HomeMy WebLinkAboutResolution 1249 Creates SID No. 461 1-28 COMMISSION RESOLUTION NO. 1249 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DIST- RIST TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 461 FOR THE PUR- POSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT BLACKMORE PLACE, TERRACE AVENUE, THE WESTERLY ONE-HALF OF NORTH SEVENTEENTH AVENUE, THE NORTHERLY ONE-HALF OF DURSTON ROAD AND THE EASTERLY m~-HALF OF NORTH NlNE- I TEENTH AVENUE IN AND ADJACENT TO MAPLE TERRACE SUBDIVISION, BEING A REARRANGE- MENT OF TRACTS 1, 2, 3, 4, 9, 11 and 13 OF HOMESITES SUBDIVISION, CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 to 11-2257 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1947. WHEREAS, there has been filed with the Clerk of the Commission of the City of Bozeman, Montana, a petition in due form of certain property owners on Blackmore Place, Terrace Aveneu, the Westerly one-half of North Seventeenth Avenue, the Northerly one- half of Durston Road and the Easterly one-half of North Nineteenth Avenue in and adjacent to Maple Terrace Subdivision, being a rearrangement of Tracts 1, 2, 3, 4, 9, 11, and 13 of Horoesites Subdivision of the City of Bozeman, Montana, asking that a special improve- ment lighting district be created for the purpose of operating and maintaining a light- ing system to light the hereinbefore named streets, roads and avenues in the City of Bozeman, Gallatin County, Montana. WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held the 16th day of February, 1966, the afore5aid petition was respectively considered and granted; I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement Lighting District No. 461 of the City of Bozeman for the purpose of operating and main- taining a lighting system to light Blackmore Place, Terrace Avenue, the Westerly one- half of North Seventeenth Avenue, the Northerly one-half of Durston Road and the East- erly one-half of North Nineteenth Avenue in and adjacent to Maple Terrace Subdivision, being a rearrangement of Tracts 1, 2, 3, 4, 9, 11 and 13 of Homesites Subdivision of the City of Bozeman, Montana. Section 2 Boundaries The boundaries of said Special Improvement Lighting District are descrbed as follows: Beginning at the Southwest corner of Section One (1) Township Two (2) South, Range Fi\re (5) East of Montana Principal Meridian; I thence North 20 03' W along the Section line a distance of 970 feet~ thence Norther 87- 57' E along the northerly line of Maple Terrace Subdivision and said line extended a distance of 630.1 feet to a point of intersection with the centerline of North Seventeenth (17th) Avenue; thence South 2- 03' E along the said centerline of North Seventeenth Avenue a distance of 1103.2 feet to a point of inter- section with the centerline of Durston Road; thence northwesterly along the centerline of said Durston Road to the true point of beginning. Containing within the above described exterior boundaries the following lots and blocks, to-wit: Lots 1 thru 26 inclusive of Block A, and Lots 1 thru 8 inclusive, of Block B, all in Maple Terrace Subdivision to Bozeman, Mont8I;la. COMMISSION RESOLUTION NO. 1249 129 Section 3 Character of Improvements The character of improvements to be installed and paid for by the Montana Power Company is the erection and installation of fifteen (15) 175 Watt, 7000 lumen Mercury Vapor, color I corrected luminaires, I.E.S. Type III, mounted on 30 feet high steel poles. Power is to be fed by an underground direct burial cable installation and shall be equipped with necessary appliances for safe and proper operation of the system. Section 4 Estimate of Cost of Maintenance and Electrical Current and Method of Assessment As estimate of the cost of maintaining such lighting system and supplying current therefor is Five and 06/100 Dollars ($5.06) per unit month for each unit or the total sum of Nine Hundred Ten and 80/100 Dollars ($910.80) per year of which total seventy-five percent (75%) or Six Hundred Eighty-three and 10/100 Dollars ($683.10) is to be assessed against the property within the district on an area basis, and twenty-five percent (25%) or Two Hundred Twenty-seven and 70/100 Dollars ($227.70) is to be paid by the City of Bozeman. The estimated rate of assessment per year per square foot within the district is .001411592232. The cost of such improvement is to be assessed against the entire district, each lot or par- cel of land within such district will be assessed for that part of the whole cost which its area bears to the area of the entire district exclusive of streets, avenues and alleys. The total assessable area within said district is estimated to be 483,921.62 square feet and is the figure I on which all protests will be received, considered and determined. Section 5 Payment The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said operation and maintenance will include the furnishing of electric current, all amps as needed and the maintenance of poles, cables and other incidental items. The entire cost of such lights will be borne by The Montana Power Company. Section 6 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 9th day of March, 1966, at the hour of one o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement Lighting District No. 461, I the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. Adopted by the Commission of the City of Bozeman, Montana, at a regular and stated session of said Commission held on the 16th day of February, 1966. NOTICE IS HEREBY GIVEN that on the 16th day of February, 1966, at a regular meeting of the Commission of the City of Bozeman, Commission Resolution No. 1249 entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 461 FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT BLACKMORE PLACE, TERRANCE AVENUE, THE WESTERLY ONE-HALF OF NORTH SEVENTEENTH AVENUE, THE NORTHERLY ONE-HALF OF DURSTON ROAD AND THE EASTERLY ONE-HALF OF NORTH NINETEENTH AVENUE IN AND ADJACENT TO MAPLE TERRANCE SUBDIVISION, BEING A REARRANGEMENT OF TRACTS 1, 2, 3, 4, 9, 11 AND 13 OF HOMESITES SUBDIVISION~ CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORICY OF AND IN CONFORMITY WITH SECTION 11-2245 TO 112257 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1947. was passed and adopted. That Wednesday, the 9th day of March, 1966, at one o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 1249 as the time and place for hearing objections to the action proposed to be taken by said . resolution, and when and where any and all persons whose property is within said proposed I Special Improvement Lighting District No. 461 may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after the date of the first publication of this notice. That the general character of the improvement to be made in said Special Improvement Lighting District No. 461 is the erection and installation of Fifteen (15) 175 Watt, 7000 lumen Mercury Vapor, color corrected luminaires, I.E.S. Type III, mounted on 30 feet high steel poles. Power is to be fid by an underground direct burial cable installation and shall be equipped with necessary appliances for safe and proper operation of the system. An approximate and preliminary estimate of the cost of maintaining such lighting system and supplying current therefor is $5.06 per unit month for each unit or the total sum of $910.80 per year of which total 75% or $683.10 is to be assessed against the property within the district on an area basis, and 25% or $227.70 is to be paid by the City of BozeJnan. The estimated rate of assessment per year per square foot within the district is .001411592232. The proposed Special Improvement Lighting District will be established for the I purpose of paying the purpose of paying the operating anu maintenance cost of such lights only, which said operation and maintenance will include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables, and other incidental items. The entire cost of such lights will be borne by The Montana Power Company.
