A RESOLUTION OF THE COMMISSION OF THE CITY OF J30ZEHAN, MONTANA, DECLARING
IT TO BE TIlE INTENTION OF SAID COMMISSION TO VACATE A PORTION OF NORTIf
HILLSON AVENUE 13E'IWEEN ~-JEST LAMME AND HEST BEALL STREET OF THE CITY Of
BOZEHAN, STATE OF MONTANA.

WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman,
Montana, A petition by the Bozeman Deaconess Foundation, the owner of all properties
abutting on I
North Hillson Avenue bet'veen l<Jest Lamme and West Beall Streets, requesting that a portion of
said
North Willson Avenue be vacated; and,
WHEREAS, the Bozeman Deaconess Foundation has agreed
to convey to the City of Bozeman a tract
of land for street purposes consisting of the easterly ten (10)
feet of Lots I, Ilf and
lA, being
ten (10) feet lying on the westerly side of North Willson Avenue as the
same is nm.,-, laid out; and,
WHEREAS, it appear.!'; to the City Commission to be in the best
interest of thE" City of Bozeman and the

NOH, THEREFORE, BE IT RESOLVED BY THE COMMISSION
Of THE CITY Of BOZEMAN:
Section 1
Declaration of Intention
It is hereby declared to he the intention of the Commission of the City of Bozeman to vacate
the easterly D~O (2) feet of that portion of North ';\lil150n Avenue between Hest Lamme
and Hest
Beall Streets lying westerly of and adjacent to Lots 12, 13 and IS of Block A, Tracy's 3rd Addition
to Bozeman, Montana, more particularly described as follm.;rs, to-wit:
Beginning at the south,~ester1y corner of Block A, Tracy's 3rd Addition to

Bozeman, Montana; thence westerly along the southerly line of said
block A

thence northerly parallel to

a distance of one hundred ninety-six and fifteen hundredths

Notice
That The City Manager of the City of Bozeman is hereby directed to cause notice of the adoption
of this resolution of intention to be served in the same manner that service of Summons is required
on all persons whose property abuts upon that pOTtlon of North Hillson Avenue lying bet"7cen West
Lamme and T.Jest Beall Streets in Block A of Tracy's 3rd Addition to the City of Bozeman, Montana,
which will be affected by the proposer1 vacation and by publication once in a daily newspaper in
general circulation in the City of Bozeman, Montana.
Section 3
Time for Objections.
That the regular session of the City Commission of the City of Bozeman, Montana,
to be held I
at the Commission Chamber in the City Hall Building, Bozeman, Montana, on Wednesday the 7th day of
february, 1968, at the hour of one o'clock p.m. of said day,
is the time and place when and where
the City Commission will hear and pass upon all objections to the vacating of said street.
ADOPTED BY THE Commission of the City of Bozeman at a regu~r session thereof held on the
10th day of January, 1968. ~ ~~

AVENUE RE~vEEN WEST LAMME AND WEST BEALL STREETS OF TIlE CITY OF BOZEMAN,
STATE OF MONTANA.
NOTICE IS HEREBY GIVEN that on the 10th day of January, 1968, at the regular meeting of the
I City Commission of the City of Bozetpan, Montana, the said Commission duly and regularly passed
and adopted Commission Resolu tion No. 1357, entitled:
A RESOLUTION OF THE COMMISSION OF TIlE CITY OF BOZEMAN, MONTANA, DECLARING
IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A PORTION OF NORTH
'vILLSON AVENUE TIETHEEN WEST LAMME AND WEST BEALL STREET OF THE CITY OF
BOZEMAN, STATE OF MONTANA.
NOTICE IS HEREBY FURTHER GIVEN that Wednesday, the 7th day of February, 1968, at one o'clock
p.m. at the Commission Room in the City Hall Building, Bozeman, Montana, is designated as the
time and place to hear objections to the vacating of the portion of North Willson Avenue between
\vest Lamme and West Beall Streets, of the City of Bozeman, Montana, and is the time and place any
person whose property ahuts upon portions of the street proposed to be vacated may appear and
object to the proposed vacation.
This notice is given pursuant to Section 11-3310, Revised Codes of Montana, 1947.

published at length in the Bozeman Daily Chronicle, a newspaper of genera]
circulation printed and published in said City in the issue of the 15th day
of January, 1968, and due proof of such publication is on file in my office.
