HomeMy WebLinkAboutResolution 1323 Extending Boundaries -. 332 COMMISSION RESOLUTION NO. 1323 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE I~BITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF. - I WHEREAS, there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman and having presented to the City of Bozeman proposed plats and certificate of survey of said land; and WHEREAS. the proper legal description of said contiguous tracts located in the County of Gallatin, State of Montana, is as follows: A tract of land in the Southeast one-quarter of the Northeast one- quarter (SEt, NEt) of Section One (1) Township Two (2) South, Range Five (5) East of Montana Principal Meridian, Gallatin County, Montana, being more particularly described as follows, to-wit: .. Beginning at the northwesterly corner of Westlake's Second Subdivision of Bozeman, Montana, said point being North 88000' West a distance of 1252.9 feet and North 1016'30" East a distance of 30 feet from the East one-quarter corner of Section 1, Township 2 South, Range 5 East, M.P.M., thence North 1016'30" East along the easterly right of way line of the Interstate Highway 1-90-6 (13) 296 as now constructed, a distance of 529.43 feet; thence South 88043'30" East a distance of 137 feet; thence South 1016'30" West parallel to and 137 feet easterly distant from said interstate right of way a distance of 531.16 feet to the northeasterly corner of Westlake's Second Subdivision of Bozeman, Montana; thence North 88000' West along the northerly line of said subdivision being also the northerly street line of Oak Street, a I distance of 137 feet to the point of beg~nning. Containing within the above described exterior boundaries a total of 72.650.42 square feet or 1.6881 acres, of this total the northerly 60 feet of the above described tract or 8220 square feet is to be deeded to the City of Bozeman for street purposes leaving a net area of 64,430,415 swuare feet or 1.4791 acres WHEREAS, it will be for the best interest of theCity of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tract hereinbefore described to extend the boundaries of the City of Bozeman so as to include the said contiguous tract hereinbefore described within the corporate limits of the said City of Bozeman. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1947, it is hereby declared to be to the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as to include the contiguous tracts hereinbefore described within the boundaries and corporate limits of the City of Bozeman, Montana. Passed and adopted by the commission of the City of Bozeman, Montana, at a regular session held on the 3rd day of May, 1967. ATTEST: Mayor I ission COMMISSION RESOLUTION NO. 1323 333 NOTICE IN RE COMMISSION RESOLUTION NO. 1323 OF THE CITY OF BOZEMAN STATING THE INTENTION OF THE CITY COMMISSION TO EXTEND THE BOUNDARIES OF SAID CITY OF BOZEMAN TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND ADJOINING SAID CITY. NOTICE IS HEREBY GIVEN That on the 3rd day of May, 1967, at a regular meeting of the City I Commission of the City of Bozeman, the said Commission duly and regularly passed and adopted Commission Resolution No. 1323, entitled: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE IN- HABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CON- TIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF." NOTICE IS HEREBY FURTHER GIVEN, that Wednesday, the 31st Day of May, 1967, at one o"clock P.M., at the Commission Room of the City Hall, Bozeman, Montana, is designated as the time and place for hearing objections to the actron proposed to be taken in said Resolution No. 1323, whereby it is proposed to embrace the hereinafter described contigent territory within the corporate limits of the City of Bozeman, Montana. Expressions of approval or disapproval by resident freeholders of the territory proposed to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than twenty (20) days after the date of the first pub- lication of this Notice.
