SUBJECT: Adopt amendment to the FY 2015 Transportation Impact Fee Capital Improvement Program (CIP) to add the widening of Cottonwood Road from Fallon Street to
Alpha Drive and to move improvements to Baxter Lane (Project SIF02) to be a scheduled item in
FY 2015.

RECOMMENDATION: Amend the Fiscal Year 2015 Transportation Impact Fee Capital
Improvement Program to add the widening of Cottonwood Road from Fallon Street to Alpha
Drive (0.4 miles) and to move improvements to Baxter Lane (Project SIF02) to be a scheduled
item in FY 2015.
RECOMMENDED MOTIONS: 1) Having heard and considered the evidence and public testimony, I find the addition of
the expansion of 0.4 miles of Cottonwood Road from Alpha Drive to Fallon Street is consistent
with the requirements of the impact fee program. Therefore, I move to add these system
improvements to the FY 2015 Transportation Capital Improvements Program list and provide for its funding in the estimated amount of $1,926,000.
2) Having heard and considered the evidence and public testimony, I find the movement
of improvements to Baxter Lane (Project SIF02) to be a scheduled project in the FY 2015
Transportation Capital Improvements Program list to be timely and appropriate and therefore move that it be changed from unscheduled to being scheduled in FY 2015 with the project description and funding amounts to remain as presently written.
UNRESOLVED ISSUES:
1) The final design of the project has not been completed and therefore detailed final cost information is not available. A preliminary cost estimate has been provided and is attached. 2) The Commission has not to date committed the additional local non-expansion share of
funding necessary to complete the project as a whole. At this point, it is suggested by Public
Works that the street reconstruction fund be used for this purpose.
ALTERNATIVES: 1. Amend the CIP as suggested.
2. Amend the CIP for a less extensive project on Cottonwood than is recommended.

3. Amend the CIP for Cottonwood with a fixed maximum amount of funding from City
controlled sources.
4. Do not amend the CIP.
BACKGROUND: This action item has two components. Both are to amend the Transportation impact fee CIP. The first is to add a new project and the second is to modify the timing of an existing project. The City has adopted transportation impact fees to help provide for additional
capacity in the arterial and collector streets to provide service to new development within the
community. The fees are spent to widen streets, install intersection control, and take related
actions to increase capacity. A full description of the impact fee program is given in Division 2.06.9, Impact Fees, in the Bozeman Municipal Code.
The City has established five criteria which must be satisfied before expending impact fees. See
2.06.1690, BMC. These are:
• Capacity expansion
• Not project related
• Timely request
• Capital Improvement Program listed
• Capital Improvement Program funded
Included in these criteria is that a project must be included on the City’s impact fee capital
improvement list and funded on that list. Listing and funding on the CIP indicates that a
particular project is a community priority. The amendment to the CIP will facilitate a future impact fee credit request by adjacent development to expand roadways. The projects would then be funded by a combination of public and private funds with each bearing its proportionate share.
Final cost share is determined at the conclusion of the project when all final costs have been
determined.
Project 1) Consider amendment to the FY 2015 Transportation Impact Fee Capital Improvement Program to add the widening of Cottonwood Road from Fallon Street to Alpha
Drive.
On August 12, 2013 the City Commission approved a conditional use permit for Town Pump to construct a fueling station and convenience store at the southeast corner of the intersection of Cottonwood Road and Huffine Lane. The conditions of approval included the two conditions
below.
8. Cottonwood Road shall be constructed to the full principal arterial standard of the current Bozeman Area Transportation Plan across the entire property frontage and be provided with street lighting meeting City of Bozeman design standards [ANSI/IESNA
RP-8-00]. A roadway taper shall be constructed in accordance with AASHTO standards
beginning at the south property line and connecting back to the existing roadway.
Cottonwood Road is a designated state secondary route (No. 345) under the control of the Montana Department of Transportation; thus, all improvements to the roadway, including access approaches, shall be reviewed and approved by MDT prior to construction. A
building permit shall not be issued until the roadway construction is substantially
completed unless the project is approved for concurrent construction under provisions of
Section 38.39.030.C Unified Development Code. The improved roadway shall be accepted by MDT and the City prior to issuance of final occupancy for the site.

