A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 486 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN EIGHT (8) INCH SANITARY SEWER LATERAL AND A SIX (6) INCH CAST IRON WATERMAIN ON KAGY BOULEVARD,..,BE'IWEEN THE CENTERLINE OF GREEK WAY I AND A POINT NINE HUNDRED EIGHTY TWO ,AND FORTY-SEVENHUNDRETHS (982.47) FEET WESTERLY THEREOF. THE CONSTRUCTION AND INSTALLATION OF SAID SANI- TARY SEWER AND WATERMAIN TO INCLUDE TRENCH EXCAVATION AND BACKFILL, INSTALLATION OF VITRIFIED TILE SEWER AND CAST IRON PIPE, NECESSARY WYES AND TEES, SERVICE STUBS, PIPE BEDDING MATERIAL, NECESSARY IlANHOLES AND FIRE HYDRANTS AND OTHER APPURTENANT WORK THERETO. ----- WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated on Kagy Boulevard between the centerline of Greek Way and a point 982.47 feet westerly thereof asking that a special improve- ment district be created for the purpose of constructing and installing an eight (8) ~nch sanitary sewer lateral and a six (6) inch cast iron watermain, to include trench excavation and backfill, installation of vitrified tile sewer and cast iron pipe, necessary wyes and tees, service stubs, pipe bedding material, necessary manholes and fire hydrants and other appurtenant work thereto; and, WHEREAS, At a regular meeting of the City Commission of the City of Bozeman held on the 13th day of March, 1968, the aforesaid petition was respecti~ely considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Sec tion 1 I Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a Special Improvement District to be known and designated as Special Improvement District No. 486 of the City of Bozeman for the purpose of constructing and installing an eight (8) inch sanitary sewer lateral and a six (6) inch cast iron watermain on Kagy Boulevard betweeu the centerline of Greek Way and a point 982.47 feet westerly thereof, said construction and installation of said sanitary sewer and watermain to include trench excavation and backfill, installation of vitrified tile sewer and cast iron pipe, necessary wyes and tees, service stubs, pipe bedding material, necessary man- holes and fire hydrants and other appurtenant work thereto. Section 2 Boundaries. The boundaries of said Special Improvement District No. 486 are decribed as follows: Beginning at a point which lies South 89014.4' West and 339 fept distant from the East one-sixteenth corner of Section 13, Township 2 South, Range 5 East of the Montana Meridian, thence at right angles to the right a distance of 45 feet to the true point of beginning, being the southwesterly corner of Lot 6 of the Greek Way Subdivision of Bozeman, Montana; thence North along the westerly line of said lot 6 a distance of 55.1 feet; thence continuing northerly along the I westerly line of said lot 6 being on a curve of 260 feet in radius a distance of 78.8 feet; thence North 19034.6' West along the west- erly line of lot 6 and lot 8 of said Greek Way Subdivision a distance of 133.4 feet; thence southwesterly across Greekway to the north- easterly corner of lot 5 of said Greek Way Subdivision; thence South 70025.4' West along the northerly lot line of said lot 5 a distance of 237.3 feet to the northwesterly corner of said lot 5; thence north- westerly along the westerly line of lot 4 of Greeek Way Subdivision and said lot line extended a distance of 332.6 feet; thence South 89032' West across the Chicago, Milwaukee, St. Paul and Pacific Rail- way Company easement and along the northerly line of the E.R.F. Research Park Building Site a distance of 505.26 feet; thence South along the westerly line of South Seventh Avenue extended southerly a distance of 565.42 feet; thence North 89014.6' East parallel to and 45 feet COMMISSION RESOLUTION No. 1362 ------.-..,... Used minute book :tft:l sheets in error. 437 distant southerly from the one-sixteenth line being the southerly line of the NE\SE\ of said Section 13, a distance of 930.97 feet; then thence at right angles to the left a distance of 90 feet to the true point of beginning. Containing within the above described exterior boundaries the following lots, tracts and parcels of land, to-wi t: I Lot 5, Greek Way Subdivision (No Assessment area) C.M. St. P. and P. Railway right of way easement (No assessment area) E.R.F. Research Park Building Site - Assessed Area 5.5195 Acres Section 3 Character of Improvements Construction and installation of an eight (8) inch sanitary sewer lateral and a six (6) inch cast iron watermain on Kagy Boulevard, between the centerline of Greek Way and 982.47 feet westerly thereof, including trench excavation and backfill, installation of vitrified tile sewer and cast iron pipe, necessary wyes and trees, service stubs, pipe bedding material, necessary manholes and fire hydrants and other appurtenant work thereto. Section 4 Estimate of Cost The estimated costs of the improvements within the district including engineering, legal and contingency is $22,000.00. Section 5 Method of Assessment I The cost of such improvement is to be assessed against the entire district, each lot, tract or parcel of land within such district will be assessed for that part of the whole cost, which its area bears to the area of the entire district exclusive of streets, avenues, alleys and public places. The total actual assessable area within such district is 5.5195 acres which is the area figure on which all protests will be received, considered and determined. Section 5 Payments. That payment for said improvements shall be made in twenty annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said special Improvement District No. 486, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 486 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for that I purpose in said Special Improvement District No. 486. Said bonds will draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) per annum, which interest shall be chargeable as a part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to Special Improvement Districts in cities and towns, and any amendments thereof or thereto. Sec tion 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 3rd day of April, 1968, at the hour of one o'clock p.m. of said day, is the time and place, when and where the I City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 486, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof, and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. NOTICE IS HEREBY GIVEN that on the 13th day of March, 1968, at a regular session of the Commission of the City of Bozeman, Commission Resolution No. 1362 entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 486 FOR THE PURPOSE OF CONSTRUCTION AND INSTALL~ ATION OF AN EIGHT (8) INCH SANITARY SEWER LATERAL AND A SIX (6) INCH CAST IRON WATERMAIN ON KAGY BOULEVARD, BETWEEN THE CENTERLINE OF GREEK WAY AND A POINT NINE HUNDRED EIGHTY TWO AND FORTY.:.SEVEN HUNDREDTHS (982.47) FEET WESTERLY THEREOF. That Wednesday, the 3rd day of April, 1968, at one-o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1362 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. I For a description of the boundaries of said Special Improvement District No. 486, reference is hereby made to Resolution No. 1362 of the Commission of the City of Bozeman declaring the intention to create said district, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for in- spection to all interested parties and the public generally. This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana, 1947.
