WHEREAS, The City Corrunission of The City of Bozeman, did on the 14th da.y of Ni1rch 1968, duly and regularly pass Commission Resolution No. 1363, entitled: A RESOLUTION OF THE CITY COMIGSSION OF THE CITY OF BOZENAN~ M~CA~, D~~h~~~M IT TO I BETHE INTENTION OJ.' THE CITY OF BOZEMAN, MONTANA TO CREATE S I 1M, T DISTRICT TO ~E KNOWN AS SPECIAL IMPROVEHENT DISTRICT NO. ,487 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT TOGETHER 'NITH INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND RECONSTRUCTION OF NECESS&~Y DRAINAGE FACILITIES INCLUDING STORM DRAINAGE PIPE, MANHOLES, INLETS AND OTHER NECESSARY APPURTENANCES THEP.ETO, ON SEVENTH (7TH) AVENUE SOUTH, GRANT STREET TO KAGY BOULEVARD AND ON THE NORTHERLY ONE-HALF OF KAGY BOULEVARD BETWEEN A POINT 200 FEET WESTERLY OF THE WEST LINE OF SOUTH SEVENTH (7TH) AVENUE AND A POINT 919 FEET EASTERLY OF SAID WESTERLY LINE. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 3rd day of April, 1968, duly PP5S Commission Resolution No. 1365, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROvlWENT DISTRICT NO. 487 OF THE CITY OF BOZEluUill FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC- CONCRETE TYPE PAVEMENT PROJECT TOGETHER WITH INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND RECONSTRUCTION OF NECESSARY DRAINAGE FACILITIES INCLUDING STORM DRAINAGE PIPE, MANHOLES, INLETS AND OTHER NECESSARY APPURTENANCES THERETO, ON SEVENTH AVENUE SOUTH, GRANT STREET TO KAGY BOULEV ARD AND ON THE NORTHERLY ONE-HALF OF KAGY BOULEVARD BETWEEN A POINT 200 FEET WEST- ERLY OF THE WEST LIlIJ"E OF SOUTH SEVENTH AVENUE AND A POINT 919 FEET EASTERLY OF SAID \<lESTERLY LINE. which Commission Resolution Nos. 1363 and 1365, passed as aforesaid, i1re hereby referred to and made a part- of this resolution for further particull'lrs in respect to the boundaries of said district, the character of improvement to be constructed therein, the estimated cost of s::lid improvements and the method of assessing the cost against the property within said district; and I WHEP.EAS, said improvements 1"5 contempIl"ted in said Commission Resolution Nos. 1363 and 1365 have been constructed and completed in accordance with thet.erms and conditions of Commission Resolution Nos. 1363 and 1365, and the total cost of said improvements so constructed is the sum of EIGHTY THOUSAND ($80,000.00) Dollars. NOllJ', THEREFORE, pursuant to the provisions of Sections 11-2201 to 11-2273 i1.nd 11-3301, H.C .M., 1947 and Bmendments thereto. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1- Tha.t to defray the cost and expense of constructing and Itaking the improvements in said Special Improvement No. 487, there be, and there is hereb;y levied and assessed a estimated tax Rmounting to the sum of EIGHTY THOUSAND ($80,000.00) Dolla,rs upon all the property in said Special Improvement District No. 487, and the estimated assessment of --- reported on ---, hereby Abated, and thi1t a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial pa;yrnent. to be made and the day when the same shAll be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made A pa.rt hereof; that the I several sums set opposite the names of the owners end the described lots and parcels of lAnd be, and the SRme I'1re hereby respectively levied <md pssessed upon and against said described lots and parcels of land to defrftY the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule "A'I, IOS required by 1:,,,,,.; that the payment of said sums shell be made in 20 inst,qllments I'md the p,'lyment of said C01'iIMISSION RESOLUTION NO. 1381 489 installment shall extend over 3_ period of 19 years; that the payment of the respective annul"l installment shall be made on or before the 30th day of November of each year until payment of all inst.<111ments together with the interest thereon, shall be made ; thAt said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of speciRl improvement taxes; that f8ilure to pay such assessmenLs when I the same become due and payable sh8ll make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the Clerk of the Commission of The City of Bozeman be, Rnd she is hereby ordered and directed to publish in the Bozeman Daily Chronicle, A da.ily newspaper printed and published in the said City of Bozemen, a notice signed by the Clerk of the Commission and stAting that a Resolution levying and assessing a special assessment of taxes to defrr:\Y the cost. and expense of constructing ,'1nd making the improvements in the said Special Improvement. District No. 487 is on file in the office of the Clerk of the Commission subject 1:.0 inspection for a period of five (5) days; that said Notice shall state the time and place !'tt which objections will be heB.rd by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) d1'1Ys before the day set by the Commission for the hearing of objections and the final adoption of this Resolution.
