SUBJECT: Commission Resolution No. 4518 to Donate Equipment from the old Water Treatment Plant to the Town of White Sulphur Springs, Montana Rural Water and the
Montana Department of Environmental Quality

RECOMMENDATION: Approve Commission Resolution No. 4518 to donate equipment from the old Water Treatment Plant to the Town of White Sulphur Springs, Montana Rural Water and
the Montana Department of Environmental Quality.
BACKGROUND: Section 7-8-4201, Montana Code Annotated, grants the City of Bozeman
the power to dispose of any property which is no longer necessary to conduct City business. This statute also provides the authority for the City to donate property upon a 2/3 majority vote of the
City Commission.
The construction of the new Water Treatment Plant is nearing completion and the new Plant
should be operating in the near future. Several items of equipment from the old plant are no longer needed and, because of their age and condition, have very little value. Staff would like to
donate some of these items to the Town of White Sulphur Springs. In 2013, White Sulphur
Springs suffered severe tornado damage and the Department of Environmental Quality is
requiring them to acquire expensive equipment that we have and no longer need. The remaining
equipment that the City wishes to dispose of would be donated to Montana Rural Water or the Montana Department of Environmental Quality. These organizations would then donate these
items to needy systems throughout Montana.
The equipment to be disposed of includes:
• (13) Hach 1720 E Turbidimeters
• (7) Hach SC100 Controllers
• (5) Hach 1720 C Turbidimeters for Spare Parts
• (2) Hach Surface Scatter Turbidimeters
• (1) Hach Cl-17 Chlorine Analyzer
• Capital Controls Gas Chlorination Equipment and Spare Parts
UNRESOLVED ISSUES: None

ALTERNATIVES: This equipment could be sold but due to its age and condition, it has
little value.

COMMISSION RESOLUTION NO. 4518
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AUTHORIZING THE DONATION OF CERTAIN ITEMS FROM THE
WATER TREATMENT PLANT TO OTHER GOVERNMENT AGENCIES WITHIN
THE STATE OF MONTANA.
WHEREAS, the City of Bozeman has recently completed construction on a new
Water Treatment Plant and has equipment that is no longer needed; and
WHEREAS, the equipment to be donated has been salvaged from the old Water
Treatment Plant and has been replaced by new equipment and has little or no value and is no
longer needed; and
WHEREAS, the Town of White Sulphur Springs suffered tornado damage in 2013 and
has a need for several items the City wishes to dispose of; and
WHEREAS, Montana Rural Water and the Montana Department of Environmental
Quality offers programs that accept used equipment to be donated to other agencies in need; and
WHEREAS, Section 7-8-4201, Montana Code Annotated, grants the City of Bozeman
the power to donate of any property which is no longer necessary for the conduct of the City
business ; and
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:

Section 1
That it is hereby declared to be in the best interests of the City of Bozeman to dispose of the
equipment (Attachment A) by donating it to the Town of White Sulphur Springs, Montana Rural
Water and the Montana Department of Environmental Quality.
Section 2
PASSED AND APPROVED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the 7th day of April, 2014.
