Application P13024. MEETING DATE: February 24, 2014 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approval RECOMMENDED MOTION: I adopt Commission Resolution 4511 amending Figure 3-1, Future Land Use Map of the Bozeman Community Plan from Community Commercial Mixed- Use to Residential on 6.1591 acres at 964 Longbow Lane. BACKGROUND: The Commission preliminarily approved this growth policy amendment on December 16, 2013 subject to contingencies necessary to complete the amendment process. The approval was unanimous. The applicant has complied with all contingencies and is now seeking final approval and implementation of the amendment. A companion zone map amendment is also being processed at this time. Both applications use the same legal description which encompasses both developable property and to the centerline of the adjacent streets. UNRESOLVED ISSUES: None known at this time ALTERNATIVES: The City Commission has the following alternative actions available: 1. Approved the application as requested; or 2. Deny the application. Report compiled on: February 3, 2014 Attachments: Resolution 4511 120 Page 1 of 3 COMMISSION RESOLUTION NO. 4511 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, TO CHANGE THE BOZEMAN COMMUNITY PLAN FUTURE LAND USE MAP DESIGNATION FROM COMMERCIAL MIXED USE TO RESIDENTIAL FOR 6.1591 ACRES OF PROPERTY ON LOT 1, BLOCK 4, LAUREL GLEN SUBDIVISION PHASE 1 AND PORTIONS OF ADJACENT RIGHT-OF-WAY. WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since 1958; and WHEREAS, the City of Bozeman adopted it current growth policy known as the Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009; and WHEREAS, Section 17.4 of the BCP establishes criteria for amending the BCP; and WHEREAS, an application was submitted by the property owner, Manhattan Bank, on July 24, 2013, to amend Figure 3-1 of the BCP (future land use map) to change the land use from community commercial mixed-use to residential on Lot 1, Block 4, Laurel Glen Phase 1 Subdivision; and WHEREAS, a public hearing was held by the Planning Board on September 3, 2013; and WHEREAS, the applicant requested a continuance of the public hearing before the City Commission and therefore a public hearing was held on December 16, 2013; and WHEREAS, after considering extensive public comment, the recommendation from the Planning Board, and the staff report the City Commission found that the Criteria of Section 17.4 of the Bozeman Community Plan were met by the application. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: 121 Resolution 4511, Lot 1, Block 4, Laurel Glen Phase 1 Growth Policy Amendment Page 2 of 3 Section 1 Figure 3-1 of the Bozeman Community Plan is hereby amended to change the future land use designation from Community Commercial Mixed Use to Residential on a portion of land located at 964 Longbow Lane and more particularly described as: Description of Primary Growth Policy Amendment Tract Lot 1, Block 4 and portions of the adjacent street right-of-ways, Laurel Glen Subdivision, Phase 1, on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana, and located in the South Half of Section 4, Township 2 South, Range 5 East of P.M.M., City of Bozeman, Gallatin County, Montana and further described as follows: Commencing at the southwest corner of Lot 1, Block 4, Laurel Glen Subdivision, Phase 1; thence South 42°25'38" West 44.47 feet, assumed bearing, to the point of beginning; thence due NORTH 495.10 feet; thence South 79°14'29" East 234.72 feet; thence easterly 83.53 feet on a tangential curve concave to the north, radius 300.00 feet and central angle 015°57'09"; thence North 84°48'22" East 209.01 feet; thence South 05°11'38" East 494.88 feet; thence South 84°48'22" West 186.98 feet; thence westerly 121.59 feet on a tangential curve concave to the north, radius 500.00 feet and central angle 013°56'01"; thence North 81°15'37" West 262.30 feet to the point of beginning.
