COMMISSION RESOLUTION NO. 1363 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 487 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT TOGETHER WITH INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES TIlE RE TO , ALSO CONSTRU- CTION AND RECONSTRUCTION OF NECESSARY DRAINAGE FACILITIES INCLUDING STORM DRAINAGE PIPE,MANHOLES, INLETS AND OTHER NECESSARY APPURTENANCES I THERETO, ON SEVENTH (7TH) AVENUE SOUTH, GRANT STREET TO KAGY BOULEVARD AND ON THE NORTHERLY ONE-HALF OF KAGY BOULEVARD BETWEEN A POINT 200 FEET WESTERLY OF THE WEST LINE OF SOUTH SEVENTH (7TH) AVENUE AND A POINT 919 FEET EASTERLY OF SAID WESTERLY LINE. ----- WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated on Seventh Avenue South, Grant Street to Kagy Boulevard and on the northerly one-half of Kagy Boulevard between a point 200 feet westerly of the west line of South Seventh Avenue and a point 919 feet easterly of said wes- terly line asking that a special improvement district be created for the purpose of constructing and installing an asphaltic-concrete type pavement project to include intrega1 concrete curbs and gutters, storm drainage, and other work incidental thereto; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 13th day of March, 1968, the aforesaid petition was respectively considered and granted; NOW, TIlEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special I improvement district to be known and designated as Special Improvement District No. 487 for the purpose of constructing and installing an asphaltic-concrete pavement project on Seventh Avenue South, Grant Street to Kagy Boulevard and on the northerly one-half of Kagy Boulevard between a point 200 feet westerly of the west line of South Seventh Avenue and a point 919 feet easterly of said westerly line. Said pavement project to include construction and installation of intregal concrete curbs and gutters, storm drainage, and other work incidental thereto. Section 2 Boundaries. That the boundaries of said Special Improvement District No. 487 are described as follows: Beginning at a point which lies 30 feet due North and North 89035' East 230 feet from the intersection of the center1ines of Vacated Grant Street and South Seventh Avenue as originally platted in Capitol Hill Addition to Bozeman, Montana; thence due South, parallel to and 230 feet distant easterly of the centerline of South Seventh Avenue extended southerly, a distance of 1584.94 feet to a point which lies 200 feet North of the northerly line of Kagy Boulevard right of way; thence North 89014.6' east parallel to and 200 feet distant northerly from said northerly right of way line of Kagy Boulevard to the point of intersection with the easterly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company spur Track easement; thence southeasterly along said easterly line of said easement to a point of intersection I with the southerly right of way line of Kagy Boulevard said point being 45 feet southerly of the East one-sixteenth (E 1/16) line of the South- east one-quarter (SE~) of Section 13, T2S, R5E, M.M.; thence South 89014.6' West along the southerly right of way line of said Kagy Boule- vard a distance of 888.97 feet; thence due North parallel to and 230 feet westerly of the centerline of South Seventh Avenue extended southerly a distance of 1874.94 feet to a point on northerly line of vacated Grant Street as originally platted in the Capitol Hill Addition to Bozeman, Montana; thence North 89035' East along said northerly line of said vacated Grant Street a distance of 460 feet to the true point of beginning. COMMISSION RESOLUTION NO. 1363 ..---- ...---.. ..-- - -...-- .-..- 441 All property included within the above described exterior boundaries is owned by the State of Montana for use and benefit of the College of Agriculture and Mechanical Arts now known as MOntana State University. Section 3 Character of Improvements. I Construction of a pavement project with intregal concrete curb and gutter, installation of storm drainage facilities including storm sewers, manholes, inlets and other necessary appurte- nances, said pavement project to include construction of an asphaltic-concrete type surface course, all necessary excavation, gravel backfill and other appurtenant work thereto including construction of intrega1 concrete curbs and gutters. Section 4 Estimate of Cost The preliminary estimate of cost is $80,000.00, including all street excavation, all materials installation costs and engineering and incidentals. Section 5 Method of Assessment The cost of such improvement is to be assessed against the entire district, each lot or parcel of land within such district will be assessed for that part of the whole cost which its linear feet of frontage on the improvement bears to the linear feet of frontage of the entire district. The total linear feet of frontage of the property within said proposed Special Improvement District -I No. 487 is 4026.77 linear feet which is the frontage on which all protests will be received, con- sidered and determined. Section 6 Payments That the payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent pay- ment in full at any regular payment date by any property owner who desires to do so. It is pro- posed to pay the entire cost and expense of the construction and installation of said improve- ments with cash to be obtained from the sale of bonds of said Special Improvement District No. 487, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 487 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for that purpose in said Special Improvement District No. 487. Said bonds will draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) per annum, which interest shall be charge- I able as a part of the cost of construction and installation of said improvements. The bond s wi 11 be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman to be held at the \ COMMISSION RESOLUTION NO. 1363 442 Commission Chamber, City Hall Building, Bozeman, Montana, On Wednesday, the 3rd day of April, 1968, at the hour of one o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 487, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof, and the I Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. ADOPTED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, at a regular and stated session of said Commission held on the 13th day of March, 1968. That Wednesday, the 3rd day of April. 1968. at one o'clock p.m.. at the Commission Room of the City Hall. Bozeman, Montana. is designated by Resolution No. 1363 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice.
