MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. lJ.84 FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT GREEK WAY BETWEEN SOUTH THIRD AVENUE AND KAGY BOULEVARD AND A PORTION OF KAGY BOULEVARD LYING WESTERLY OR SOUTH THIRD AVENUE AND ADJOINING GREEK WAY SUBDIVISION, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE 1;10NTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFORMITY WITH I SECTIONS 11-2245 to 11-2257 INCLUSIVE OF THE REVISED CODES OF MONTANA 1947. - - - - - - - - WHEREAS, there has been filed with the Clerk of the Commission of the City of Bozeman, Montana, a petition in due form of certain property owners between South Third Avenue and Kagy Boulevard and a portion of Kagy Boulevard lying westerly of South Third Avenue and adjoining Greek Way Subdivision asking that a special improvement lighting district be created for the purpose of operating and maintaining a lighting system to light the hereinbefore streets, roads and avenues in the City of Bo zeman, Ga lla t in Coun ty, Mon tana . WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held the 14th day of June, 1967, the aforementioned petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISS ION OF THE CITY OF BOZBMAN: Section I Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special im- provement district to be known and designated as Special Improvement Lighting District No. 484 of the City of Bozeman for the purpose ofoperating and maintaining a lighting system to light Greek Way be- tween South Third Avenue and Kagy Boulevard and a portion of Kagy Boulevard lying westerly of South I Third Avenue and adjoining Greek Way Subdivision. Section 2 Boundaries. The boundaries of said Special Improvement Lighting District are described as follows: Beginning at the East Sixteenth corner of the Southeast one-quarter of Section 13, T2 South, Range 5 East M.P.M., Bozeman, Gallatin County, Montana; thence South 890 14.4' West a distance of 611.0' to the east right of way line of the Chicago-Milwaukee-S t. Paul and Pacific Railway right of way~ thence along said east right of way line and a circular curve to the left having a radius of 741.8 feet to a point which bears North 150 13.0' West a distance of 358.1 feet from the intersection of the sixteenth line and the east railway right of way~ thence North 270 47.1' West along said right of way line a distance of 156.9 feet; thence north 42000.3' East a distance of 744.4 feet; thence east a distance of 280.0 feet to a point on the east line of section 13; thence South along said east line of said Section 13 a distance of 1029.4 feet to the point of beginning. Including within the above-described exterior boundaries Lots I, 2, 3.4.5.6,8, and 9 of Greek Way Subdivision which are to bear assess- ments for this improvement. Section 3 Character of Improvements The character of improvements to be installed and paid for by the Montana Power Company is the erection and installation of nine (9) 175 Watt, 7000 lumen Mercury Vapor, color corrected I luminaires IES Type III, mounted on 30 foot high steel poles; power is to be supplied by overhead ,,,iring and the installation shall be equipped with necessary appliances for safe and proper oper- ation of the system. Sec tion 4 Estimated cost of Maintenance and Electrical Current and Method of Assessment An estimate of the cost of maintaining such lighting system and supplying current therefor is COMMISSION RESOLUTION NO. 1329 --- 349 is Three and 70/100 Dollars ($3.70) per unit month for each unit. or the total sum of Three Hundred Ninety-Nine and 60/100 Dollars ($399.60) per year of which total Seventy-Five Per Cent (75%) or Two Hundred Ninety-Nine and 70/100 Dollars ($299.70) is to be assessed against the properties within the district on a linear foot basis and ~~enty-Five Per Cent (25%) of Ninety-Nine and 90/100 Dollars ($99.90) is to be paid by the City of Bozeman. Montana. The estimated linear feet to be assessed I within the district is 2('4(,.!+0 linear feet and is the figure on which all protests \~ill be received. considered and determined. and the estimated cost per linear foot is $0.1217105263 cents. The cost of such improvement is to be assessed against the entire district. each lot or parcel of land within such district will be assessed for that part of the whole cost. which its linear feet of frontage bears to the total linear feet of frontage within the district. Section 5 Payment The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only. which said operation and maintenance will include the furnishing of electric current. all lamps as needed and the maintenance of poles. cables, and other incidental items. The entire cost of installing such lights will be borne by the Montana Power Company. Section 6 Protests and Notice That the regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber. City Hall Building. Bozeman. Montana, on Wednesday, the 12th day of July, 1967. I at the hour of one o'clock p.m. of said day, are the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement Lighting District No. 484, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. Adopted by the Commission of the City of Bozeman, Montana, at a regular and stated session of said Commission held on the 21st day of June, 1967. I NOTICE IS HEREBY GIVEN that on the 21st day of June, 1967, at a regular meeting of the Commission of the City of Bozeman, Commission Resolution No. 1329 entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA DE- CLARING IT TO BE THE INTENTION OF THE SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 484 FOR THE PURPOSE OF OPERATING AND MAIN- TAINING A STREET LIGHTING SYSTEM TO LIGHT GREEK WAY BE~~EEN SOUTH THIRD AVENUE AND KAGY BOULEVARD AND A PORTION OF KAGY BOULEVARD LYING WESTERLY OF SOUTH THIRD AVENUE AND ADJOINING GREEK WAY SUB- DIVISION. SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POHER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CON- FORMITY WITH SECTIONS 11-2245 TO 11-2257 INCLUSIVE OFT.HE REVISED CODES OF MONTANA 1947. COMMISSION RESOLUTION NO. 1329 350 was passed and adopted. That Hednesday, the 12th day of July, 1967, at one o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 1329 as the time and place for hearing objections to the action proposed to be taken by said Resolution, and when and where any and all persons whose property is within said proposed Special Improvement Lighting District No. l~8lf may appear and show cause, if any they have, against said proposed improvement. Objections I must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after the date of the first publication of this notice. State of Montana, and open for inspection to all interested parties and the public generally. This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana, 1 94 7 .
