Home My WebLink AboutResolution 1337 Removal of Noxious Weeds 370 COMMISSION RESOLUTION NO. ~ A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MON1J:'ANA, TO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS FOR 1J:'HE YEAR 1967, PURSUANT 'IX) THE PROVISIONS OF CHAPTER 6.50 I OF THE BOZEMAN MUNICIPAL CODE. WHEREAS, the City Council of the City of Bozeman heretofore duly and regularly passed Ordinanoe No. 428, entitled: " '! '~:A:NFORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES ", AND WHEREAS, Section 11-985 R.C.M., 1947, provides the City or Town Council has power to declare and determine what vegetation within the City or Town shall be noxious weeds, and to provide the manner in whioh they shall be exterminated, and to require the owner or owners of any property within said City or Town, to exterminate or remove noxious weeds from their premises, and one-half of any road or street lying next to the lands or boulevard abutting thereon, and to provide, in the event the owners or owner of any of said premises neglect to exterminate or remove noxious weeds therefrom, for levying the cost of such extermination or removal as special assessment against the property; and WHEREAS, owners of ppemises in said City have neglected to exterminate and remove noxious weeds therefrom during the year 1967 and the City of Bozeman, pursuant to Section 11-95 R.C.M., 1947, and Section 6.50.020 of the Bozeman I Municipal Code, have exterminated and removed noxious weeds from the premises of said owners and the total cost of the extermination and removal thereof is oharge- able to the property as hereinafter set forth, pursuant to the provisions of said Section 11-985, Political Code, R.C.M., 1947, and said Section 6.50.020 of the Bozeman Municipal Code. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That during the year 1967, the City of Bozeman has exterminated and removed noxious weeds from the properties in the City of Bozeman and defrayed the cost thereof as set forth in the Schedule hereto attached and made a part hereof. See tion 2. That to defray the cost $1480.00 of exterminating and removing said noxious weeds from said premises as set forth in said schedule, hereto attached and made a part hereof, for the year 1967, there be, and there is hereby levied and assessed a special tax against said property as set forth in said schedule, hereto attached and made a part hereof; tha t a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in the assessment list hereto attaohed marked "Schedule One", and made a I part hereof; that the several sums set opposite the names of the owners and the description of the lots and parcels of land be, and the same are hereby levied and asses sed upon and agains t sa id 10 ts and agains t a-aid loots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of land desoribed in said assessment list, "Schedule One", as required COMMISSION RESOLUTION NO. 1337 -..--...- ..-- :3'11 by law; that said Sums shall be paid and the collection thereof shall be made in the manner in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when same shall bticome due and payable shall make such persons and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. I Section 3. That the regular session of the Commission of the City of Bozeman to be held on the 30th day of August, 1967 at the Commission Room, City Hall Building, be and the same is hereby designated as the time and place at which ob- jections to the final adoption of this resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, and she is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission stating that a resolution levying a special assessment of taxes to defray the cost of exterminating and removing noxious weeds from certain properties in The City of Bozeman for the year 1967, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing objections, and the final adoption of this resolution. HEARING, FINAL ADOPTION COMMISSION RESOLUTION NO. 1337 LEVYING SPECIAL ASSESSMENT OF TAXES TO DEFRAY THE COST OF EXTERMINATING AND REMOVING NOXIOUS WEEDS ON CER TAIN PROPER TIES IN THE CITY OF BOZEMAN FOR THE YEAR 1967. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 23rd day of August, 1967, Commission Resolution No. 1337 was I duly passed and adopted; that said Commission Resolution No. 1337 levies and assesses a special assessment of taxes upon certain properties in the City of Bozeman for the year 1967 to defray the cost of exterminating and removing noxious weeds for the year 1967. ~hat, said Commission Resolution No. 1337 is now on file in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons COMMISSION RESOLUTION NO. 1337 372 interested for a period of five days; that Wednesday the 30th day of August, 1967, at 1:00 o'clock P.M. of said day at a regular session of the Commission of The City of Bozeman, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass,"'upon any and all objections that may be made to the final passage and adoption of said Commission Resolution No. 1337 and the levying of said assessment; the t, said Resolution will be finally passed and I adopted at said regular session of said Commission subject to such corrections and amendments as may be made upon objections made and filed within the five days limit as provided by law.
