COMMISSION RESOLUTION NO. L359
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES
OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND
CONTIGUOUS TO THE SAm CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED,
WITHIN THE CORPORATE LIMITS THEREOF.

WHEREAS , there has been presented to the City Commission of the City of Bozeman a written and I
verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman
so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman; and
WHEREAS, the proper legal description of said contiguous tracts is as follows:
Several tracts of land located in the SE% of Section 11, Township 2 South,
Range 5 East, known as the Mountain Vista Suburb; an upp1atted tract known
as Tract W on Assessor's Plat, SE%SE% Section 11, Township 2 South, Range
5 East; Lots 8 and 9 of Block 3, Kirk Sub-Division and Lots I, 2 and 3 of
Block 4 of Kink Subdivision, the exterior boundaries of which are more
fully described as follows, to-wit:
Beginning at the southeast corner of Section 11, Township 2 South, Range 5
East, M.P.M.; thence northerly along the easterly line of said Section 11,
a distance of 928.8 feet to a point of intersection with the northerly line
of lots 8 and 9 of Block 3, Kirk Subdivision extending easterly; thence west-
erly along said northerly line of said lots 8 and 9 of said Block 3 and said
line extended a distance of 435 feet to the westerly line of South 20th Avenue
as platted in Kirk Subdivision; thence southerly along the westerly line of
said South 20th Avenue a distance of 557 feet to the northerly line of the
Mountain Vista Suburb; thence westerly along the northerly line of said
Mountain Vista Suburb a distance of 885 feet to the westerly line of the south-
east one-quarter of the southeast one-quarter (SE%SE%) of said Section 11;
thence South P06'42" East along the westerly line of said Mountain Vista
Suburb a distance of 371.8 feet to the southerly line oc said Section 11;
thence North 88051'11" East along the southerly section line of said Section
11, a distance of 1320 feet to the southeast corner of Section II, being
the true point of beginning.
Containing within the above described exterior boundaries the following lots, I
streets, tracts and parcels of land, to-wit:
All of lots 8 and 9 of Block 3 Kirk Subdivision; all of lots 1, 2 and 3 of
Block 4 Kirk Subdivision; West Dickekson Street as platted in Kirk Subdivision;
all of Assessors Trac t ''W'' of SE%SE%, Section 11, as described in Page 553,
Book of Deeds number 97 in the office of the Gallatin County Clerk and Recorder;
Tract 1B of Mountain Vista Suburb, dedicated for road purposes in Kirk Sub-
division; that portion of South 20th Avenue described as the westerly 60 feet
of the easterly 75 feet of Tract 3, Mountain Vista Suburb and dedicated for
road purpose in plat of Kirt Subdivision; that portion of South 20th Avenue
as platted in Kirk Subdivision and lying northerly of and between the Mountain
Vista Suburb and the northerly 'line of lots 8 and 9 of Block 3, Kirk Subdivision
extended westerly; Tracts 1 and 2, the East 15 feet of Tract 3, the westerly
137.5 feet of Tract 3, Tracts 4, 5, 6, 7 and 8 of Mountain Vista Suburb; the
westerly 60 feet of Mountain Vista Suburb dedicated for road purposes; all the
25 foot wide right of way of the Farmers Canal lying within the above described
exterior boundaries; Tracts lC, lA, 2A, 3A, 4A, 5A, 6A, 7A and SA of mountain
Vista Suburb, now being used as right of way of former U. S. 191, commonly
called Huffine Lane and College Street.
WHEREAS, the City Commission of the said City of Bozeman has, by its Resolution No. 1355,
regularly passed and adopted on the 27th day of December, 1967, declared it to be for the best
interests of the said City of Bozeman and the inhabitants thereof and of the inhabitants of the
contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be ex-
tended so as to include said contiguous tracts; and
WHEREAS, the Clerk of the City Commission has, pursuant to the provisions of Section 11-403, I
Revised Codes of Montana, 1947, given the required notice to property owners and caused to be
published the required public notice of such proposed extension of the boundaries of said City of
Bozeman; and

WHEREAS, twenty (20) days have expired since the date of the first publication of said notice;

WHEREAS, less than a majority of the resident freeholders of the territory to be embraced
have filed with the City Clerk written expressions of disapproval, to-wit 22.0%

protests, each signed by Two resident freeholders of said territory
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
I Section 1. That pursuant to the authority vested in the City Commission of the City of Bozeman
by Section 11-403, Revised Codes of MOntana, 1947, it is hereby declared that the boundaries of the
said City of Bozeman shall be extended so as to embrace and include within the boundaries and
corporate limits of the said City of Bozeman the tracts contiguous thereto and hereinbefore
described.
Section 2. That this Resolution shall be, and the same is hereby decUared to be effective
thirty days after its adoption and approval.
PASSED AND ADOPTED by the Commission of the City of Bozeman at a regular session held on the
24th day of January, 1968.

hereby certify that the foregoing Resolution No. 1359 was published by
title and number in the Bozeman Daily Chronicl~a newspaper of general
circulation, printed and published in said City in the issue of February
the 6th, 1968, and due proof of such publication is on file in my office.
