LEGAL DESCRIPTION
A parcel of land, said parcel being Lot 3 and Lot 4 of Minor Subdivision No. 223, and a
portion of Pond Row as dedicated in said minor subdivision, and also including Tract C of the
Amended Plat of Van Horn Subdivision as recorded in Book E of plats on Page 339A, said
parcel being located in the Southwest Quarter of Section 11, Township 2 South, Range 5 East,
Principal Meridian Montana, City of Bozeman, Gallatin County, Montana, and , said parcel being
more particularly described as follows:
Beginning at the northwest comer of said Tract C; thence South 88'31'17" East, on the north
line of said tract, a distance of 297.85 feet; thence North 01'28'58" East, on the east line of
said amended plat, a distance of 99.01 feet; thence South 88'30'22" East, on the north line of
Lot 4 of said Minor Subdivision No. 223, a distance of 151.97 feet; thence South 01'29'38"
West, on the west line of Pond Row, a distance of 226.98 feet; thence South 77'10'30" East, d
distance of 60.79 feet; thence South 88'32'19" East, a - distance of 0.40 feet to the southwest
corner of Lot 2 of Minor Subdivision No. 223; thence South 88'32'19" East, on the south line
of said Lot 2, a distance of 120.43 feet; thence South 01'19'18" West, on the east line of Lot

The described parcel has an area of 12.724 acres, more or less. The described parcel is as
shown on the accompanying plat and is along with and subject to any existing easements.
The above described tract of land is to be known and designated as the AMENDED PLAT
OF TRACT C OF VAN HORN SUBDIVISION AS AMENDED BY PLAT E -39 -A, & LOTS 3 & 4, &
PORTIONS OF POND ROW IN MINOR SUB. NO. 223, City of Bozeman, Gallatin County,
Montana; and the lands included in all streets, avenues, alleys, and parks or public lands
shown on said plat are hereby granted and donated to the City of Bozeman for the
public use and enjoyment. Unless specifically listed herein, the lands included in all
streets, avenues, alleys, and parks or public lands dedicated to the public are accepted
for public use, but the City accepts no responsibility for maintaining the same. The
owners(s) agree(s) that the City has no obligation to maintain the lands included in all
streets, avenues, alleys, and parks or public lands hereby dedicated to public use. The
lands included in all streets, avenues, alleys, and parks or public lands dedicated to the
public for which the City accepts responsibility for maintenance include: POND ROW &
FOWLER AVENUE.
The undersigned hereby grants unto each and every person, firm or corporation, whether
public or private, providing or offering to provide telephone, electric power, gas, intemet,
cable television or other similar utility or service, the right to the joint use of an
easement for the construction, maintenance, repair and removal of their lines and other
facilities in, over, under and across each area designated on this plat as "UTILITY
EASEMENT" to have and to hold forever.
