AND TERMINATION OF EXISTING EASEMENT
THIS GRANT OF EASEMENT FOR IRRIGATION PIPELINE AND
TERMINATION OF EXISTING EASEMENT(hereinafter referred to"Agreement") is
made by and among Bozeman School District 7 of 404 West Main Street, P.O. Box
520, Bozeman, MT 59771-0520, (hereinafter referred to as "Grantor"), and DELBERT
AND DENA RICHTER, of 2950 Harper Puckett Road, Bozeman, MT 59718, SIMGRAF
CORPORATION of 326 N. Broadway, Bozeman, MT 59715, MICHAEL COK AND
KATHLEEN R. COK, of 3300 Harper Puckett Road, Bozeman, MT 59718,WILLIAM
AND MARGARET TATARKA, of 19 Lake Road, Bozeman, MT 59715, THOMAS AND

VESTA FERN ANDERSON & BAXTER RANCH HOLDING, LTD, of P.O. Box 3253,
Billings, MT 59103-3253 (hereinafter referred to collectively as "Grantees").
Grantor hereby grants an easement(hereinafter referred to as"Easement")to
Grantees, and their successors across Tract 2A of Certificate of Survey No. 2554A for
the irrigation pipeline route as depicted as on Exhibit A attached hereto and
incorporated by reference herein. The Easement shall be twenty(20)feet in width,
consisting of ten (10)feet on each side of the pipeline depicted in Exhibit A. The
Easement is perpetual and nonexclusive, and is granted for the purpose and use of
conveying irrigation water across Grantor's property by a buried irrigation pipeline and is
further for the purpose and use of operating, repairing, maintaining, improving and
replacing said irrigation pipeline. The Easement is not granted for any other purpose or
use than that specified herein..
Grantor further agrees that any encroachment into the easement corridor will be
limited to road and utility crossings for the provision of access and utilities to Grantor's
property and on-site sidewalk and asphalt parking/driveways for Grantor's property. No
other structures or trees may be placed within the Easement. Grantor further agrees
that should Grantor's property improvements need to be removed to repair, maintain,
improve or replace said irrigation pipeline,the Grantor shall be responsible for
replacement of Grantor's improvements once the irrigation pipeline work is completed.
Grantor further agrees it shall not grant an easement to any third parry allowing for the
installation of utilities to be located parallel to the irrigation pipeline located in the
Easement.

Should the Grantees discontinue use of the irrigation pipeline thereby
abandoning the irrigation pipeline,the Easement shall terminate within one year of such
abandonment, and the Grantees and their successors, heirs, and assigns agree to
voluntarily execute and record any documents necessary to extinguish the Easement
and terminate this Agreement.
The Easement granted by Grantor is for the benefit of those properties owned
and irrigated by the Grantees as of the date that Grantor executes this Agreement, and
shall not be expanded to include the delivery of water or benefits to other properties not
specifically referenced in this Agreement or other properties not owned by the Grantees
at the time of Grantor's execution of this Agreement, The right to use of this Easement
may, however, be transferred among and between the Grantees or their successors for
use at properties owned by them at the time of Grantor's execution of this Agreement.
In addition, the Grantees hereby terminate and relinquish to the Grantor any and all
claims to ownership or usage of that certain ditch easement crossing Grantor's property
and recorded with the office of the County Clerk and Recorder, Gallatin County,
Montana on June 16, 1902 in Deeds at Film 30, page 65 and attached hereto and
incorporated by reference herein as Exhibit B.

VESTA FERN ANDERSON &BAXTER RANCH HOLDING, LTD, of P.O. Box 3253,
Billings, MT 59103-3253 (hereinafter referred to collectively as"Grantees").
Grantor hereby grants an easement(hereinafter referred to as"Easement")to
Grantees, and their successors across Tract 2A of Certificate of Survey No. 2554A for
the irrigation pipeline route as depicted as on Exhibit A attached hereto and
incorporated by reference herein. The Easement shall be twenty(20)feet in width,
consisting of ten (10)feet on each side of the pipeline depicted in Exhibit A. The
Easement is perpetual and nonexclusive, and is granted for the purpose and use of
conveying irrigation water across Grantor's property by a buried irrigation pipeline and is
further for the purpose and use of operating, repairing, maintaining,improving and
replacing said irrigation pipeline. The Easement is not granted for any other purpose or
use than that specified herein..
Grantor further agrees that any encroachment into the easement corridor will be
limited to road and utility crossings for the provision of access and utilities to Grantor's
property and on-site sidewalk and asphalt parking/driveways for Grantor's property. No
other structures or trees may be placed within the Easement. Grantor further agrees
that should Grantor's property improvements need to be removed to repair, maintain,
improve or replace said irrigation pipeline,the Grantor shall be responsible for
replacement of Grantor's improvements once the irrigation pipeline work is completed.
Grantor further agrees it shall not grant an easement to any third party allowing for the
installation of utilities to be located parallel to the irrigation pipeline located in the
Easement.

Should the Grantees discontinue use of the irrigation pipeline thereby
abandoning the irrigation pipeline,the Easement shall terminate within one year of such
abandonment, and the Grantees and their successors, heirs, and assigns agree to
voluntarily execute and record any documents necessary to extinguish the Easement
and terminate this Agreement.
The Easement granted by Grantor is for the benefit of those properties owned
and irrigated by the Grantees as of the date that Grantor executes this Agreement, and
shall not be expanded to include the delivery of water or benefits to other properties not
specifically referenced in this Agreement or other properties not owned by the Grantees
at the time of Grantor's execution of this Agreement. The right to use of this Easement
may, however, be transferred among and between the Grantees or their successors for
use at properties owned by them at the time of Grantor's execution of this Agreement.
In addition, the Grantees hereby terminate and relinquish to the Grantor any and all
claims to ownership or usage of that certain ditch easement crossing Grantor's property
and recorded with the office of the County Clerk and Recorder, Gallatin County,
Montana on June 16, 1902 in Deeds at Film 30, page 65 and attached hereto and
incorporated by reference herein as Exhibit B.
