HomeMy WebLinkAboutResolution 1367 Creates a SID No. 488 452 COMMISSION RESOLUTION NO. 1367 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZ:EMAN DECLARING IT TO BE '!HE INTENTION OF THE CITYOF-BOZ:EMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 488 E'OR THE PURPOSE OF OON3TRWTING AND INSTALLING AN ASPHALTIC-CONCRETE PAVEMENT, INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO; ALSO CONSTRUCTING STORM DRAINAGE SYSTEM AND MANHOLES, CONSTRUCTION AND RECONSTRUCTION OF NECESSARY _ DRAINAGE INLETS AND APPURTENANCES 'IHERETO ON THAT PORTION OF I EAST BABCOCK STREET BETWEEN SOUTH CHURCH AVENUE AND SOUTH WALLACE A VENUE AND ON THAT PORTION OF SOUTH WALLACE AVENUE BETWEEN EAST BABCOCK STREET AND EAST MAIN STREET. WHEREAS, there has been filed with the Olerk of the City Commission of the City of Bozeman, Montana, a petition in due form of oertain owners of properties situated on the portion of East Baboook Street between South Churoh Avenue and South Wallaoe Avenue and on that portion of South Wallaoe Avenue between East Babcock Street and East Main Street, asking that a special improvement district be created for the purpose of constructing and installing an asphaltic-conorete pavement projeot to include intregal concrete curbs and gutters, storm drainage, and other work incidental thereto; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 8th day of May, 1968, the afore~ said petition was respectively considered and granted; I NOW, THEREF'ORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Seotion 1 Deolaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Speoial Improvement District No. 488 for the purpose of constructing and installing an asphalic- ooncrete pavement project on that portion of East Baboock Street between South Church Avenue and South Wallace Avenue and on that portion of South Wallace Avenue between East Babcock Street and East Main Street. Said pavement project to inolude construotion and installation of intregal conorete curbs and gutters, storm drainage, and other work incidental thereto. Section 2 Boundaries That the boundaries of said Special Improvement Distriot I No. 488 are described as follows: Beginning at the point of interseotion of the oenterlines of South Church Avenue and East Baboock Street; thence southerly along the centerline of South Churoh Avenue a distance of 90 feet, thence easterly, parallel to and 90 feet distant southerly -..-.., -.-..------.. ,.----- 453 from the centerline of East Ba.bcock Street a distance of 542 feet to a point, said point being 90 feet distant easterly from thecenterline of South Wallace Avenue; thence northerly parallel to and 90 feet distant easterly from the oenterline of South Wallace Avenue a distanoe of 446.50feet to the center- line of East Main Street; thenoe westerly along said centerline a distance of 180 feet; thence southerly parallel to and 90 feet distant westerly from the centerline of South Wallaoe Avenue a distanoe of I 266.50 feet to a point, said point being 90 feet distant northerly from the centerline of East Babcock Street; thence westerly parallel to and 90 feet distant northerly from the centerline of East Baboock Street a distance of 334 feet to the center- line of South Church Avenue; thence southerly along said centerline a distance of 90 reet to the point of beginning. Containing within above described exterior boundaries the following lots, blocks, tracts, and parcels of land, to.wit: East 4 feet of Lot 12; all of Lots 13, 14, 15 and 16; East 4 teet and South 60 feet of Lot 17; South 60 feet of Lots 18 through 28 of Block B, Rouse's Addition; all of Lots 1, 2~ 27, and 28; East. feet of Lots 3 and 26 of Block C, Rouse's Addition; North 60 feet of Lotl; all of Lots 15 and 16 o~ Block A, Rouse's Second Addition; North 60 teet of Lot 1; North 60 feet and West 28 feet of Lot 2, Blook B, Rouse's Second Addition; West 60 feet of vacated East Babcock Street lying between Block C~ Rouse's Addition and Block B~ Rouse's Second Addition. Section 3 Character of Improvements Construotion of an asphaltic-concrete pavement project I with integral concrete ourbs and gutters, including excava- tion and backfill and necessary appurtenances thereto; oonstruction and installation of a storm drainage system including necessary pipelines, manholes, constructed and reconstructed drainage inlets~ necessary exoavation and baok~ fill, and necessary appurtenances thereto, to be installed on that portion of East Babcock Street between South Church Ave- nue and South Wallace Avenue, and on South Wallace Avenue be- tween East Babcock Street and East Main Street. 3eotion .. Estimate of Cost The preliminary estimate of the cost of the improve- ments in 1his district including materials, construction, engineering, legal, administrative and contingency costs i8 $31,000.00. Section 5 I Method of Assessment The cost of such improvement is to be assessed against the entire eistrict, with each lot or parcel of land assessed for that portion of the whole cost which its frontage bears to the total frontage of the entire district exclusive of -. ,..- -.-- -..-- -- .-- - n__._ m.~_._ ------- 454 streets, avenues, alleys and public places. The total frontage in the district is 1379 linear feet. the estimated rate of assessment is $22.48005801 per linear foot of frontage. Section 6 Payments I That the payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 488, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Speoial Improvement District No. 488 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for I that purpose in said Speoial Improvement District No. 488. Said bonds will draw simple interest from the date of their registration until called for payment, at a rate not to ex- ceed six percent (6%) per annum, which interest shall be chargeable as a part of the coat of construction and install- ation of said improvements. The bonds will be issued and Bold in accordance with the provisions of Section 11-2232 and Section 11-1271 Revised Codes of Montana, 1947, and all other applicable provisi ons of Title 11 of the Revised aodes of Montana, 1947, relating to speoial improvement districts in cities and towns, and any amendments thereof or thereto. Seotion 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana on Wednesday the 5th day of I June, 1968 at the hour of one o'olock p.m., of said day, i8 the time and place, when and where the City Commission will hear and pasa upon all protests duly and regularly made and filed against the creation of said proposed Special Improve- -..-. - __...u_..._ _ --... 455 ment District No. 488, the improvements proposed to be made pursuant thereto and the extent and dp.racter thereof, or either thereof, and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the I time as by law required, of the adoption of this resolution of intention. That Wednesday, the 5th day of June, 1968, at one o'olock p.m., at the Commission Room of the City Hall, Bozeman, Montana is designated by Resolution No. 1367 as the I time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the Ci~ Commission within fifteen (15) days after date of the f1rst publication of this notice. The general charaoter of the improvements proposed to be made is the construction and installation of an asphaltic- concrete pavement, with integral concrete curbs and gutters, including excavation and backfill and necessary appurtenances thereto; construction and installation of a storm drainage system including necessary pipelines, manholes, constructed and reconstructed drainage inlets, necessary excavation and back- fill and necessary appurtenances thereto, to be installed on that portion of East Babcock Street between South Church and South Church Avenue and South Wallace Avenue, and on South I Wallace Avenue between East Babcock Street and East Main Street.
