Montana. a petition in due form of certain property owners on South Grand Avenue. South Third Avenue. South Fourth Avenue and South Fifth Avenue betwe€'n a point 150 feet southerly of the southerly line of Hest Cleveland Street to West Lincoln Street. and South Sixth Avenue from a point 150 feet south- erly of the southerly line of West Cleveland Street to a point 50 feet southerly of the south- erly line of West Grant Street. also 1-.1est Arthur Street. West Garfield Street and West Hayes Street fro1\' Sixth Avenue South to the alley East of South Grand Avenue. and W('~;t Grant Strect from a point 128 feet westerly of South Sixth Avenue to the alley easterly of South Grand Avenue. asking that a special improvement lighting district be created for the purpose of operating and main- taining a lighting system to light the hereinbefore described streets, roads and avenues in the City of Bozeman. Gallatin County, Montana HHEREAS. at a regular meeting of the City Commission of the City of Rozeman held the 15th day of I March. 1967. the aforesaid petition was respectively considered and granted; NOW. THEREFORE, BE IT RESm,VED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Spction 1 Declaration of Intention That it is herehy declared to he the intention of thp City of Bo~eman to creatE' a special improvement district to be known and designated as Spe.eial Improvement 1,ighting District No. t~80 of the City of Bozeman for the purpose of operating and maintaining a lighting system to light that rJOrLion of South Grand Avenue. Section 2 Boundaries. I The boundaries of the said Special Improvement 1,i.ghting District are described as follows: Beginning at a poirit of intersection of the centerline of West Lincoln Street and the prolongation of the centerline of the alley of Block 21. Butte Addition to the City of Rozeman. Type III mounted on 30 feet high steel poles. Power is to be supplied by a single wire overhead conducter equipped '<lith the necessary appliances for safe and I proper operation of the system. Section 1+ Estimate of Cost of Maintenance and Electrical Current and Method of Assessment. An estimate of the cost of maintaining such lighting system and supplying current therefor is Thrf'e and Seventy one-hundredths dollars ($3.70) per unit month for each unit or the total sum of Five Thousand Seventeen and twenty one Hundredths dollars ($5017.20) per year; of which total seventy-five percent (75%), or Three Thousand Seven Hundred Sixty-two and Ninety one- --... 322 hundredths dollars ($3762.90) is to be assessed against the rroperties within the district on an area baRis and twenty-five percent (25':0, or one Thousand THO Hundred Fifty-four and Thirty one- h~ndredths dollars e1254.30) is to be paid by the City of Bnzeman, Montana. The estimated rate of assessment per year square foot of assessable property within the district is $0.002102904563 per square foot. Section 5 Payment The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said operation and maint- enance will include the furnishing of electric current, all lamps as needed and the ma in tenance of poles, cables, and other incidental items. The entire cost of installation of such lights will be borne by The Montana Power Company. Section 6 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Build ing, Bozeman, Montana, on Hednesday, the 12th day of April, I 1967, at the hour of one o'clock p.m. of said day, are the time and place when and where th~' City Commission wi 11 hear and pass upon all prates ts duly and regularly made and fi led agains t the creation of said proposed Special Improvement Lighting District No. 480, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof, aml the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. That Wednesday, the 12th day of April, 1967, at one o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana,is designated by said Resolution No. 1319 as the time and place for hearing objections to the action proposed to be taken by said Resolution, and when and where I any and all persons whose property is within said proposed Special Improvement Lighting District No. 480 may appear and show cause, if any they have, against said proposed improvement. That the general Character of the improvement to be made in said Special Improvement Lighting District No. !~80 is the erection and installation of one hundred thirteen (113) 175 Watt, 7000 Lumen, Mercury-Vapor color corrected 1uminaire LE.S. An approximate and preliminary estimate of the cost of maintaining such lighting system and supplying current therefor is $3.70 per unit month for each unit or the total sum of $5,017.20 per year; of which total 75~, or $3,762.90 is to be assessed against the properties within the district on an area basis and 2570' or $1,254.30 is to be paid by the City of Bozeman, Montana. The estimated rate of assessment per year per square foot of assessable property within the dis- trict is $0.002102904S63 per square foot.
