A RESOLUTION OF TIm CITY COMMISSI:)N OF 'THE CITY OF BOZEMANJE-
CLARING IT TO BE THE INTENTION OF THr': CITY OF BOZEMAN, MONTANA,
TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL

CITY OF BOZEMAN, MONTANA.
WH'"~R EA S, there has been filed with the Clerk of the City Commiseion of the
City of Bozeman, Montana, a petition in due form of certain owners of properties
situated on West Villard Street, between North Tracy and North Willson Avenues,
abutting on Blocks 2 and 3 of Beall's Third Addition, asking that a special im-
provement district be created for the purpose of the construction and installation
of asphaltic-concrete pavement project to include intregal concrete curbs and
gutters, necessary drainage structures and the ne~e3sary appurtenances to said
pa vemen t; and,
WHEREAS, at a :regular meeting of the City Commission of the City of Bozeman
held on the 13th day of April, 1966, the aforesaid petition was respectively con-
sidered and granted;
NOW, THEREFORE, BE IT RESOLVET) BY THE CITY COMMISSION OF TIrE CITY OF BOZEMAN:
Section 1
Declaration of Intention I
That it is hereby declared to be the intention of the City of Bozeman to
create a special improvement district to be known and designated as Special
Improvement District No. 467 for the purpose of the construction and installation
of an asphaltic-concrete pavement project on West Villard Street, between North
Tracy and North Willson Avenues, abutting on Blocks 2 and 3 of Beall's Third
Addition to the City of Bozeman, Montana. Said pavement project to include
construction and installation of intregal concrete curbs and gutters and the
neces aary appurtenances to said pa vemen t.
Section 2
Boundaries
That the boundaries of said Special Improvement District No. 467 are described
as follows:
Beginning at the point of intersection of the centerline of
North v~illson Avenue and the centerline of West Villard Street;
thence northerly along the centerline of said North Willson
Avenue a distance of 80 feet; thence easterly parallel to and
80 feet distant northerly from the centerline of said West I
Villard Stree t, (being also along the northerly lines of lots
19 and 22 of Block 2 of Beall's Third Addition and said lines
projected) to a point of intersection with the centerline of
North Tracy Avenue; thence southerly along the centerline of
North Tracy Avenue a distance of 160 feet; thence westerly
parallel to and 80 feet distant southerly from the centerline
of said West Villard, (being along the southerly lot lines of
Lots 2 and 23 of Block 3 of Beall's Third Addition and said
lines projected) to a poin t of intersec tion wi th the centerline
of North ~illson Avenue; thence northerly along said centerline
of North ilIson Avenue a distance of 80 feet to the true point
of beginning.

Containing within the above described exterior boundaries the
following lots, blocks and tracts of land:
Lots 19, 20, 21 and 22 of Block 2 of Beall t s r.Ihird
Addition and the vacated portion of North Willson
Avenue abutting on Lots 21 and 22.
Lots 1, 2, 23 and 24 of Block 3 of Beall's Third
I Addition and the vacated portion of North Willson
Avenue abutting on Lots 23 and 24.
Section 3
Character of Improvements
Construction of a pavement project with Intregal concrete curbs and gutters,
necessary drainage structures and necessary appurtenances to said construction
on West Villard Street, between North Tracy and North Willson Avenues, abutting
on Blocks 2 and 3 of Beall's Third Addition, said pavement project to include
construction of an asphaltic-concrete type surface course, all necessary ex.
cavation, gravel backfill and other appurtenant work thereto.
Section 4
Es tima te of Cos t
The preliminary estimate of cost is ~12,OOO.OO, including all street ex~
cava tion, all ma tertals, installation costs and engineering and incidentals.
Section 5
Method of Assessment
The cost of such improvement is to be assessed against the entire district,
I each lot or parcel of land within such district will be assessed for that part
of the whole cost which its area bears to the area of the entire district, ex-
clusive of streets, avenues, alleys and public places; and further, each square
foot of lan-l within the district lying within 25 feet of the line of the street
or aVenue on which the improvements herein provided for are made, shall bear
double the amount of the costs of ruch improvement per square foot of such land
that each square foot of any other lan'-; within the district shall bear.
The
total actual square foot of assessable area within the said district is 45,607.13
square feet, which is the area figure on which all protests will be received,
considered and determined.
Section 6
Extended District
The City Commission of' the City of Bozeman does hereby find that the con-
templa ted work and improvements are, in the opinion of the City Commission,
of
more then local or ordinary public bene!! t and the t the cost and expense of
I such improvements shall be chargeable on an extended district and the City
Commission does hereby declare that the above described district and all lots
included therein will be benefited by the contemplated improvements and that
said district and all lots included therein shall be assessed to pay the costs
and expenses thereof.

Section 7
Payments
That the payments for sai" improvements shall be made in twenty (20) annual
installments exten,-'!ing over a period of nineteen (19) years, but this shall not
be construed to prevent payment in full at any regular payment date by any prop-
erty owner who desires to do do. It is proposed to pay the entire cost and I
expense of the construction and installation of said improvements with cash to
be obtained from the sale of bonds of said Special Improvement District No. 467,
as authorized by law. Such bonds will be in denomina tions of $100.00 each, and
fractions or multi.flles of $100.00 wb.ere necessary, to be issued and chargeable
against a fund to be known an:1 designated as Special Improvement District No. 467
Fund of the Ci ty of Bozeman. The bonds will "be redeemable a t the option of
the City, sIngly or in multiples, and in the order of their registration, when-
ever funds are available for that purpose in said Special Improvement 0istrict
No. 467. Said bonds will draw 8 simple interes t from the da te of their regis-
tration until called for payment, at a rate not to exceed six percent (6%) per
annum, whicfj interest shall be chargeable as a part of the cost of construction
and installa tion of said improvements. The bonds will be issued and sold in
accordance with the provisions of Sectionll-2232 and Section 11-2271, Revised
Codes of Montana, 1947, and all other ap,f:,licable provisions of Ti tIe 11 of the
Revised Coaes of Montana, 1947, relating to" speciallmprovement districts in I
cities and towns, and any amendments thereof or thereto.

protests and Notice
Tha t the regular session of the Ci ty Commission of the Ci ty of Bozeman to
be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on
Wednesday, the ~ day of May, 1966, at the hour of one o'clock p.m. of said
day, is the time and place, when and where the City Commission will hear and pass
upon all protests dulyans regularly mane and filed against the creation of said
proposed Special Improvement "District No. 467, the improvements
proposed to be made pursuant thereto and the extent and character thereof, or
either thereof, and the Clerk of the City Commission be, and she is hereby di-
rected to give notice in the manner and for the time as by law required,; of the
adoption of this resolution of intention.
ADOPTED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, at a regular and
sta ted sess ion of said Commission held on the 13th day of April, 1966.
