GALLATIN ICE FOUNDATION—BOZEMAN AMATEUR HOCKEY ASSOCIATION—ICE FACILITY LOCATED AT GALLATIN
COUNTY FAIRGROUNDS
THIS AGREEMENT is made and entered into by and among the City of Bozeman, Montana ("City") as
grantor.and the Gallatin Ice Foundation ("Foundation") & Bozeman Amateur Hockey Association
("BAHA") as grantees.
WHEREAS,on October 9, 2006 and March 19, 2007,the City of Bozeman approved the Foundation's
request for the use of$300,000 of Big Box (Development Impacts Fund) Economic Development money
for the enclosure of Haynes Pavilion (in the amount of$125,000)and the construction of a "second
sheet of ice"at the Gallatin County Fairgrounds; (in the amount of$175,000); and
WHEREAS,the Haynes Pavilion was enclosed and the City paid $125,000 to the Foundation in 2007; and
WHEREAS,the need now exists to construct a second ice facility for quality organized ice hockey and ice
skating opportunities in the City of Bozeman; and
WHEREAS, the Foundation, in concert with Gallatin County, is now ready to proceed with the
construction of a new, second, indoor ice rink facility, "the Facility," at the Gallatin County Fairgrounds;
and
WHEREAS, Gallatin County Fairgrounds currently leases to BAHA the facility for winter use; and
WHEREAS,the Foundation has substantially completed the $1 Million fundraising necessary for"Step
One—Laying the Groundwork," which includes: Design, Engineering, Project Permitting, Site
Preparation, Northeast Entry Construction, Paved Parking at the Northeast Entry, and Erecting the
36,000 sq ft Building Shell; and
WHEREAS,future phases of the project are anticipated to include "Step Two—To Skatable Ice ($1.5M)"
which includes: Mechanical Room Addition, Installation of Ice Plant, Installation of Refrigerated Rink
Slab and Floor, Building Lighting, Interim Locker Rooms, Restrooms&Seating; and "Future Steps—
Finishing Touches" which includes. Locker Room Connector Addition, Permanent Seating and
Mezzanine, Central Entry, Lobby, Concessions,Skate Shop and Event Rooms, Program and
Administrative Offices, Restrooms,Signage,Additional Parking, and Site Landscaping. Construction and
installation of these items will occur as funding becomes available; and
WHEREAS,the Foundation has provided evidence of existing pledges and donations that match and
exceed the City's$175"000 contribution;
The Parties agree:
1. The City will grant and release to the Gallatin Ice Foundation a sum of One-hundred and
seventy-five thousand dollars ($175,000.00) from its Development. Impacts Fund.
2. The Foundation will use the money towards the construction of an indoor ice facility at the
Gallatin County Fairgrounds, adjacent to the existing Haynes Pavilion.
3. The Foundation and BAHA will continue to provide time available at the Facility and the Haynes
Pavilion,where the public has reasonable opportunity to enjoy open skating time.
4. The Foundation will provide the City with copies of paid invoices totaling$350,000(representing
the City contribution plus match)for the construction uf the Facility.
S. The City will have no current or future obligations for funding the operations, maintenance,
replacement,or insurance of the Facility.
6. The City will have no current or future obligations for the adequacy of the construction or
operation of the Facility,
7. The grantees agree not to discriminate in the use or expenditure of funds provided by the City
no the basis of race, color, religion, creed,sex, age, marital status,national origin, or actual
or perceived sexual orientation,gender identity urdisability. The grant recipients agree this
requirement shall apply to all contractors and subcontractors retained or hired by them using
funds provided under this Agreement.
