CALL TO ORDER AND ATTENDANCE Chairperson Garberg called the meeting to order at 7:00 p.m. and took attendance. PUBLIC COMMENT None. ITEM 3. MINUTES OF SEPTEMBER 17, 2013 AND THE AMENDED MINUTES OF AUGUST 20, 2013 A motion was made and seconded to approve the amended minutes of the August 20, 2013 meeting as amended. The motion passed unanimously. A motion was made and seconded to approve the minutes of the September 17, 2013 meeting as amended. The motion passed unanimously. ITEM 4. PROJECT REVIEW 1. Oak Meadows ZMA #Z-13175 A Zone Map Amendment application requested by owner RES-MT Oak Meadows LLC, 709 NW 107th Avenue 4th Floor, Miami FL 33172, applicant Cougar Properties LLC, 3805 Valley Commons Drive #12, Bozeman MT 59718, and representative PC Associates LLC, 26D Shawnee Way, Bozeman MT 59715, to change 5.74 acres from R-4 (Residential High Density District) to B-2 (Community Business District) zoning. The property is legally described as Lots 1 and 2 and Open Space, Block 5, and Lots 1 and 2 and Open Space 2 in Block 4 and a portion of Park 1 of the Oak Meadows Subdivision, and portions of North 14th Avenue and North 12th Avenue, as platted in said subdivision in the SW 1/4 Section 1, T2S, R5E, P.M.M., City of Bozeman, Gallatin County, Montana. (Rogers) The Applicant requested a continuance on the project. There was not public comment on this item. A motion was made and seconded to continue this item to the November 5, 2013 meeting at 6:00 pm. The motion passed unanimously. 2. Z-13164 Spring Creek Resort Article 38.11 Urban Mixed Use Text Amendment An Article 38.11 Urban Mixed Use Text Amendment application request by Spring Creek Village LLC, 101 East Main Ste. D, Bozeman, MT 59715, applicant Delaney & Co. Inc., 101 East Main Ste. D, Bozeman, MT 59715, and representative Jami Morris, 2440 Etta Place Ste. D, Bozeman MT 59718, to modify the text of the UMU District. (Saunders) Planner Saunders presented the project. He noted that this application is for the text and not the map, and so there is no specific location for this, and any place that is designated as Urban Mixed Use would be subject to any changes being adopted.There is currently only one Urban Mixed Use location on the map at the corner of Ferguson and Huffine Lane. He noted that the staff report suggests some revisions to the language the applicant had originally requested. He then reviewed some of the most significant suggested changes, including how to measure the blend of mixed uses, unique characteristics of the urban mixed use district as the only district that requires (as opposed to allows) mixed use, structure parking with liner buildings, (active ground floor activity of smaller shops or offices along the street), how to calculate the required amount of residential component (a ratio of dwelling units per square footage as a minimum, which can be phased across the project), removal of the requirement that buildings to be adjacent to the street, minimum building height of three stories and having varying heights achieved through multiple stories, and public spaces as a way to meet the parkland requirement as a combination of land and installation of improvements, private streets (which the City does not generally favor), and application noticing. Staff recommends approval with the edits to the original language. Staff supports items 1 through 8, but does not support items 9 and 10. No public comment has been received. The City Commission will review the application on October 28, 2013. Both the Parks and Recreation Advisory Board and the Bicycle Advisory Board have been advised of the application and may choose to review it in advance of the City Commission review. The Parks and Recreation Advisory Board subdivision review committee opposed the applicant’s proposed language regarding parks. Questions included amended building height, parkland, private streets and nonconformance of street sections, and angle parking. Applicant representative Jami Morris reiterated that this zoning currently appears in only one location within the city. They are in agreement with everything in the staff report and have decided to withdraw the request for item 9. There was no public comment. A motion was made and seconded to adopt the findings in the staff report and recommend approval of the application with the modifications recommended by staff. The motion was amended to include removing the items known as item 9 and 10. The motion was approved unanimously. ITEM 5. NEW BUSINESS None. ITEM 6.
