HomeMy WebLinkAboutResolution 1366 Sewage Treatment Works 450 COMMISSION RESOLUTION NO. 1366 A RESOLUTION AUTHORIZING FILING APPLICATION FOR FEDERAL GRANT FOR SEWAGE TREATMENT WORKS UNDER 33 USC 466 et seq. AND AUTHORIZING A CITY OFFICIAL TO SIGN FOR THE CITY SAID APPLICATION AND OTHER DOCUMENTS PERTAINING THERETO. WHEREAS, the City of Bozeman, Montana, a municipal corporation, herein called the Applicant, after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain public works, generally described as sanitary I Sewer Improvements, including provision for improvements and additional capacity of existing dis- posal and treatment facilities, addition of secondary treatment, an outfall sewer to new plant site and installation of a major interceptor sewer to relieve the overload conditions of existing sewers within the City and providing capacity for anticipated growth and miscellaneous items nec- essary for the completion of the project, is desirable and in the public interest and being required by law to the end it is necessary that steps be taken immediately to carry out the construction of said public works without delay; and WHEREAS, under the term of 33 usc 466 et seq., the United States of America has authorized the making of grants to public bodies to aid in financing the cost of the construction of such public works; and WHEREAS, the Applicant has examined and duly considered such act and now considers it to be in the public interest, legally necessary and to its benefit, to file an application under said act and to authorize other action in connection therewith. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, the governing body of said applicant, as follows: 1. That the construction of said public works is essential to, legally necessary, and to the best interests of the Applicant and to the end that such public works be provided as promptly as I practicable, it is desirable that action to carry out the construction thereof be undertaken immediatelY,~ 2. Authorization is hereby given to the Applicant to file an application on its behalf (in form required by the Water Pollution Control Administration) for a grant to be made by the United States to the Applicant to aid in defraying the cost of the above described public works. 3. That if such grant is made, the applicant shall provide or make necessary arrangements to provide such funds, in addition to the grant as ~ay be required to defray the cost of said public works. 4. That R. Harry Morrow, Mayor, is hereby authorized to furnish such information and take such action as may be necessary to enable the Applicant to qualify for the grant, including execution of the application and such supporting documents thereto in compliance with the requirements of the Water pollution Control Administration. 5. That the officer designated in the preceding paragraph is hereby designated as the author- ized representative of the applicant for the purpose of furnishing to the United States as may be required such information, data, and documents pertaining to the application for a grant and other- wise to act as the authorized representative of the Applicant in connection with this application and any ensuing construction of this project. I 6. That certified copies of this resolution be included as part of the subject application to be submitted to the Water Pollution Control Administration for the subject construction grant.
