HomeMy WebLinkAboutResolution 1355 Extend the Boundaries 419 COMMISSION RESOLUTION NO. 1355 A RESOLUTION OF TIlE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE 13EST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF SEVERAL TRACTS OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS ~HTH- IN THE CORPORATE LIMITS THEREOF. I ----- tVHEREAS , there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman ~o as to include certain contiguous tracts of land within the boundaries of the City of Bozeman and having presented to the City of Bozeman proposed plats and certificate of survey of said land; and WHEREAS, the proper legal description of said contiguous tracts located in the County of Gallatin State of Montana, is as follows: Several tracts of land located in the SE~ of Section 11 Township 2 South, Range 5 East known as the Mountain Vista Suburb; an unplatted tract known as Tract W on Assessor's Plat SE~SE~ Section II, Township 2 South, Range 5 Eas t; lots 8 and q of Block 3, Kirk Sub-Division and ~ots 1, and 2 and 3 of Block 4 of Kirk Suboivision, the exterior boundaries of which are more fully described as follows, to-wi t: Reginning a t the southeast corner of Section 11, TO'o1nship 2 South, Range 5 East, M. P.M.; thence northerly along the easterly line of said Section 11, a distance of 928.8 feet to a point of intersection with the northerly line of lots 8 and 9 of Block 3, Kirk Subdivision extended easterly; thence 'o1esterly along said northerly line of said lots 8 and 9 of said Block 3 and eaid line extended a distance of 435 feet to the westerly line of South 20th Avenue as platted in Kirk Subdivision; thence southerly along the westerly line of aaid South 20th Avenue a distance of 557 feet to the northerly line of the Mountain Vista Suburb; thence westerly along the northerly line of said Mountain Vista Suburb a distance of 885 feet to I the westerly line of the southeast one-quarter of the southeast one-quarter (SE},sE ~J of said Section 11; thence South 1006'42" east along the 'o1esterly line of said Mountain Vista Suburb a distance of 371.8 feet to the south- erly line of said Section 11; thence North 88051'11" East along the southerly section line of said Section 11. a distance of 1320 feet to the southeast corner of Section 11, being the true point of beginning. Containing within the above described exterior boundaries the follmo1ing 10 ts , streets, tracts and parcels of lan~ to-wit: All of lots 8 and 9 of Block 3 Kirk Subdivision; all of lots I, 2 and 3 of Block 4 Kirk Subdivision; West Dickerson Street as platted in Kirk Subdivision; all of Assessors Tract "w" of SE~SE~, Section II, as described in Page 553, Book of Deeds number 97 in the office of the Gallatin County Clerk and Recorder; Tract IB of Mountain Vista Suburb, dedicated for road purposes in Kirk Subdivision; that portion of South 20th Avenue described as the westerly 60 feet of the easterly 75 feet of Tract 3, Mountain Vi~ta Suburb and dedicated for road purpose in plat of Kirk Subdivision; that portion of South 20th Avenue as platted in Kirk Subdivision and lying northerly of and between the Mountain Vista Suburb and the northerly line of lots 8 and q of Block 3, Kirk Subrlivision extended westerly; tracts I and 2, the East 15 feet of Tract 3, the westerly 137.5 feet of Tract 3, Trae ts t" 5 , 6, 7 and 8 of Mountain Vista Suburb; the westerly 60 feet of Mountain Vista Suburb dedicated for road purposes; all the 25 foot wide right of way of the Farmers Canal lying within the above described exter- ior boundaries; Tracts IC, lA, 2A, 3A, 4A, 5A, 6A, 7A and 8A of Mountain Vista Suburb, now being used as right of way of former U. S. 191, commonly called Huffine Lane and College Street. WHEREAS, it will be for the best interest of the city of Bozeman and the inhabitants thereof I and of the inhabitants of the contiguous tracts hereinbefore described to ex tend the boundaries of the City of Bozeman so as to include the said contiguous tracts hereinbefore described within the corporate limits of the said City of Bozeman. NOH, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: See tion 1. That pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1%7, it is hereby declared to be to the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundarieA of the said City of Bozeman be extended so as to include the contiguous tracts hereinbefore described within Commission Resolution No. 1355 420 the boundaries and corporate limits of the City of Bozeman. Montana. PASSED AND ADOPTED by the Commission of the City of Bozeman. Montana. at a regular session held on the 27th day of December. 1967. Mayor ., -<p' Clerk 0 I -0-0-0-0- NOTICE IN RE COMMISSION RESOLUTION NO. 1355 OF THE CITY OF BOZEMAN STATING THE INTENTION OF THE CITY COMMISSION TO EXTEND THE BOUNDARIES OF SAID CITY OF BOZEMAN TO EMBRACE AND INCLUDE SEVERAL TRACTS OF LAND ADJOINING SAID CITY. NOTICE IS HEREBY GIVEN that on the 27th day of December, 1967, at a regular meeting of the City Commission of the City of Bozeman. the said Commission duly and regularly passed and adopted Commission Res olution No. 1355 entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF SEVERAL TRACTS OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS WITH- IN THE CORPORATE LIMITS THEREOF. NOTICE IS HEREBY FURTHER GIVEN THAT Wednesday. the 24th day of January, 1968, at one o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana is designated as the time and place for hearing objections to the action proposed to be taken in said Resolution No. 1355, whereby it j- is proposed to embrace the hereinafter described contigent territory within the corporate limits of I the City of Bozeman, Montana. Expressions of approval or disapproval by resident freeholders of the territory proposed to be embraced must he made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later then twenty (20) days after the date of the first pub- lication of this notice.
