PLANNING DIRECTOR FINDINGS
File Name: Village Downtown Minor Modification to Final PUD Plan File Number: # Z – 04202A
PURSUANT to Chapter 18.36, BMC, and other applicable sections of Title 18, BMC, a review of the
minor modification to the final PUD plan described herein was conducted. The applicant presented to
the City a proposed minor modification to the final PUD plan to allow Lots 119, 121, 123, 125, 127 and
129 in the Village Downtown PUD to be changed from attached, single-family lots to detached single-
family lots. The applicant proposes to complete this minor modification with property boundary
relocation to achieve the minimum five-foot side yard setbacks. The purposes of the minor modification
to the final PUD plan review were to consider all relevant evidence relating to public health, safety,
welfare, and the other purposes of Title 18, BMC; to evaluate the proposal against the criteria of Section
18.36.040.C.4, BMC, and the standards of Title 18, BMC; and to determine whether the minor
modification to the final PUD plan should be approved, conditionally approved, or denied.
Staff reviewed the proposal and concluded that the request appears to meet the criteria for a minor
modification. The DRC reviewed the proposal on February 27, 2008, and recommended approval of the
minor modification to the final PUD plan subject to the following condition(s):
1. Street cut permits and the associated fees will be required for the abandonment of the water
service.
The Planning Director has found that the proposed minor modification to the final PUD plan, would
comply with the requirements of the Bozeman Municipal Code if certain conditions were imposed.
Therefore, being fully advised of all matters having come before him regarding this application, the
Planning Director makes the following decision.
The minor modification to the final PUD plan has been found to meet the criteria of Title 18, BMC, and
is therefore approved, subject to the conditions listed above and the correction of any elements not in
conformance with the standards of the Title. The evidence contained in the submittal materials,
advisory body review, and this finding, justify the condition(s) imposed on this development to ensure
that the final PUD plan and subsequent construction complies with all applicable regulations, and all
applicable criteria of Title 18, BMC.

This Planning Director project decision may be appealed filing a notice of appeal with the Clerk
for the City of Bozeman, within 4 days after the date of approval as evidenced by the Planning Director’s signature, by following the procedures of Section 18.66.030, BMC.
