Box 1230, Bozeman, MT 59771, a Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby release and reconvey the following described easement(s) unto Sundance Springs Residential Owners Association, Inc., a Montana Corporation, P.O. Box 933, Bozeman, MT 59771, described as follows: The 30 foot wide sanitary sewer easement that runs from the south end of Good Medicine Way to the north right of way line of Peace Pipe Drive, and being across the 12.64 acre Open Space parcel and centered on the common line between Lot 24 and Lot 25, as shown on the plat of SUNDANCE SPRINGS SUBDIVISION PHASE 1A, according to the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana. WITNESSETH WHEREAS the Grantor is the legal record title holder of the 30 foot wide sanitary sewer easement situated across the 12.64 acre Open Space parcel and centered on the common line between Lot 24 and Lot 25, as shown on the plat of SUNDANCE SPRINGS SUBDIVISION PHASE IA, City of Bozeman, Gallatin County, Montana. WHEREAS the above 30 foot wide sanitary sewer easement was granted on the Final Plat of SUNDANCE SPRINGS SUBDIVISION PHASE 1A, recorded on July 8, 1998 at the Clerk and Recorder's Office of Gallatin County, Montana. WHEREAS an alternative location was found for the construction of a sanitary sewer line without having to occupy said easement recorded on July 8, 1998 and the vacation of said easement will not adversely impact the Grantor's interests. WHEREFORE, the Grantor does hereby release and reconvey to Sundance Springs Residential Owners Association, Inc., a Montana Corporation those portions of the easement(s) located on the above described real property as set forth on Exhibit A attached hereto together with any right, title, or interest that the Grantor may have in said easements as set forth on Exhibit A attached hereto and incorporated herein by reference as though fully set forth and described as follows: The 30 foot wide sanitary sewer easement that runs from the south end of Good Medicine Way to the north right of way line of Peace Pipe Drive, and being across the 12.64 acre Open Space parcel and centered on the common line between Lot 24 and Lot 25, as shown on the plat of SUNDANCE SPRINGS SUBDIVISION PHASE IA, according to the plat thereof, on file and of record in the officeeoof the Clerk and Recorder, Gallatin County, Montana.