9. The south leg of the intersection of Cottonwood Road and Huffine Lane shall be
improved to accommodate a full principal arterial standard roadway. All intersection
improvements and signalization upgrades shall be reviewed and approved by MDT prior
to construction. A building permit shall not be issued until the intersection improvements and signalization upgrades are substantially completed unless the project is approved for
concurrent construction under provisions of Section 38.39.030.C Unified Development
Code. The improved intersection and signalization upgrades shall be accepted by MDT
prior to issuance of final occupancy for the site.
As noted in the conditions of approval, the Montana Department of Transportation (MDT)
controls Huffine Lane and Cottonwood Road south of Huffine Lane. The applicants have been
pursuing design of the required expansion to Cottonwood Road adjacent to their property. MDT
has indicated that they require that the north and south approaches to Huffine Lane match. This
means that the northern section of Cottonwood Road/Huffine intersection will need to be constructed to the same configuration as the southern side adjacent to the Town Pump project.
Staff was not aware of this MDT requirement last fall when the annual CIP was being prepared.
Planning and Engineering staff have examined the existing configuration of Cottonwood Road,
the required improvements for Town Pump and the existing Transportation Impact Fee Capital Improvements Program. Staff is of the opinion that the best option under the current conditions is
to add the Cottonwood Road improvements to the CIP for FY 2015 and construct a larger project
of 0.4 miles. This meets the timing desired by Town Pump and will provide additional street
capacity in a rapidly growing area of town.
Funding for the project will be from four sources. Impact fees are expected to provide the
majority of the amount. There is an existing minimum roadway north and south of Huffine Lane.
The additional lane expansions, except for a small portion immediately adjacent to the Town
Pump site, will be impact fee eligible. Town Pump will be responsible for the curbs, gutter,
sidewalk, and some lane area adjacent to their project. The Staff propose that the City will use non-impact fee funds to provide for some non-capacity expanding work on the existing lanes
north of Huffine Lane and for the local share of some signal adjustments as part of the overall
project. At this time this memo was written the exact nature of that work had not been decided.
The share of non-impact fee funding needed will be affected by this. Some sidewalk installation
will be required by three other private parties located along the corridor who have not already installed sidewalks.
The expansion of Cottonwood Road north of Babcock Street is already on the CIP with design to
begin in Fiscal Year 2015 and construction to occur in Fiscal Year 2016. This is a separate
project, SIF36, and is not adjacent to the work in the proposed amendment.
The City’s major street system is established through the long range transportation planning
process. The map of the major street network is shown on Figure 9-2, Existing Major Street
Network and Future Right-Of-Way Corridor Needs. Cottonwood Avenue is shown as a principal
arterial. The functional classification of streets is described in more detail in Section 9.1 in the City’s transportation plan. Cottonwood Road is within the defined transportation system and is a
road which qualifies for impact fee funding.
Project 2) Move Project SIF02, Improvements to Baxter Lane, 19th to Cottonwood, to be
a scheduled item in FY 2015. This project is described in the CIP as “Reconstruct Baxter Lane from 19th Avenue to
Cottonwood to a Minor Arterial standard as shown in the Transportation Plan. Continued

development in the northwest quadrant of the city will be sustained by having this important
east-west arterial improved to a complete street standard.” The portion of this project between
Davis Lane and Ferguson Avenue has already been constructed as a project improvement for
Baxter Meadows subdivision.
Presently the project is placed in the unscheduled column. It is proposed to move the project to
FY 2015. It is not expected that the entire project may be undertaken at once. However, there are
two subdivision projects at either end which will be likely to be making improvements to
sections of Baxter Lane in the near term. Therefore, the near term commitment is expected to be considerably less than the full amount.
The installation of a traffic signal at Davis Lane and Baxter Lane is presently listed in FY 2015
as SIF42. There will be significant improvements to Baxter Lane needed as part of that project.
Moving this project will enable improvements to Baxter Lane in coordination with adjacent private development which is expected to be more cost effective.

