COMMISSION RESOLUTIN NO. 1358
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES
OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTAIN TRACT OF
LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTIOULARLY DE-
SCRIBED, WITHIN THE CORPORATE LIMITS THEREOF.

WHEREAS , there has been presented to the City Commission of the City of Bozeman a written I
and verbal request petitioning the said City Commxssion to extend the boundaries of the City of
Bozeman so as. to include certain contiguous tracts of land within the boundaries of the City of
Bozeman; and
WHEREAS , the proper legal description of said contiguous tracts is as follows:
A portion of the "Homesites", a suburb of Bozeman, Montana, as recorded on
page 11 of Book E of Plats, Office of Gallatin County Clerk and Recorder,
comprises specifically of Tracts numbered 5A, 5B, 5C, 6, 7, 8A, 8B, 8C, and
10 and more particularly described as follows, to-wit:
Beginning at a point which lies East 761 Feet and North 2003' West 30 feet
from the Southwest corner of Section 1, Township 2 South, Range 5 East,
M.P.M., said point being the southwesterly corner of Tract SA of said
"Homesites"; thence northerly along the easterly line of North Seventeenth
(17th) Avenue, being along the westerly lines of Tracts 5A, 8A, 8B, 8C
and 10 a distance of 734.8 feet to the northwesterly corner of said Tract 10;
thence N 87058' E along the northerly line of said Tract 10, being also
along the southerly line of Tract 12 of said "Homesites," a distance of
570.2 feet to the northeasterly corner of said Tract 10; thence S 2003' E
along the easterly line of said ''Homesi tes" a distance of 764.8 feet to
southeasterly corner of Tract 7 of said ''Homesites'' being a point of
intersection with the northerly right of way line of Durston Road; thence
West along the southerly line of said ''Homesites'', being along the north-
erly right of way line of Durston Road a distance of 571 feet to the south-
west corner of said Tract A of said "Homesites" being the true point of
beginnings.

Including within the above described exterior boundaries the following
Tracts of land. to-wit: Tract 5A, Tract 5B, Tract 5C, Tract 6, Tract 7,
Tract 8A, Tract 8B, Tract 8C and Tract 10 of "Homesites" suburb of
Bozeman, Montana as platted and recorded in the Office of the Clerk and
Recorder, Gallatin County, MOntana.
The total area of Tracts included within the Boundaries of the Homesites
Annexation is 9.82 acres.
WHEREAS, the City Commission of the said City of Bozeman has by its Resolution No. 1354,
regularly passed and adopted on the 27th day of December, 1967, declared it to be for the best
interests of the said City of Bozeman and the inhabitants thereof and of the inhabitants of the
contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be ex-
tended so as to include said contiguous tracts; and
WHEREAS, the Clerk of the City Commission has. pursuant to the provisions of Section 11-403,
Revised Codes of Montana, 1947, given the required notice to property owners and caused to be
published the required public notice of such proposed extension of the boundaries of said City of
Bozeman; and
WHEREAS , twenty (20) days have expired since the date of the first publication of said notice; and
WHEREAS, less than a majority of the resident freeholders of the territory to be embraced have I
filed with the City Clerk written expressions of disapproval, to-wit NONE written protests, each
signed by NO resident freeholderss of said territory.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1. That pursuant to the authority vested in the City Commission of the City of Bozeman
by Section 11-403, Revised Codes of Montana, 1947, it is hereby declared that the boundaries of the
said City of Bozeman shall be extended so as to embrace and include within the boundaries and corp-
orate limits of the said City of Bozeman the tracts contiguous thereto and hereinbefore described.

Section 2. That this Resolution shall be, and the same is hereby declared to be effective
Thirty days after its adoption and approval.
PASSED AND ADOPTED by the Commission of the City of Bozeman at a regular session held on the
24th day of January, 1968.

I, Erna V. Harding, Clerk of the Commission of the City of Bozeman, do
hereby certify that the foregoing Resolution No. 1358 was published by
title and number in the Bozeman Daily Chronicle, a newspaper of general
circulation, printed and published in said City in the issue of February
6th, 1968, and due proof of such publication is on file in my office.
