SUBJECT: Approve request for Cash in Lieu of Parkland Dedication for the Peach &
Black Residences Site Plan and Certificate of Appropriates with Variance
from minimum lot size requirement, File Z13254.

RECOMMENDATION: The City Commission approves the request for cash donation in-lieu
of land dedication for the Peach & Black Residences. Application No. Z13254.
SUGGESTED MOTION: Should the Commission remove this from the consent agenda we
recommend the following motion: “Having considered information provided by staff, considered
public comment, and considered all of the information presented, I hereby adopt the findings
included in the staff memorandum for application Z13254 and accept the provision of $2,090.88
cash in lieu as meeting the required parkland dedication.
BACKGROUND: The property owner, Mr. Jason Delmue, 2 East Peach Street, Bozeman MT
59715, represented by Intrinsic Architecture, Inc, 111 North Tracy Avenue, Bozeman, MT
59715, made application for modification to the existing home at 519 North Black and the
construction of two additional residential structures with accessory buildings and related site
improvements. The subject property is located at 519 North Black Avenue, southwest of the intersection of North Black Avenue and East Peach Street. The site is zoned R-3 (Residential
Medium Density) and is located within the Conservation Overlay District.
On December 16, 2013 the Commission conditionally approved the variance request and Site
Plan with Certificate of Appropriateness, unanimously. Code Provision “m” cited Section
38.27.020, BMC, for parkland and open space requirements. This code provision stated the site plan application does require a contribution of park area (parkland) by any combination of land
dedication, cash donation in-lieu of land dedication, or an alternative authorized by Section
38.27.100. This provision must be reviewed and approved and must be approved prior to final
plan approval. Cash-in-lieu of land dedication is the preferred alternative to meet this
requirement. Use of cash-in-lieu requires further review and approval by the City Commission.
The two (2) additional single household dwellings require parkland dedication, cash in-lieu of
parkland dedication, or a combination of cash in-lieu and park land dedication. It is the
expressed preference of the developer to provide cash in-lieu of parkland dedication. Pursuant to
Section 38.27.030.C, BMC, the Applicant provided the necessary appraisal documentation to

establish the fair market value for the equivalent land dedication. Required parkland dedication
is equal to 2,613.6 square feet.
North Grand Field, Beall Park, Westlake Park, and the Gallatin County Fairgrounds are in close
proximity to the subject property.
UNRESOLVED ISSUE(S): None at this time.
ALTERNATIVES: As suggested by the Commission.
FISCAL EFFECTS: Per the attached appraisal, the anticipated payment for cash in lieu of parkland dedication for two (2) additional single household dwellings at 0.03 acres per dwelling
requires 0.06 acres total. Therefore, the cash in-lieu for this project is $2,090.88.
