COMMISSION RESOLUTION NO. 1331
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING
A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT
DISTRICT NO. 484 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING
AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT GREEK HAY BETWEEN
SOUTH THIRD AVENU~AND KAGY BOULEVARD AND A PORTION OF KAGY BOULEVARD
LYING WESTERLY OR SOUTH THIRD AVENUE AND ADJOINING GREEK WAY SUB-
DIVISION, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE

MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND TN CONFORMITY
\\11TH SECTIONS 11-2245 TO 11-2257 INCLUSIVE OF THE REVISED CODES OF
MONTANA 1947.
Whereas, at a regular session of the Commission of the City of
Bozeman, State of Montana,
he Id on the 2ls t day of June, 1967,
the said Commission duly passed Commission Resolution No. 1329
declaring it to be the intention of the said Commission to create a special improvement district
to be known and designated as Special Improvement District No. 484 of the said City for the pur-
pose of operating and maintaining a street lighting system to light Greek Way Between South Third
Avenue and K;tgy Boulevard and a portion of Kagy Boulevard lying westerly of South Third Avenue
and adjoining Greek Way Subdivision, said lighting system to be installed and
paid for by the
Montana Power Company. all un0er the authority of and in conformity with Sections 11-2245 and
11-2257 inclusive, of the Revised Codes of Montana. 1947. which said Resolution
of Intention is
of record and on file in the office of the Clerk of said City Commission and open to the inspection
of the public. and is hereby referred to for further particulars; and
WHEREAS, due proof has bee made that service of notice
of the adoption of said Resolution
No. 1329 was duly made and given as by law provided; and
I WHEREAS, a t the time and place fixed in said Resolution
No. 1329 for the making and filing
of protests against the creation of said proposed Special Improvement Lighting District No. 484
to-wi t. at the hour of 1:00 o'clock p.m. on Wednesday.
the 12th day of July. 1967. being a regular
meeting time of said City Commission, at the Commission Chamber in the City Hall Building of the
City of Bozeman, there were not sufficient protests made or filed against the creation of said
Special Improvement Lighting District No. 484.
NOW, THEREFORE, BE IT
RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN;
Sec tion 1
That there be. and there is hereby created a special improvement
district of the City of
Bozeman to be known and designated as Special Improvement Lighting District No. 48ll,
for the pur-
pose of operating and maintaining a street lighting system to light Greek Way between South Third
Avenue and Kagy Boulevard and a portion of Kagy Boulevard lying westerly of South Third Avenue
and adjoining Greek Way Subdivision, said
lighting system to be installed and paid for by The
Montana Power Company, all under the authority of and in conformity
with Sections 11-2245 to
11-2257 inclusive. of the Revised Codes of Montana, 1947, pursuant to and
in conformity with
Commission Resolution No. 1329 of the Commission of the City of Bozeman, passed and adopted
on
I the 21st day of June, 1967, which said Commission Resolution No.
1329 declares it to be the in-
tention of said City Commission to create said Special Improvement T,ighting District No. 48/+ f(1r
the purposes aforesaid, and ,,,hich said Commission Resolution No.
1329 is of record and on file
in the office of the Clerk of the City Commission in the City Hall Building. Bozeman, and
is open
to the inspection of the public, and is hereby referred
to for further particulars.

Section 2
That said Commission Resolution No. ]129 is hereby referred
to and made a part hereof for
further particulars in respect to the boundaries of said Special
Improvement District No. h84, the
estimated cost of said improvements and the method
of assessing the same against the property of
said D i s t r i ct.

Section 3
The character of improvements to he installed and paid
for by the Montana Power Company is
the erection and installation of nine (9)
175 Watt, 7000 lumen Mercury Vapor,
color corrected
luminaires IES Type III, mounted on 30 foot high steel poles. Power is
to be supplied by overhead
wiring and the installation shall be equipped with necessary appliances
for safe and proper oper-
a tion of the sys tem.
Section L~
The proposed Special Improvement Lighting District ,,,ill be established for the purpose of
paying the operating and maintenance cost of such lights only, 1"hich said operation and mainte-
nance will include the furnishing of electric current,
all lamps as needed and the maintenance
of
po Ie s, cablE's, nnd other incidental items.
The entire installation cost of such lights will be
horne by The Montana Power Company. The portion of the cost of maintenance and electrical current
payable by the Ci ty of Bozeman 'viII be p3id directly ~y the City of Bozeman and
the portion to
be assessed against the property within the district will be assessed and paid annually as pro-
vided by law.
