HomeMy WebLinkAboutResolution 1322 Creates SID No. 489 329 COMMISSION RESOLUTION NO. 1322 A RESOLUTI8N OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. :.eo OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAINTAINING A STRE~T LIGHTING SYSTEM TO LIGHT THAT PORTION OF SOUTH GRAND AVENUE, SOUTH THIRD AVENUE, SOUTH FOURTH AVENUE AND SOUTH FIFTH AVENUE BETWEEN A POINT 150 FEET SOUTHERLY OF THE SOUTHERLY LINE OF WEST CLEVELAND STREET TO WEST LINCOLN STREET, AND TO LIGHT I THAT PORTION OF SOUTH SIXTH A VENUE FROM A POINT 150 FEET SOUTHERLY OF THE SOUTHERLY LINE OF WEST CLEVELAND STREET 'ID A POINT 50 FEET SOUTHERLY OF THE SOUTHERLY LINE OF WEST GRANT STREET, ALSO TO LIGHT WEST ARTHUR STREET, WEST GARFIELD STREET, AND WEST HAYES STRgET, FROM SIXTH A VENUE SOUTH TO THE ALLEY EAST OF SOUTH GHAND A VENUE, AND TO LIGHT WEST GRANT STR3~ET FROM A POINT 128 FEET WESTERLY OF SOUTH SIXTH AVENUE TO THE ALLEY EASTERLY OF SOUTH GRAND AVENUE. WHEREAS, at a regular sesston of the Commission of the City of Bozeman, State of Montana, held on the 15th day of March, 1967, the said Commission duly passed Commission Resolution No. 1319 declaring it to be the intention of the said Com- mission to create a special improvement district to be known and designated as Special Improvement District No. 480 of the said City for the purpose of operating and maintaining a street lighting system to light South Grand Avenue, South Third Avenue, South Fourth Avenue and South Fifth Avenue between a point 150 feet South- erly of the southerly line of West Cleveland Street to West Lincoln Street, and South Sixth Avenue from a point 150 feet southerly of the southerly line of West Cleveland Street to a point 50 feet southerly of the Southerly line of West Grant Street, also West Arthur Street, West Garfield Street and West Hayes Street from Sixth Avenue Sputhto the alley East of South Grand Avenue, and West Grant Street I from a point 128 feet westerly of South Sixth Avenue to the alley easterly of South Grand Avenue, said lighting system to be installed and paid for by The Montana Power Company, all under the authority of and in conformity with Sections 11~~245 and 11-2257 inc1usive,of the Revised Codes of Montana, 1947, which said Resolution of Intention is of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public, and is hereby referred to for further partioulars; and WHEREAS, due proof has been made that service of notice of the adoption of said Resolution No. 1319 was duly made and given as by law provided; and WHEREAS, at the time and place fixed in saId Resolution No. 1319 for the making and filing of protests against the oreation of said proposed Special Improvement Lighting District No. 480 to-wit, at the hour of 1:00 o'clock p.m. on Wednesday, the 12th day of April, 1967, being a regular meeting time of said City eommission, at the Commission Chamber in the City Hall Building of the City of Bozeman, there were not suffioient protests made or filed against the creation of said Special Improvement Lighting District No. 480. I NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Seotion 1 That there be, and there is hereby created a special improvement district of the Ci ty of Bozeman to be known and designa tad as Special Improvement Lighting District No. 480, for the purpose of installing and maintaining a lighting system to light South Grand Avenue, South Third Avenue, South Fourth Avenue and South Fifth Avenue between a point 150 feet southerly of the southerly line of West Cleveland Street COMMISSION RESOLUTION NO. 1322 "------ 330 to West Lincoln Street, and South Sixth Avenue from a point 150 feet southerly of the southerly line of West Cleveland Street to a point 50 feet southerly of the southerly line of West Grant Street, also West Arthur Street, West Garfield Street and West Hayes street from Sixth Avenue South to the alley East of South Grand Avenue, and West Grant Street from a point 128 feet westerly of South Sixth Avenue I to the alley easterly of South Grand Avenue, said lighting system to be installed and paid for by The Montana Power Company, all under the authority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Revised Codes of Montana, 1947, pursuant to and in conformity with Commission Resolution 1319 of the Commission of the City of Bozeman, passed and adopted on the 15th day of March, 1967, which said Commission Resolution No. 1319 declares it to be the intention of said City Commission to create said Special Improvement Lighting District No. 480 for the purposes aforesaid, and whieb said Commission Resolution No. 1319 is ot record and on file in the office of the Clerk of said City Commission in the Ci ty Hall Building, Bozeman, and is open to the inspection of the public, and is hereby referred to for further particulars. Sec tion 2 That said Commission Resolution No. 1319 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improve- ment District No. 480, the estimated cost of said improvements and the method of assessing the same against the property of said District. I Section 3 The charaoter of the improvement to be installed and paid forby ~e Montana Power Company is the erection and installation of one hundred thirteen (113) 175 Wa tt, 7000 Lumen, Mercury-Vapor color corrected luminsire I.E.S. Type III mounted on 30 feet high steel poles. Power is to be supplied by a single wire overhead conduotor equipped with the necessary appllancesfor safe and proper operation of the system. Sec tion 4 The proposed Special Improvement Ltghting District will be established for the purpose of paying the operating ani~ maintenance cost of such lights only, which said operation and maintenance will include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables, and other incidental items. The entire installation cost of such lights will be borne by The Montana Power Company. The portion of the cost of maintenanoe and electrical current payable by the City ot Bozeman will be paid directly by the Ci ty of Bozeman and the portion to be assessed against the property wi thin the district will be assessed and paid I annually as provided by law. PASSED AND ADOPTED by the Commission of the City of Bozeman at a regular session thereof held on the 12th day of April, 1967.
