HomeMy WebLinkAboutResolution 1250 Creates SID No. 462 - 1.32 COMMISSION RESOLUTION NO. 1250 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DE- CLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPEC- IAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 462 FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT NORTH EIGHTEENTH AVENUE, FROM WEST BEALL STREET TO DURSTON ROAD, WEST BEALL STREET FROM THE ALLEY LINE I OF BLOCK uBu AND NORTH NINETTENTH AVENUE, AND THE SOUTHERLY SIDE OF WEST DURSTON ROAD BETWEEN THE ALLEY OF BLOCK ttBtt AND NORTH NINETEENTH A VENUE AS PLATTED IN GRAF' S FIRST RE"ARRANGEMENT OF BLOCK 6 OF KIRKS SECOND SUBDIVISION TO BOZEMAN, MONTANA, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPNAY, ALL UNDER THE AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 TO 11-2257 IN- CLUSIVE, OF THE REVISED CODES OF MONTANA, 1947. WHEREAS, there has been filed with the Clerk of the Commission of the City of Boze- man, Montana, a petition in due form of certain property owners on North Eighteenth Ave- nue from West Beall Street to Durston Road, West Beall Street from the Alley line of Block uB" and North Nineteenth Avenue, and the Southerly side of West Durston Road between the alley of Block nBn and North Nineteenth Ayenue as platted in Graf's First Rearrange- ment of B~ock 6 of Kirks Second Subdivision to Bozeman, Montana, asking that a special improvement lighting district be created for the purpose of operating and maintaining a lighting system to light the hereinbefore described streets, roads and avenues in the City of Bozeman, Gallatin County, Montana. WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held the 16th day of February, 1966, the aforesaid petition was respectively considered and granted; I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create improvement district to be known and designated as Special Improyement Lighting District No. 462 of the City of Bozeman for the purpose of operating and maintaining a lighting system to light North Eighteenth Avenue from West Beall Street to Durston Road, West Beall Street from the alley line of Block nBtt and North Nineteenth Avenue, and the Southerly side of West Durston Road between the alley of Block "B" and North Nineteenth Avenue as platted in Gr~f'5 First Rearrangement of Block 6 of Kirks Second Subdivision to Bozeman, Montana. Section 2 Boundaries The boundaries of said Special Improvement Lighting District are described as follows: Beginning at the northwesterly corner of Section 12, Township 2 South, I Range 5 East of Montana Principal Meridian; thence North 89- 53' 38" East along the northerly line of said Section 12, a distance of 180.91 feet to the true point of beginning; thence southerly along the center- line of the alley of Block A of Graf's First Rearrangement of Block 6 of Kirks Second Subdivision and said line extended a distance of 64.14 feet southerly of the southerly line of West Beall Street; thence easterly parallel to and 64.14 feet distant southerly from the southerly line of said West Beall Street a distance of 310.05 COMMISSION~RESOLUTION NO. 1250 1.33 feet; thence northerly at right angles to a point of intersection of the northerly line of West Beall Street and the centerline of the alley of Block B of said Graf's First Rearrangement of Block 6 of Kirks Second Subdivision; thence continuing northerly along the centerline of the alley of said Block B and said centerline I projected to a point of intersection with the northerly line of said Section 12, being the centerline of West Durston Road; thence North 89- 53' 38tt West along said section line a distance of 300.02 feet to the true point of beginning. Containing within the above described exterior boundaries the following lots, blocks and parcels_of land, to-wit: Lots 18 thru 34 inclusive of Block A, Lots 1 thru 17 in- clusive of Block B, all in Graf's First Rearrangement of Block 6 of Kirks Second Subdivision, also a portion of Block 2, 64.14 feet in width and 310.05 feet in length lying adjacent to West Beall Street. Section 3 Character of Improvements The character of improvement to be installed and paid for by The Montana Power Company is the erection and installation of thirteen (13) 175 Watt Mercury-Vapor, color corrected luminaires, mounted on 30 feet high, tapered steel poles. Power is to be fed by a single overhead wire and the installation shall be equipped with all necessary appliances for safe and proper operation of the system. Section 4 Estimate of the Cost of Maintenance and Electrical Current I An estimate of the cost of maintaining such lighting system and supplying current therefor is Three and 70/100 Dollars ($3.70) per unit month or the sum of Five Hundred Seventy-seven and 20/100 Dollars ($577.20) per year of which total seventy-five percent (75%) or Four Hundred Thirty-two and 90/100 Dollars ($432.90) is to be assessed against the property within the district on a square foot basis, and twenty-five percent (25%) or One Hundred Forty-four and 30/100 Dollars ($144.30) is to be paid by the City of Bozeman. Section 5 Method of Assessment and Actual Area The cost of such improvement is to be assessed against the entire district, each lot or parcel of land within such district will be assessed for that part of the whole cost, which its area bears to the area of the entire district exclusive of streets, ave- nues and alleys. The total assessable area within the district is estimated to be 293,478.16 square feet, which is the area figure on which all protests will be received, considered and determined. I The estimated rate of assessment per year per square foot of property within the district is .001475067173. Section 6 Payment The proposed Special Improvement Lighting District will be established for the pur- pose of paying the operating and maintenance cost of such lights only, which said operation and maintenance will include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables, and other incidental items. ,cOMMISSION RESOLUTION NO. 1250 :134 The entire cost of such lights will be borne by The Montana Power Company. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held I ~t the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 9th day of March, 1966, at the hour of one o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement Lighting Dist- rict No. 462, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. That Wednesday, the 9th day of March, 1966, at one o'clock p.m. at the Commission I Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 1250 as the time and place for hearing objections to the action proposed to be taken by said resolution, and when and where any and all persons whose property is within said proposed Special Improvement Lighting District No. 462 may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after the date COMMISSION RESOLUTION NO. 1250 1.35 of the first publication of this notice. For a description of the boundaries of said Special Improvement Lighting District No. 462 reference is hereby made to Resolution No. 1250 of the Commission of the City of Bozeman declaring the intention to create said District, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public gen- erally. This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana, 1947. Dated this 16th day of February, 1966.
