STRUCTURES, ON SOUTH TRACY AVENUE, ABUTTING ON
LOTS 2 OF BLOCK 4 AND LOTS 5 OF BLOCK 3, HILL STREET FROM SOUTH THIRD
AVENUE EASTERLY TO HIGHLAND COURT, AND ON HIGHLAND COURT ABUTTING ON LOT
2 OF BLOCK 5, LOT 8 OF BLOCK 2, ALL IN THOMPSON'S ADDITION NUMBER 3 TO THE
CITY OF BOZEMAN, MONTANA.
WHEREAS , there has been filed with the Clerk of the City Commission of the City of Bozeman,
Montana, a petition in due form of certain owners of properties situated on South Tracy Avenue
abutting on Lots 2 of Block 4 and Lots 5 of Block 3, Hill Street from South Third Avenue easterly
to Highland Court, and on Highland Court abutting on Lot 2 of Block 5 and lot 8 of Block 2, all in
Thompson"s Addition Number 3 to the city of Bozeman, Montana, asking that a special improvement dis-
trict be created for the purpose of constructing and installing an asphaltic-concrete pavement
project to include intregal concrete curbs and gutters, storm drainage, and other work incidental
thereto; and
WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 2nd
day of March, 1966, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
SECTION
1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a special
improvement district to be known and designed as Special Improvement District No. 463 for the
purpose of constructing and installing an asphaltic-concrete pavement project on South Tracy
Avenue abutting on Lots 2 of Block 4 and Lots 5 of Block 3, Hill Street from South Third Avenue
easterly to Highland Court, and on Highland Court abutting on Lot 2 of Block 5 and Lot 8 of Block I
2, all in Thompson's Addition Number 3 to the City of Bozeman, Montana. Said pavement project to
includeoonstruction and installation of intregal concrete curbs and gutters, storm drainage, and
other work incidental thereto.
SECTION
2
Boundaries
That the boundaries of said Special Improvement District No. 463 are described as follows:
Beginning at a point on the southerly line of Thompson's Addition Number 3 to
Bozeman, Montana, said point being the southwesterly corner of Lot 7 of Block
2 and the southeasterly corner of Lot 8 of Block 2 of said Thompson's Addition
thence North 7021' East along the westerly lot lines of 4, 5, 6, and 7 of said
Block 2 a distance of 382.16 feet; thence North 12033' East Along the
westerly
lines of Lots 2, 3 and 4 of said Block 2, a distance of 179.77 feet; thence
north 16010' East along the westerly lines of Lots 1 and 2 of said Block 2,
across Highland Court and parallel to and 49.25 feet westerly from the westerly
lot line of I,ot 4 of Block 3 a distance of 373.0 feet to a point of intersection
with the southerly lot line of lot 2 of said Block 3; thence North 73050' West
along the southerly lines of Lots 1 and 2 of said Block 3 a distance of 61.26 feet
to the southwesterly corner of said Lot 1; thence North 30020'10"
West along
the westerly line of said Lot L across South Tracy Avenue (formerly Spring Creek
Drive) and parallel to and 20.22 feet distant westerly from the westerly line of
Lot 1 of Block 4, a distance of 320.03 feet to a point of intersection with the
northwesterly line of Lot 2 of said Block 4; thence South 59039'50" West along
the northwesterly line of said Lot 2 a distance of 884.40 feet to the north-
westerly corner of said Lot 2; thence continuing South 59039'50" West to a point
of intersection with the centerline of South Third Avenue, being the westerly
line of said Thompson's Addition Number 3; thence South 00001' East along the
centerline of South Third Avenue to a point on said line which lies 138 feet souther-

ly of the point of intersection of said centerline of South Third Avenue and
the centerline of Hill Street; thence in an easterly direction parallel to and
105 feet distant southerly from the southerly line of Hill Street to a point
136.36 feet westerly of the westerly line of Highland Court; thence southerly
parallel to and 136.36 feet distant westerly from the westerly line of High-
land Court being on a bearing of South 7021' West a distance of 337.12 feet
to a point on the southerly line of said Thompson's Addition Number 3;

South 89024' East along said southerly boundary of said Thompson's Addition a
distance of 355.60 feet to the point of beginning
Including within the above described exterior boundaries the following Lots, Blocks and parcels
of land, to~wit:

