COMMISSION RESOLUTION NO. 1255
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING
A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT
DISTRICT NO. 462 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING
AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT NORTH EIGHTEENTH
AVENUE. FROM WEST BEALL STREET TO DURSTON ROAD. WEST BEALL STREET
FROM THE ALLEY LINE OF BLOCK "B" AND NORTH NINETEENTH AVENUE. AND
THE SOUTHERLY SIDE OF WEST DURSTON ROAD BETWEEN THE ALLEY OF BLOCK

MENT OF BLOCK 6 OF KIRKS SECOND SUBDIVISION TO BOZEMAN. MONTANA.

WHEREAS. at a regular session of the Commission of the City of Bozeman, State of Montana,
held on the 16th day of February. 1966. the said Commission
duly passed Commission Resolution
No. 1250 declaring it to be the intention of the said Commission to create a special improvement
district to be known and designated as Special Improvement District No. 462 of the said City for
the purpose of operating and maintaining a street lighting system to light North Eighteenth Avenue
from West Beall Street to Durston Road. West Beall Street from the Alley line of Block "B" and
North Nineteenth Avenue, and the southerly side of West Durston Road between the alley of Block
"W' and North Nineteenth Avenue as platted in Graf's First Rearrangement of Block 6 of Kirks
Second Subdivision to Bozeman. Montana. said lighting system to be installed and paid for by the
Montana Power Company. all under the authority of and in conformity with Sections 11--2245 and
11--2257 inclusive, of the Revised Codes of Montana, 1947, which said Resolution of Intention is
of record and on file in the office of the Clerk of said City Commission and open to the inspection
of the public, and in hereby referred to for further particulars; and
WHEREAS. due proof has been made that service of notice of the adoption of said Resolution No.
1250 was duly made and given as by law provided; and
WHEREAS, at the time and place fixed in said Resolution No. 1250 for the making and filing of
protests against the creation of said proposed Special Improvement Lighting District No. 462.

wit. at the hour of 1:00 o'clock p.m. on Wednesday, the 9th day of March. 1966, being a regular

meeting time of said City Commission, at the Commission Chamber in the City Hall Building of the
City of Bozeman, there were not sufficient protests made or filed against the creation of said
Special Improvement Lighting District No. 462.
NOW, THEREFORE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN;
SECTION 1
That there be. and there is hereby created a special improvement district of the City of
Bozeman to be known and designated as Special Improvement Lighting District No. 462, for the
purpose of installingand maintaining a lighting system to light North Eighteenth Avenue from West
Beall Street to Durston Road, West Beall Street from the alley line of Block "B" and North Nine-
teenth Avenue, and the Southerly side of West Durston Road between the alley of Block "B" and North
Nineteenth Avenue as platted in Graf's First Rearrangement of Block 6 of Kirks Second Subdivision
to Bozeman, Montana, said lighting system to be installed and paid for by The Montana Power Company,
all under the authority of and in conformity with Sections 11-2245 to 11-2257 inclusive. of the
Revised Codes of Montana. 1947. pursuant to and in conformity with Commission Resolution No. 1250
of the Commission of the City of Bozeman. passed and adopted on the 16th Day of February. 1966, which
said Commission Resolution No. 1250 declares it to be the intention of said City Commission to create
said Special Improvement Lighting District No. 462 for the purposes aforesaid. and which said Comm-
ission Resolution No. 1250 is of record and on file in the office of the Clerk of said City Commission
in the City Hall Building. Bozeman. and is open to the inspection of the public. and is hereby referred
to for further particulars.
Section 2

That said Commission Resolution No. 1250 is hereby referred to am made a part hereof for fur-
ther particulars in respect to the boundaries of said Special Improvement District No. 462. the
estimated cost of said improvements and the method of assessing the same against the properst of
said District.
Section 3
The character of the improvement to be installed and paid for by The Montana Power vCompany is
the erection and installation of thirteen (13) 175 Watt Mercury-Vapor. color corrected luminaires,
mounted on 30 feet high. tapered steel poles. Power is to be fed
by a single overhead wire and the
installation shall be equiped with all necessary appliances for safe and proper operation of the

system.
Sec tion 4
The proposed Special Improvement Lighting District will be established for the
purpose of
paying the operating and maintenance cost of such lights only, which said operation and maintenance
will include the furnishing of electric current, all
lamps as needed and the maintenance of poles,
cables, and other incidental items.
The entire installation cost of such lights will be borne by
I The Montana Power Company. The portion of the cost of maintenance
and electrical current payable
by the City of Bozeman will be paid directly by the City of Bozeman and
the portion to be assessed
against the property within the district will be assessed arid paid annually as provided by law.
PASSED AND ADOPTED By the Commission of the City of Bozeman at a regular session thereof
held on the 9th day of March, 1966.
