HomeMy WebLinkAboutResolution 1375 Garbage Collection . 474 COMMISSION RESOLUTION NO. 1375 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZElv'!AN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH CARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1968, TO DEFRAY THE COST AND EXPENSE OF COLLECTING A~ID DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN MUNICIPAL CODE. WHEREAS, The City Commission of the City of Bozeman did on the 3th day of January, 1940, duly and I regularly pass Ordinance No. 696, entitled; AN ORDINANCE DEFINING GARBAGE FOR THE PURPOSE OF THIS ORDINANCE, PROVIDING FOR THE COLLECTION AND DISPOSITION THEREOF BY AND UNDER THE SUPERVISION AND CONTROL OF THE DEPARTMENT OF PUBLIC WELFARE AND FOR DEFRAYING THE COST OF SUCH COLLECTION AND DISPOSITION BY SPECIAL ASSESSMENT AGAINST THE PROPERTY TO WHICH SUCH SERVICE IS RENDERED, AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE. which Ordinance No. 696, passed as aforesa,id is hereby referred to and made a part of this Resolution for further particula.rs in respect to the basis and method of assessing the cost against the property herein assessed, and WHEREAS, said expense incurred by said City in the collection and disposition of garbage in accordance with said Ordinance is hereby estimated by the Commission of The City of Bozem~_n to be the sum of Seventy-Six Thousand Four Hnndred Three & 32/100ths ($76,403.32) dollars for the year 1968, over and above all moneys collected f!['Offi business and professional concerns, or combined residences and business or residences and professional business concerns in accordance with said Ordinance No. 696, and the Bozeman ~lUnicipa,l Code, and WHEREAS, in order to raise se-id sum to defre.y the said cost, it is necesB8ry to establish the basic unit rate, as defined in said Bozeman Municipal Code at twenty ($20.00) dollars. NOW, THEREFORE, pursuant to the provisions of said Ordinance No. 696, and the Bozeman Municipal I Code and the Laws of the State of Montana, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1: ThRt to defray the estimated cost and expense of collecting And disposing of garbage in the City of Bozeman for the yea,r 1968. there is hereby levied and assessed a,gainst the property and the several lots, pieces and parcels of land thereof within the City of Bozeman as set forth in Schedule "A", which is 8ttached hereto and made a part hereof, a. tax; that a particular description of each lot and parcel of land with the name of the owner and/or owners and the sum assessed against the same is set forth in the assessment list in said Schedule "A"; that the severa.l sums set opposite the n8mes of said owners and the descrived lol:.s and parcels of land, be, and the same are hereby levied and assessed upon and a.gainst said lots and pt'lrcels of It'lnd for said purpose; that the several sums be collected from the respective owners of said lots and parcels of land described in said asses- sment list and owned by them; that the said sums shall be paid and the collection thereof be made in the manner and in accordance with Ordinance No. 696 of the City of Bozeman, Montana, and the laws of the State of Montana governing the collection of Special Improvement Taxes; that failure to pay such assessment when the sarne shall become due and payable shall make such persons and such lots and I parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2: That the regular session of the Commission of the City of Bozema,n, Montana, to be held in the Commission Chamber in the City Hall of said City on the 7th day of August, 1968, at 1:00 O'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Commission. Secti~:m 3: That the Clerk of the Commission of the City of Bozeman, be, and she is hereby ordered COMMISSION RESOLUTION NO. 1375 . 4?5 and directed to publish in the Bozemp~ Daily Chronicle, a daily newspaper printed and published in said City of Bozeman, a notice signed by the Clerk of the Commission, stating that a Resolution levying and assessing a special assessment of taxes to defr~y the cost and expense of the collection and disposition of garbage in the City of Bozeman for the year 1968, against the property to which such service was rendered, is on file in the office of the Clerk of the Commission subject to inspection I for a period of five days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final a,doption of this Resolution, and, that said Notice shall be published at least five (5) days before the date set by the Commission for he.!1.ring of objections and the final adoption of this Resolution. I ATIEST: tiQ.:r.lQ.~ HEARING, FINAL AOOPl'ION COMMISSION RESOLUTION NO. 1375 LEVYING A SPECIAL ASSESSMENT TO DEFRAY THE COST OF THE COLLECTION AND DISPOSITION OF GARBAGE FOR THE YEAR 1968 AGAINST ALL PROPERTY IN THE CITY OF BOZEMAN TO WHICH SUCH SERVICE WAS RENDERED. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of The City of Bozeman held on the 31st day of July, 1968, Commission Resolution No. 1375 was provisionally passed and adopted; that said Resolution levies and assesses a special assessment of taxes to defray the cost of collection I'md disposition of Garbage in the City of Bozeman, for the year 1968, upon all property to which such service was rendered. That said Commission Resolution No. 1375 is now on file in the office of the Clerk of the Commission of The City of Bozeman, subject to inspection of all persons interested, for a period of five days; that Wednesday, the 7th day of August 1968, at 1:00 o'clock p.m. of said day at a regular session of the Commission of the City of Bozeman, in the Commission Room, in the City Hall Building, has been designated as the time and pl~ce when and where said Commission will hear and pciSS I upon cny and all objections that may be made to the final passage and adoption of said Commission Resolution No. 1375 And the levying of said assessment; Ilnd that s8.id Resolution will be finally . pa.ssed and adopted at said regular session of said Commission, subject to such corrections and ~mendments that may be made upon objections made and filed with the Clerk of the Commission within the five days limit as provided by law.
