COMMISSION RESOLUTION NO. 4482
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH LA'YNE INLINER, LLC., KIOWA, COLORADO..
WHEREAS,the City!Commission did,on the 10`a'day of June 2013,authorize award of the bid for
the City of Bozeman 2013. Sewer Rehabilitation project, to Layne lnliner, LLC., Kiowa, Colorado; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation,and Layne lnliner,LLC., as contained in Change Order No. 1,attached hereto,be and
the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract
change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such
signature.

You are directed to make the following changes in the Contract Documents:
Description: This change order reduces contract time from 125 to 121 calendar days. The Work will be
substantially completed within 121 calendar days after the date when contract time commenced, July 30, 2013, as
stated in the Notice to Proceed, and final completion shall be achieved within 30 days of the date of substantial
completion. The new substantial completion date is November 28, 2013. The new final completion date is
December 28, 2013. Contractor is allowed to work 4 Saturdays (four 48-hour work weeks), as per the attached
schedule, submitted duly 31,2013.
Additionally, this change order increases the contract amount as a result of an unknown storm drain that was in
conflict with the new manhole location at the intersection of 5"'and Main, installation of bell restraints and a
corpo cap provided by the City on an existing water main, and the loss of 28 feet of impregnated liner that
resulted when Contractor changed his intended plan to line Mendenhall and instead moved to 3rd Ave to allow the
City to complete a spot repair in Mendenhall.
Reason for Change Order: To allow Saturday work without incurring additional inspection/engineering time
and fees„to cover costs associated with a conflicting storm drain;to cover costs associated with restraining an
existing water main at the request of the City; and, to cover costs associated with the loss of 28 feet of liner.

CHANGE ORDER
INSTRUCTIONS
A. GENERAL INFORMATION
This document was developed to provide a uniform format for handling contract changes that affect Contract
Price or Contract Times. Changes that have been initiated by a Work Change Directive must be incorporated into
a subsequent Change Order if they affect Price or Times..
Changes that affect Contract Price or Contract Times should be promptly covered by a Change Order. The
practice of accumulating Change Orders to reduce the administrative burden may lead to unnecessary disputes.
If Milestones have been listed in the Agreement, any effect of a Change Order thereon should be addressed.
For supplemental instructions and minor changes not involving a change in the Contract Price or Contract Times,
a Field Order should be used.
D. COMPLETING THE CHANGE ORDER FORM
Engineer normally initiates the form, including a description of the changes involved and attachments based upon
documents and proposals submitted by Contractor, or requests from Owner, or both.
Once Engineer has completed and signed the form, all copies should be sent to Owner or Contractor for approval,
depending on whether the Change Order is a true order to the Contractor or the formalization of a negotiated
agreement for a previously performed change. After approval by one contracting party, all copies should be sent
to the other party for approval. Engineer should make distribution of executed copies after approval by both
parties.
If a change only applies to price or to times,cross out the part of the tabulation that does not apply.
