COMMISSION RESOLUTION NO. 1326
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES
OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTAIN TRACT OF
LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DES-
CRIBED, WITHIN THE CORPORATE LIMITS THEREOF.

I WHEREA~ there has been presented to the City Commission of the City of Bozeman a written and
verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman
so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman; and
WHEREAS, the proper legal description of said contiguous tracts located in the County
of Gallatin
State of Montana, is as fo llows :
A tract of land in the Southeast one-quarter of the Northeast one-
quarter (SE~NE~) of Section One (1) Township Two (Z) South, Range
Fi.ve (5) East of Montana Principal Meridian, Gallatin County,
Montana, being more particularly described as follows,
to-wit:
Beginning at the northwesterly corner of Westlake's Second
Subdivision of Bozeman, Montana, said point being North 88000'
West a distance of 1252.9 feet and North 1016'30" East a dist
ance of 30 feet from the east one-quarter corner of Section 1,
Township 2 South, Range 5 East, M.P.M.,
thence North 1016'30.
East along the easterly right of way line of the Interstate
Highway 1-90-6 (13) 296 as now constructed, a distance of 529.43
fee t; thence south 88043'30" East a distance
of 137 feet; thence
South fOI6'30" West parallel to and 137 feet easterly distant
from said Interstate right of way a distance of 531.16 feet to
the northeasterly corner of Westlake's Second Subdivision of
Bozeman, Montana; thence North 88000'
West along the northerly
line of said subdivision being also the northerly street line
of Oak Street, a distance of 137 feet to the point of beginning.
Containing within the above described exterior boundaries a
I total of 72,650.42 square feet or 1.6881 acres, of this total
the northerly 60 feet of the above described tract or 8220
square feet is to be deeded to the City of Bozeman for street
purposes leaving a net area of 64,430.415 square feet or 1.4791
acres.
WHE REAS , the City Commission of the said City of Bozeman has, by its Resolution No.
1323,
regularly passed and adopted on the 3rd day of May, 1967, declared it to
be for the best interests
of the said City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous
tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as
to include said contiguous tracts; and
WHEREAS, the Clerk of the City Commission has, pursuant to the provisions of Section 11-403,
Revised Codes of Montana, 1947, given the required notice to property owners and
caused to be
published the required public notice of such proposed extension of the boundaries of said City of
Bozeman; and
WHEREAS, twenty (20) days have expired since the date of the first publication of said
notice;
and
WHEREAS, none of the resident freeholders of the territory to be embraced have filed with the
City Clerk written expressions of disapproval, the total resident freeholders
of said territory
I being one (1).
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1. That pursuant to the authority vested in the City Commission of the City of Bozeman
by Section 11-403, Revised Codes of Montana, 1947,
it is hereby declared that the boundaries of the
said City of Bozeman shall be extended so as to embrace and include within the boundaries and cor-
porate limits of the said City of Bozeman the tracts contiguous thereto and hereinbefore described.

Section 2. That this Resolution shall be, and the same is hereby declared to be effective
immediately upon its adoption and approval.
Passed and adopted by the Commission of the City of Bozeman at a regular session held on the
30th day of May, 1967.

hereby certify that the foregoing Resolution No. 1326, was published by title
and number in the Bozeman Daily Chronicle, a newspaper of general circulation
printed and published in said City in the issue of the 5th day of June, 1967,
and due proof of such publication is on file in my office.
