HomeMy WebLinkAboutResolution 1254 Creates SID No. 461 .a 44 .L COMMISSION RESOLUTION NO. 1254 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 461 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAIN- TAINING A STREET LIGHTING SYSTEM TO LIGHT BLACKMORE PLACE, TERRACE AVENUE, THE WESTERLY ONE-HALF OF NORTH SEVENTEENTH AVENUE, THE NORTHERLY ONE-HALF OF DURSTON ROAD AND THE EASTERLY ONE~HALF OF NORTH NINETEENTH AVENUE IN AND ADJACENT TO MAPLE TERRACE SUBDIVISION, BEING A REARRANGEMENT OF TRACTS 1, 2,3, 4, 11 AND 13, OF HOMESITES SUBDIVISION, CITY OF BOZEMAN, COUNTY OF I GALLATIN. AIIo _ _ - WHEREAS, at a regular session of the Connnission of the City of Bozeman, State of Montana. held (i on the 16th day of February, 1966, the said Connnission duly passed COIIuuission Resolution No. ~ \"1,,~ \ 'J declaring it to be the intention of the said Commission to create a special improvement district to " ., . .. be known and designated as Special Improvement Distrh,t No. L~6l of the sai(: City for the purpose of operating and maintaining a street lighting system to light BlaLkmore Place, Terrae Avenue, the westerly one-half of North Seventeenth Avenue. the northerly one-half of Durston Road and the easterly one-half of North Nineteenth Avenue in and adjacent to Maple Terrace Subdivision. being a rearrangement of Tracts 1. 2, 3, 4, 9, 11 and 13 of Homesites subdivision. City of Bozeman, County of Gallatin, State of Montana, said lighting system to be installed and paid for by The Montana Power Company. all under the authori ty of and in conformity with Sections 11-2245 and 11-2257 inclusive, of the Revised Codes of Montana. 1947. which said Resolution of Intention is of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public. and is hereby referred to for further particulars; and WHEREAS. due proof has been made that service of notice of the adoption of said Resolution No. 1249 was duly made and given as by law provided; and WHEREAS , at the time and place fixed in said Resolution No. 1249 for the making and filing of protests against the creation of said proposed Special Improvement Lighting District No. 461. to~ wit, at the hour of 1:00 o'clock p.m. on Wednesday, the 9th day of March, 1966, being a regular meeting time of said City Commission. at the Connnission Chamber in the City Hall Building of the City of Bozeman, there were not sufficient protests made or filed against the creation of said I Special Improvement Lighting District No. 461. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That there be. and there is hereby created a special improvement district of the City of Bozeman to be known and designated as Special Improvement Lighting District No. 461, for the purpose of in- stalling and maintaining a lighting system to light Blackmore Place, Terrace Avenue, the westerly one-half of North Seventeenth Avenue, the northerly one-half of Durston Road and the easterly one- half of North Nineteenth Avenue in and adjacent to Maple Terrace Subdivision. being a rearrangement of Tracts 1. 2, 3. 4, 9. 11 and 13 of Homesites subdivision, City of Bozeman. County of Gallatin. State of Montana, said lighting system to be installed and paid for by The Montana Power Company. all under the authority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Re~ vised Codes of Montana, 1947. pursuant to and in conformity with Commission Resolution No. 1249 of the Commission of the City of Bozeman, passed and adopted on the 16th day of February, 1966, which said Commission Resolution No. 1249 declares it to be the intention of said City Commission to ~;reate said Special Improvement Lighting District No. 461 for the purposes aforesaid, and which said Commission Resolution No, 1249 is of 'record and on fi le in the office of the Clerk of said Ci ty Commission in the City Hall Building, Bozeman. and is open to the inspection of the public. and is hereby referred to for further particulars. Section 2 That said Commission Resolution No. 1249 is hereby referred to and made a part hereof for fur~ ther particulars in respect to the boundaries of said Special Improvement District No. 461, the I estimated cost of said improvements and the method of assessing the same against the property of said District. Sec tion 3 The character of the improvement to be installed and paid for by the Montena Power Company is the erection and installation of fifteen (15) 175 Watt. 7000 lumen Mercury Vapor, color corrected luminaires, LE.S. Type III, mounted on 30 feet high steel poles.. Power is to be fed by an under- ground direct burial cable installation and shall be equipped with necessary appliances for safe and proper operation of the system. COMMISSION RESOLUTION NO. 1254 ...-- 145 Section 4 The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said operation and maintenance will , include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables, , 'I and other incidental items. The entire installation cost of such lights will be borne by The Montana Power Company. The portion of the cost of maintenance and electrical current payable by the City of Bozeman will be paid directly by the City of Bozeman and the portion to be assessed against the property within the district will be assessed and paid annually as provided by law.