Depending on which section of Baxter Lane is improved first there may be adjacent unannexed properties. The need to acquire additional right of way may influence which section can be
improved first. The City does budget funds in the CIP for right-of-way acquisition.
Impact Fee Advisory Committee) The committee considered these amendments at their meeting
on March 6, 2014. A quorum was not present. The four members present informally discussed the two proposed changes and concurred that they were consistent with the purpose and
requirements of the impact fee program. No vote was taken as a quorum was not present.
FISCAL EFFECTS: The request is for initial estimated funding of $1,926,000 from the
Transportation Impact Fee fund for Cottonwood and continues at $2,000,000 for Baxter Lane. There are sufficient monies currently within the impact fee fund to cover these commitments. No
other project will be delayed by this amendment.
Cottonwood Project - There would be a probable commitment of street and curb reconstruction
funds or other non-impact fee sources such as developer funded project improvements to pay for non-impact fee eligible portions of the project. Initial estimate for City non-impact fee share for
all purposes is expected to not exceed $125,000. It must be noted that this number may be
modified depending on the final design. The present street and curb reconstruction fund CIP has
$800,000 (SCR02) identified for annual street replacement projects but does not identify
individual locations. Funds expended on Cottonwood will require other projects to be delayed. However, as no specific streets have been identified to date for reconstruction the Commission
must determine if Cottonwood is their priority for work to be done.
Baxter Lane project – As shown on the attached CIP listing, an SID or other local share in the
amount of $1,350,000 is anticipated to be paired with the impact fees to complete the project. The SID has not been formed. Waivers of right to protest creation of an SID exist for most of the
properties along the corridor. There are some unannexed properties adjacent to the roadway.

required to ensure the configuration of Cottonwood Road on either side of Huffine

have jurisdiction over Huffine Lane and south Cottonwood Road. This project will
also include installation of bicycle lanes and completion of sidewalk connections on both sides of Cottonwood Road. This will complete the full build out of a
principal arterial in a rapidly developing area of the community and leverage
private development improvements.

CONSIDERED: This project is needed to enable a Commission approved site development to
proceed. The City could take no action which would prevent the private
development from being constructed.

ADVANTAGES OF
APPROVAL: Traffic on Cottonwood Road is rapidly increasing with four new subdivisions in
near proximity at different stages in the review and development process. As a
principal arterial, Cottonwood Road is one of the primary routes for travel within
Bozeman and becomes a state highway south of Huffine Lane. The proposed project will provide additional traffic capacity in a rapidly growing area and will
create a more functional roadway with a consistent cross section through its largest
intersection at Huffine Lane. The overall project will also coordinate
improvements in association with adjacent private development to complete key
links in the City's pedestrian and bicycle systems. This would also support the future development of project SIF36 which is scheduled for construction in FY
2016.

committed. Three adjacent developments which deferred installation of sidewalks
with prior development will be required to install those at the same time as the
widening project is completed.

Interpretation of MapThis map presents the Recommended Major Street Network. It shows how the street network should develop over time and is intended to be used as a planning tool. It will assist in theevaluation of long-term traffic needs when planning future developments. The route alignments shown are conceptual in nature.The actual alignments may vary based on development patterns, geographic features, and other issues unknown at this time. The community planners will strive to designthe roads to fit the character of the landscape and minimize impacts on natural features such as wetlands, mature trees, and riparian corridors.Most of these routes are not recommended for construction at this time. existing lanes of Cottonwood Road north of Huffine Lane. The exact extent of the maintenance component has not been decided. These
companion funds have not yet been committed. Three adjacent developments which deferred installation of sidewalks with prior development
will be required to install those at the same time as the widening project is completed.
