HomeMy WebLinkAboutResolution 1253 Creates SID No. 465 :t41 COMMISSION RESOLUTION NO. 1253 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 465 FOR THE rURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTREGAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY DRAINAGE INLETS AND APPURTENANCES THERETO ON A PORTION OF NORTH EIGHT- EENTH AVENUE BE'IWEEN WEST BEALL STREET AND THE SOUTHERLY LOT LINES OF LOT 26, BLOCK A AND LOT 9 OF BLOCK B, GRAFIS FIRST REARRANGEMENT OF BLOCK 6, KIRKS SECOND SUB- I DIVISION, AND A PORTION OF WEST BEALL STREET FROM THE CENTERLINE OF THE ALLEY OF BLOCK A TO THE CENTERLINE OF THE ALLEY OF BLOCK B OF SAID GRAF'S FIRST REARRANGE- MENT OF BLOCK 6, CITY OF BOZEMAN, .MONTANA. ------- WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated on a portion of North Eighteenth Avenue and a portion of West Beall Street, as shown in the above caption, asking that a special improvement district be created for the purpose of constructing and installing an asphaltic- concrete pavement project to include intregal concrete curbs and gutters, storm drainage, and other work incidental thereto; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 2nd day of March, 1966, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Sec tion 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special im- provement district to be known and designated as Special Improvement District No. 465 for the purpose of constructing and installing an asphaltic-concrete pavement project on a portion of North Eighteenth Avenue between West Beall Street and the southerly lot lines of Lot 26, Block A and Lot 9 of Block B, Grafls First Rearrangement of Block 6, Kirks Second Subdivision and a portion of West Beall Street from the centerline of the Alley of Block A to the centerline of the Alley of Block B of said Grafls First Rearrangement of Block 6. Said pavement project to include construction and installation of I intregal concrete curbs and gutters, storm drainage and other work incidental thereto. Section 2 Boundaries. That the boundaries of said special Improvement District No. 465 are described as follows: Beginning at the northeasterly corner of Lot 25 of Block A, Graf's First Rearrangment of Block 6, Kirk's Second Subdivision; thence westerly along the northerly line of said Lot 25 and said Lot line extended to the centerline of the alley of Block A; thence southerly along the centerline of said alley of said Block A and said center- line projected southerly across West Beall Street to a point 64.14 feet southerly of the southerly line of said West Beall Street; thence easterly parallel to and 64.14 feet distant southerly from the southerly line of said West Beall Street a distance of 300.05 feet; thence northerly a distance of 64.14 feet and continuing northerly across West Beall Street to a point of intersection with the centerline of the alley of Block B of said Graf's First Rearrangement of Block 6; thence northerly along the centerline of the alley of said Block B to a point opposite the northerly line of Lot 10 of said Block B; thence westerly along the northerly lot line of said Lot 10 and said line extended and across North Eighteenth Avenue to the northeasterly corner of Lot 25 of Block A, being the point of beginning. Containing within the above described exterior boundaries the following lots and tracts of land, to-wi t: All of lots 18 thru 25 inclusive of Block A; all of lots 10 thru 17 inclusive of Block B, all in Graf's First Rearrangement of Block 6, Kirk's second Subdivision; a portion of Block 2, (64.14 x 300.05 Kirk's Second Subdivision.) Sec tion 3 Character of Improvements I Construction of a pavement project with intregal concrete curbs and gutters, st01"n1 drainage and mecessary appurtenances to said construction on a portion of North Eighteenth Avenue between West Beall Street and the southerly lot lines of Lot 26, Block A and Lot 9 of Block B, Graf's First Re- arrangement of Block 6, Kirk's Second Subdivision and a portion of West Beall Street from the center- line of the Alley of Block A to the centerline of the alley of Block B of said Grafls First Rearrange- ment of Block 6, said pavement project to include construction of an asphaltic-concrete type surface sourse, all necessary excavation, gravel back fill and other appurtenant work thereto. COMMISSION RESOLUTION NO. 1253 ___.n. --.-- -.-- 1.42 Section 4 Estimate of Cost The preliminary estimate of cost is $26,000.00, including all street excavation, all materials, installation costs and engineering and incidentals. Section 5 Method of Assessment The cost of such improvement is to be assessed against the entire district, each lot or parcel I of land within such district will be assessed for that part of the whole cost which its area bears to the area of the entire district, exclusive of streets, avenues, alleys and public places, and further each square foot of land within the district lying within 25 feet of the line of the street on which the improvements herein provided for are made, shall bear double the amount of the costs of such improvements per square foot of such land that each square foot of any other land within the district shall bear. The total actual square feet of assessable area within the district is 203233.06, which is the area on which all protests will be received, considered and determined. Section 6 Payments. That the payments for said improvements shall be made in twenty (20) annual installments ex- tending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 465, as author- ized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessar~ to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 465 Fund of the City of Bozeman, The Bonds wi 11 be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for that purpose in said Special Improvement District No. 465. Said bonds will draw an simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) per annum, which interest shall be chargeable as a part of the cost of I construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 19l~7, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to Special Improvements Districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and notice That the regular session of the City Commission of the City of Bozeman to be held at the Comm- ission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 23rd day of March, 1966, at the hour of one o'clock p.m. of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 465, the improvements proposed to be made pursuant there- to and the extend and tharacter thereof, or either thereof, and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention.
