COMMISSION RESOLUTION NO. 3358
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DECLARING THE CITY COMMISSION'S INTENT TO ESTABLISH A
2000 SIDEWALK PROGRAM AND TO ORDER THAT SIDEWALKS BE INSTALLED
IN CERTAIN AREAS OF BOZEMAN, AS PROVIDED FOR IN SECTIONS
7-14-4109 AND 7-14-4110, MONTANA CODE ANNOTATED.
WHEREAS, Section 7-14-4109, Montana Code Annotated, provides that a local
governing body may order sidewalks constructed in front of any lot or parcel of land; and
WHEREAS, on the 28th day of March 1994 the City Commission did adopt
Commission Resolution No. 2965, revising the City's sidewalk policy and adopting rating/
ranking sheets to serve as the basis for developing a priority listing for installation of
sidewalks; and
WHEREAS, the City staff has developed a priority list for sidewalk installation; and
WHEREAS, the City Commission has determined that it is the best interests of the City
of Bozeman to install sidewalks along the streets listed herein.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That, in accordance with the provisions of Section 7-14-4109, Montana Code
Annotated, and the City's sidewalk policy, as established in Commission Resolution No.
2965, the City Commission declares its intent to order the installation of sidewalks along
both sides of the following streets:
1. West Koch Street between South 15th Avenue and South 19th Avenue;
2. West Koch Street between South 19th Avenue and South 23rd Avenue;
3. Lincoln Road between Willow Way and South 19th Avenue (north side
only);
4. Kagy Boulevard between Greek Way and South 11 th Avenue (south side
only);
5. Cypress Avenue between East Main Street and East Curtiss Street;
6. East Curtiss Street between Cypress Avenue and Aylsworth Avenue;
7. East Babcock Street between Cypress Avenue and Aylsworth Avenue;
8. East Olive Street between Cypress Avenue and McAdow Avenue;
9. McAdow Avenue between East Olive Street and East Curtiss Street;
10. East Main Street between Cypress Avenue and Highland Boulevard;
11. West Dickerson/North 22nd Avenue between South 19th Avenue and
West Koch Street;
12. Wheat Drive between North 7th Avenue and Mandeville Lane;
13. Mandeville Lane between Wheat Drive and North 7th Avenue (south side
only);
14. South 15th Avenue between West Koch Street and West Dickerson
Street;

15. South 20th Avenue between West Koch Street and West College Street.
Section 2
That at a regular session of the City Commission of the City of Bozeman, to be held
in the Commission Room, Municipal Building, 411 East Main Street, Bozeman, Montana, on
Monday, the 1st day of May 2000, at the hour of 7:00 p.m. of said day, is the time and
place when and where the City Commission will hear testimony in support of and in
opposition to the ordering of sidewalks as contained in Section 1, above.
The Clerk of the City Commission is hereby directed to publish notice of the adoption
of this resolution of intention.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular session thereof held on the 17th day of April 2000.

NOTICE IS HEREBY GIVEN that on the 17th day of April 2000, at a regular meeting of the
City Commission of the City of Bozeman, Montana, said Commission duly and regularly passed
and adopted Commission Resolution No. 3358, entitled:
COMMISSION RESOLUTION NO. 3358
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DECLARING THE CITY COMMISSION'S INTENT TO ESTABLISH A 2000
SIDEWALK PROGRAM AND TO ORDER THAT SIDEWALKS BE INSTALLED IN
CERTAIN AREAS OF BOZEMAN, AS PROVIDED FOR IN SECTIONS 7-14-4109 AND
7.14.4110, MONTANA CODE ANNOTATED.
A copy of said Commission Resolution No. 3358 is on file in the office of the Clerk of the
City Commission at 411 East Main Street, Bozeman, Montana, which states the City
Commission's intent to install sidewalks along both sides of particular streets within the city
limits of the City of Bozeman, as follows:
1 . West Koch Street between South 15th Avenue and South 19th Avenue;
2. West Koch Street between South 19th Avenue and South 23rd Avenue;
3. Lincoln Road between Willow Way and South 19th Avenue (north side only);
4. Kagy Boulevard between Greek Way and South 11 th Avenue (south side
only);
5. Cypress Avenue between East Main Street and East Curtiss Street;
6. East Curtiss Street between Cypress Avenue and Aylsworth Avenue;
7. East Babcock Street between Cypress Avenue and Aylsworth Avenue;
8. East Olive Street between Cypress Avenue and McAdow Avenue;

15. South 20th Avenue between West Koch Street and West College Street.
NOTICE IS HEREBY FURTHER GIVEN that Monday, the 1 st day of May 2000, at 7:00 p.m.
at the Commission Room, Municipal Building, 411 East Main Street, Bozeman, Montana, is
designated as the time and place set for hearing and passing on all public testimony in support
of and in opposition to this proposed 2000 Sidewalk Program.