All of lot 8 of Block 2; all of lot 5 of Block 3, excepting the easterly
49.25 x 140 feet; all of Lot 2 of Block 4 excepting the northeasterly 20.22
x 110 feet; a portion of Lot 1 and a portion of Lot 2 of Block 5, all in
Thompson's Addition Number 3 to the City of Bozeman, Montana.
Section 3
Character of Improvements
I Construction of a pavement project with intregal concrete curbs and gutters,
storm drainage
and necessary appurtenances to said construction on South Tracy Avenue abutting on Lots 2 of Block
4 and Lots 5 of Block 3, Hill Street from South Third Avenue easterly to Highland Court, and on
Highland Court abutting on Lot 2 of Block 5 and Lot 8 of Block 2,
all in Thompson's Addition Number
3 to the City of Bozeman, Montana,
said pavement project to include construction of an asphaltic-concrete
surface type course,
concrete intregal curb and gutters, necessary excavation and fill, gravel back-
fill, necessary street monuments and other appurtenant work thereto, also the
construction and in s t-
allation of storm drainage pipe,
including necessary trench excavating and backfill, inlets, man-holed
and other necessary appurtenant structures.
Section 4
Estimante of Cost
The preliminary estimate of cost is $104,000.00,
including all street excavation, all materials,
installation costs and engineering and incidentals.
Section 5
Method of Assessment
The cost of such improvement is to be assessed against the entire district, each
lot or parcel
of land within such district will be assessed for that part of the whole cost
which its area bears
to the area of the entire district, exclusive of streets,
avenues, alleys and public places, and
further, each square foot of land within the district lying within 25 feet of
the line of the street
or avenue on which the improvements herein provided for are to be made shall beal
double the amount
of the costs of such improvements per square foot of such land that each square
foot of any other
I land within the district shall bear.
The total actual square foot of assessable area within the
said district is 665,864.90 square feet, which is the area figure on which all protests will be re-
ceived, considered and determined.
Section 6
Payments
That the payments for said improvements shall be made in twenty (20) annual installments
ex-
tending over a period of nineteen
(19) years, but this shall not be construed to prevent payment in
full at any regular payment date by any property owner who desires to do so.
It is proposed to pay
the entire cost and expense of the construction and installation of said improvements
with cas to be
obtained from the sale of bonds of said Special Improvement District No. 463,
as authorized by law.
Such bonds will be in denominations of $100.00 each, and fractions or multiples
of $100.00 where
necessary, to be issued
and chargeable against a fund to be known and designated as Special Improve-
ment District No. 463 Fund of the City of Bozeman.
The bonds will be redeemable at the option of
the City, singly or in
multiples, and in the order of their registration, whenever funds are avail-
able for that purpose in said Special Improvement District No. 463.
Said bonds will draw a simple
interest from the date of their registration until called for payment, at a rate
not to exceed six
percent (6%) per annum, which interest shall be chargeable as a part of the cost
of construction and
installation of said improvements.
The bonds will be issued and sold in accordance with the provisions
of Section 11-2232 and Section 11-2271, Revised Codes of Montana,
1947, and all other applicable pro-
visions of Title 11 of the Revised Codes of Montana,
1947, relating to special improvement districts
in cities and towns, and any amendments thereof or thereto.

Protests and Notice
That the regular session of the City Commission of the City of Bozeman to be held at the Commission

Bozeman, Montana, on Wednesday, the 23rd day of March,
1966, at the hour
of one o'clock p.m. of said day,
is the time and plac~ when and where the City Commission will hear
and pass upon all protests duly and regularly made and filed against the creation
of said proposed
Special Improvement District No. 463,
the improvements proposed to be made pursuant thereto and the
extent and character thereof, or either thereof, and the Clerk of the City Commission
be, and she is
Hereby directed to give notice in the manner and for the time as by law required,
of the adoption of
this resolution of intention.

NOTICE IS HEREBY GIVEN that on the 2nd day of March, 1966, at a regular session of the
Commission of the City of Bozeman, Commissione Resolution No. 1252, entitled:

TION NUMBER 3 TO THE CITY OF BOZEMAN, MONTANA.
WAS passed and adopted.
That Wednesday, the 23rd of March, 1966, at one
o'clock p.m., at the Commission Room of the
City Hall, Bozeman, Montana, is designated by Resolution No. 1252 as the time when and the place
where the Commission of the City of Bozeman will hear and pass upon all protests that may be made
against the making of such improvements, or the creation of said district. Protests must
be made I
in writing and delived to the Clark of the City Commission within fifteen (15) days after date
of the first publication of this notice.
The general character of the improvements proposed to be made is the construction and install-
ation of an asphaltic- concrete pavement, including excavation. gravel backfill, gravel cushion
course, asphaltic-concrete base and surface courses, concrete intregal type curbs and gutters, con-
crete curbs, medians, and necessary incidentals necessary to a satisfactory paving project on South
Tracy Avenue abutting on Lots 2 of Block 4 and Lots 5 of Block 3, Hill Street from South Third
Avenue easterly to Highland Court, and on Highland Court abutting on Lot 2 of Block 5 and Lot 8 of
Block 2, all in Thompson's Addition Number 3 to the City of Bozeman, Montana.
The estimated cost of said improvements is $104,000.00, including all street excavation, all
materials, installation costs and engineering and incidentals.
For a description of the boundaries of said Special Improvement District No. 463, reference is
hereby made to Resolution No. 1252 of the Commission of the City of Bozeman declaring the intention
to create said district, which on file in the office of the undersigned Clerk of said Commission in
the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested
parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, revised Codes of Montana,
1947.
